RESOLUTION 2017-100
RESOLUTION GRANTING LOT COMBINATION APPROVAL
TO DAVID AND KATHERINE CROSBY FOR
PROPERTY AT 2402 HAMEL ROAD
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, David P. Crosby and Katherine P. Crosby (the "Owners") own property
located at 2402 Hamel Road ("Parcel 1"), which is 71.5 acres in area and is legally described as:
the East zofthe Southeast Quartet of 'section township 118, Range 23, except ,lea: parr of
the Southeast Quarter of the Southeast Quancr of Section 9. Township 118 IN Range 23
West of the 5'1' Principal Meridian. described F> follows:
Beginning at tnr Southwest corner of maid Southeast Quarter of the Southeast Quarter: thence
cast along the South line of said Southeast Quarter a, distance of 615 feet; thence deflecting lett
87 degrees 40 minutes it distance ref 52o feet; thence deflecting left 88 degrees a distance of 175
feet: thence deflecting right 38 degrees a distarnbe of 83 feet; thence deflecting left 19 degrees 30
minutes to the West line of said Southeast Quarter of the Southeast Quarter; thence South to the
point of beginning, according to the l;nited States t_iocenunent thereorand .situate in
Hennepin C. om», Minnesota.

WHEREAS, the Owners also own property immediately to the east ("Parcel 2"), which
is 33.3 acres in area and is legally described as:

Range 2.3 except that part thereat lying Easterly of the center line of i lan,el Road. Hennepin
County. Minnesota

WHEREAS, the Owners have requested approval of a lot combination to combine
Parcel 1 and Parcel 2 into a single parcel which is proposed to be legally described as in
Exhibit A, attached hereto (the "Property"); and
WHEREAS, the City Council reviewed the requested lot combination at the December
5, 2017 meeting and reviewed testimony of interested parties; and

WHEREAS, following such review the City Council made the following findings:
1) The proposed lot combination is not in conflict with the general and specific plans of the
City and is not premature.
2) The lot resulting from the lot combination exceeds minimum lot standards, is suitable for
the type of use contemplated, and is otherwise not in conflict with the findings noted in
Subd. 10 of Section 820.21 of the City Code.
NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota
hereby grants approval to David and Katherine Crosby for a lot combination of Parcel 1 and
Parcel 2 into a single parcel as described in Exhibit A, attached hereto, subject to the following
terms and conditions:
1) The Owners shall file necessary documents with Hennepin County to effectuate the lot
combination prior to June 14, 2018 or the approval granted herein shall become null and
void, unless an extension is granted by the City Council.
2) The Owners shall abide by the recommendations of the City Attorney related to recording
procedures and title documentation.
3) The Applicant shall pay to the City a fee in the amount sufficient to pay for all costs
associated with the review of the application for lot combination.

The motion for the adoption of the foregoing resolution was duly seconded by member Anderson
and upon vote being taken thereon, the following voted in favor thereof:
Anderson, Cousineau, Martin, Mitchell, Pederson
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
