HomeMy Public PortalAbout1959 August - October Council Minutes 2 S 4 August 3, 1959 A regular meeting of the Board of Trustees of the Village of McCall Valley County, Idaho was held on the above date and the following business transacted. Members present were: Roberts Fortin Ruark I ?urns ide '� For?a tr lso presort was Charles ryence, Village !`.ttorne . Ruark moved the meetinrr of July 6, 1959 be adjourned which motion was seconded by Fortin and declared carried unanimously. The minutes of the previous meeting were read and approved as read with the correction that the row flan of the Vi l fare J,hould he in the custody of the American Legion. ' he minutes were approved with this correction. Regarding the !etcott nil Company Lease to purchase the 'festoott property, Soerce stated a new agreement, a warrenty deed, and an escrow agreement had been delivered to him by the Westcott Oil Co. The contract was discussed in part by Spence and the changes in the wording were noted. Following discussion, Fortin moved the Chairman and Clerk he authorize:' to sign the agreement to purchase th^ "estcott property. The motion was seconded by Ruark and declared • carried unanimously. Regarding the crossing on Stibnite Avenue,' -1ckaret reported the plank had been ordered and delivered to the section house for installation by the section crew. MOW Roberts read a letter from Robertson "'. Smith repoeting the prelim- inary work on the zoning had been completed and he would make a • survey of the physical set up of the Village in the near future. Ruark reported nothing new on the dog pound construction. Fortin re"orted he was still at. temptina to get the dump road surveyed. Spence reported on a meeting with Ronald J. Hamilton on the negotiation for the purchase of the necessary ground at the golf course. Spence reported he paid 4000 for the ground and tha proreta portion would be `>1060 and allowing him access to the property. There followed a discussion on the purchase price paid by Hamilton and the amount which would be paid by the Village under a condemnation procedinc. Following discussion on past use and values in other parts of the Village, Burnside moved the foard offer him 1500 for the land with no easement. the motion was seconded by Fortin. 0uestion7 in favor • of the motion; Fortin and Burnside, against the motion; Ruark and Roberts. The motion failed for lack of majority. Ruark moved an offer S be made in the amount of 1300 and access t thpe property be riven 1 DLer Hamilton. The Chairman declared the mot o n or want of a second. No further motions being made, Spence was instructed by the Chairmen to negotiate with Hamilton without an offer. Burnside reported on the caddy house construction at the golf course end stated it would not be completed in the 30 day construction period. He reported briefly on the tournement which was started and stated that about five points wc,uld be played in the lady's tournement. he stated the troohi^s were also here and the fees were raised to S7. 50 for the men and 4e'4. 00 for the women. ' he activities of Newt . Carter were briefly discussed. The following fuel oil bids and Gasoline bids were ,*ad to the Hoard in response to the advertisement for bids. Standard Oil company, furrise oil , 13. 10, stove oil, 16. 6 ; 'e.stcott Oil C mpeny, dlesdl oil, 15. 60, stove oil, 17. 10, gasoline, 25. 50. Followin - discussion of the bids, Fortin moved to accept the low bid of >tandard Gil Company for furnp4.c oil and stove oil . Thr motion to accept the tow bid was seconded by I/yark and dectareG carries' unanimously. Regarding the gasoline bid, 8 Ruark moved to accept the bid of Westcott Oil Company of 25. 50 as the only bid submitted. The motion was seconded by Fortin and declared carried unanimously. The petition of Jim Eiseman for permission to construct, install, and maintain a 6 in. sewer line in the right-of-way of Mather Road in Brundage subdivision was read. Ackaret stated no objection would be had other than the outfall be below the water line at low water time. Following further discussion on the Eiseman petition, Burnside moved the petition be granted with the condition that any outfall be below the water levet at Low water time and the sewer be constructed to Village specifications and approved by the V- ttage Water superintendent and the State of Idaho. The motion was seconded by Ruark and declared carried unanimously. R,EGrs fEK f C.L. Burdett, who was present, stated he wanted toAcomplainTabout the Dorris dog situation. He reported he was selling his property and afraid he would meet with some objection due to the odor of the dogs and requested the Village to take some action. Spence reported on the course of action open to the Village. Following discussion on the various alternatives, Fogg moved the Chairman and Clerk be instructed to send a notice to Dorris to abate the nuisgnce. The motion was seconded r.„. by r''urnside and declared carried unanimously. Rewarding the proposed T' hangers for private aircraft at the airport, Fogg reported that about four people wanted the hangers and still were discussing labor bids as the bids that were received appeared to be too high. D.U. Rowles, who was present, discussed the property of the Gem State Telephone Company Warehouse which is located adjacent to the tie-down .area at th - airport and stated it would be necessary to fence the area due to thefts of property at the warehouse. An examination of the platt snowed the Gem State property tine to extend out into the taxi way. He stated he wanted to trade that area for another piece of --- Village around behind and southwest of the warehouse. Following dis- cussion/an easement between the Gem State Telephone Company and the Village of McCall for uce appeared to be the best solution. ooherts stated that the easemeht should he tabled until the area can he staked and decide the basis of trade. • Ackaret reported he had not contacted Cambell on CamRell sewer but the tine could not be purchased because the line was not built to Village specifications. Ruark stated he had no report on the caution light. The Clerk reported approximately $890 had been received in spray dohations. The request of Pero H. Shelton and the Mission Subdivision was britfly discussed following which Fogg introduced and moved the adoption of proposed ordinance ft 211, an ordinance anexing certain land to the Village of McCall, Valley County, Idaho Lying contiggous to the present limits of .said Viltiare. Burnside moved the rules be suspended for the passage of proposed ordinance 1/211 which motion was seconded by Fortin and declared carri ?d unanimously. Burnside seconded the motion moving the adoption of proposed ordinance /4211 . Question: ordinance #211 was declared carried unanimously. Fortin moved the subdivision known as the Mission Subdivision be accepted end authorized the Clerk to certify the same to the county commissioners. The motion was seconded by ,jurnside and declared carried unanimously. Regarding the amendment of the budget, a letter from the McColl Memorial Hospital Board was read requesting an additional ,S5000 be included in their budget for the conversion of the heating plant to oil, purchase of new beds, and etc. Also, the golf course budget was increased by $3000 due to the new construction. Fogg reported on the bid from Stanley on the gravel and reported the County would haul the gravel for nothing and we would be re-imbursed by the State at approximately 20% or $1000. The airport budget should be increased by approximatly ,$2000 to cover this expenditure. Fogo briefly explained the extention of the runway with oil and gravel as proposed. .Following further discussion, Fong moved to in- crease the budget for the 1959- 1960 Fiscal year by the amount of .S10,000 as follows: golf course construction, 3000, hospital expenso, `s500O; airport expense and construction, '2000. The motion was seconded by 2 s 6 eeirnside and declared carried unanimously. v'rrnside introduced and moved the adoption of proposed ordinance "f212, an ordinance termed The Annual Apprppriation Dill appropriating; such sums of mone'- oe are deemed necessary to defray all necessary expenses and liabilities of the Village of McCall . Idaho for the fiscal year 1959-1960 and fixing the fax levie for the Village of McCall, Idaho for the fireel year 1959-1960. ~'uark moved the rules be suspended for the passage of proposed ordinance ',f212. Fortin seconded the motion moving the adoption of proposed ordinance #212 and the ordinance was declared carried unanimously. The Chief of Police report on the recomendations on the promgbation of traffic rules was briefly discussed. The Chairman stated the matter would tabled urtil a Later meetine. Foga moved the t H. L. Ruark be authorized to sign at the bank on general fund expenditures in the absence of the Chairman. The motion was seconded by ''urnside and declared carried unanimously. A letter of thanks frgm the Idaho Municipal League to the Village was read by the Clerk. "pence reported a Letter to Pete Stewart sent ie reruested by the Soard. Ackaret read e bill from Everett on the broken water line Znr' the meter charge. The matter was turned over to Ackaret and Forg for recommendation to the Board. -The several bills were read for payment following which Fortin moved the bills he approved and ordered payed which motion was seconded by Foga and declared carried unanimously. C irman a• Clerk: 'TTF.ST /.urust 21, 1959 A continuation of the regular meeting of August 3, 1959 of the Board of Trustees of the Village of McCall, Valley County, Idaho was held on the above date and the following business transacted. Members present: Roberts Ruark Fogg Fortin-absent Burnside-absent. • The '-hairman stated the meeting was called for the purpose of cohsidering the letter from the McCall Memorial Hospital Board for the conversion from coal to oil heat. A letter from the McCall "emorial hospital board recommending the bid of Neal Volker in the amount 52763 he accepted. Following discussion Foga moved the action of the McCall memorial Hos- pital Board be approved and the bid in the amount of `a2763 submitted by Neal '.Talker be accepted. The motion was seconded by Ruark and declared carried unanimously. A letter from Ronald J. 1 iamilton requesting a 2 inch water line run on to his property was read to ,r ,, Board. Fong stated, following a con- ference with Leanord -}rkerat, that the line could not be run on to his property for several reasons. First the lateral to number 3 green was laid very close to the surface of the ground and was turned off early in the fall to prevent freezing. Also, there was the possiblit_y of an inadequate supply for both golf course use and Hamilton 's use. In the event that he would want a 2 inch line he would have to hook on at his own cost as that size line does not meet Village specifications. The Clerk was instructed to inform kr. Hamilton that the Village would install a three quarter inch lihe for a distance of 40 feet or across thr' street at what ever point might be closest to the cd.-'e of hi - property. The Clerk was instructed to inform %':r. Harmiiton of the L?oard s actions. The promulgation of traffic rules as recommended by the Chif of frolicy was tabled until a full :.oard was present. There followed a discussion on the basic speed in the "i ' !a'-e of t'cC ll in rei"tien to basic speeds in other cities and ' illn'es trrourhout the .State. Members present were Roberts rr Burnside it Fortin rr Fogg rr Ruark Absent Also present was Charles Spence, Village Attorney The minutes of the previous meeting were read and approved as read. John Carrico, who was present, stated he was desirous of purchasing a portion 'of the around o -ned by the Village of McCall on the North ' side of the Golf Course. He briefly outlined the ground he felt was necessary toward the developing of his subdivision. There followed a discussion on the legal requirements of holding an election and etcetra prior to the time the ground could be sold. Following discussion Spence was instructed to work with Carrico on a trade of adjoining ground on the foot by foot trade with provisions granted for street right of way. Fogg briefly reported on the last zoning and planninc commission meeting and stated Henry Allen was to act as Chairman until a full quorum could be present for the election of a permanent chairman. Spence reported the requested appraisals for the Nestcott Oil Company had been forwarded to them. owner., Regarding the road to the new dump ground Ackaret reported the cat would soon be in and work could be resumed on the road construction. Burnside reported the doors at the caddy house were in and the building was locked. Archie Rose had almost completed the finishing work. There followed a discussion on the type of floor covering following which Roberts stated Shawver recommended some type of asphalt be poured which would be suitable for caddy house use. The floor covering was briefly discussed and also stools for the counters and the necessary tables. Roberts reported also that the arrangement with the golf course leasee would have to be reviewed as well as also the possible revision in golf rates. Burnside reported the green were being repaired and the use of the Verticut machine. e( „ €) Spence reported he had contacted Hamilton 's attorney and the attorney had not seen Hamilton. Spence requested a formal offer to be presented to the Dewey Davis people, then if declined the Village could proceed with condemnation proceedings. Following discussion Fortin moved that Spence be authorized to offer $350 for the land in question in the approximate amount of three quarters acres. The motion was seconded by Fogg and declared carried unanimously. It was reported by Fogg that some hangers would possibly be constructed this fall at the airport. Roberts suggested that the construction -'- be started some where down from the edge of the property line. Ackaret reported that the toilet facilities at the Riverside Bridge had been completed and were acceptable by the Village. Roberts suggested a special meeting be held on the traffic code as soon as Ruark returned to the Village and was available for a meeting. . Regarding the claim for the glasses of Edwin Alexander which had been broken while on duty, Spence reported that the Village was not legally liable for the glasses as they are personal property. The Village would be liable only under personal injury and a change of glasses as a result. Roberts suggested that the Village might pay a portion of the bill if a precedent would not be sent. A committe of Ruark, Spence, and Blake were appointee' to make a recommendation to the Board. In the interim Alexander should pay for the glasses. Roberts reported nothing new on the hospital financtg for the proposed addition to the hospital. Ackaret reported on the bid for the laying of the water line in Reedy Lane from Ray Lappen. The bid was approximately a dollar per foot to excavate and fill, repair any breaks, hydrants $50, and '40 for connections. The approximate length of the line would be 700 feet. Following discussion Fogg moved to instruct Spence to draw up a contract with Lappen in acceptance of the bid which motion was seconded by Fortin and declared carried unanimously. Ackaret reported on the Pen Lomand Corporation sewer plans. The line was partially installed prior to state approval with the understanding if it were not approved it would be plugged and not used until state approval was given. Ackaret also reported that there would l;e no graveling on the roads that they are building in the new subdivision at present. There followed a short discussion on the application of fluorine, chlorine, and line in the water system and the reasons for the fluorine not being applied. • The Barnett water bill was discussed and Ackaret reported on the meter inside the service station which should offset the charge which had been made to the Hilltop Motel on the adjacent building. Ackaret stated he would contact Mrs. Barnett and reach an agreement on the charges. It was reported the LaFay house was now hooked on the sewer line. The audit proposal of Rife, Wilson i Pryzybylski was read to the Board. Following discussion on the rates Fogg moved to accept the audit contract as presented, which motion was seconded by Burnside ---' and declared carried unanimously. The several bills were read for payment. Members present were: Roberts " Fortin if Ruark Fogg II Burnside Absent The Chairman stated the meeting was called for the purpose of considering the traffic code and the adopting of the rules and regulations of same. There followed a discussion on the traffic code and postings as recommended by the Chief of Police and amended by the Board of Trustees, following which Fortin moved the adoption of Order #1 of traffic rules and regulations for the Village of McCall. The motion was seconded by Ruark and declared carried unanimously. It was reported by Fortin the dump road .vas being worked on and nearing completion. There followed a discussion on the contracting of the building of the fence adjacent to the road as agreed upon with Deinhart. j— Regarding the proposed addition to the hospital and the possibility of Hillburton Funds, Roberts reported that the necessary forms had been completed and were being considered at the next meeting of the Hospital Facilities Section. He also reported the X-ray had been purchased by the hospital. The bill of Archie Rose in the amount of $537. 50 for finishing work at the Golf Course Club House was read, following which Fortin moved the bill be approved and ordered paid which motion was seconded by Fogg, r and declared carried unanimously. ks;1 Regarding his previous appointment on a committee to determine if the Village should pay for any portion of the eye glasses of Edwin Alexander that were broken in the line of duty Ruark reported that he felt the Village should pay for some portion of the glasses. Fogg suggested the Village get a break down on the bill and the Village pay for the lenses only, excluding any cost for frames, eye examinations, and etcetera. Following further discussion„ Ruark moved the village of McCall pay for the cost of the lenses only, which motion was seconded by Fogg, and declared carried unanimously. The Clerk reported on the balances in the Water Revenue Fund, the Sewer Revenue Fund, and the Village General Fund, following which Fogg moved the water line in the Hoff and Brown addition in the amount of $3131.79 be purchased from Brown 's Industries from the special Water Revenue Fund. The motion was seconded by rortin and declared carried unanimously. Following discussion on the Sewer Revenue Fund, Fogg moved that the Village transfer $ ,000 from the Sewer Revenue Fund to the Village General Fund. The motion was seconded by Ruark and declared carried unanimously. Fogg reported the several hangers were under construction at the airport and that the girders are available to build five units and they very possibly would not be available in the future. The possibility of stock piling some of the girders by the Village was discussed. Fogg stated he would report at the next meeting on the availability of girders.
