That decision was based on the minimal amount of work required on the inspection reports that had been prepared last week by the Building Official (Ray Hord) and the Chatham County Fire Marshal (Rodney Smith). That agreement continues despite the fire at this location on Saturday, April 21. I discussed with Ray on Friday that a temporary C.O. would not be issued given the minimal amount of work required in order for a C.O. to be issued. Perhaps a miscommunication occurred between Keith, Jr., and Ray, or Keith, Jr. and yourself, or perhaps Ray was unclear on my position of not issuing temporary Certificates of Occupancy. Following my telephone conversation with you earlier today Ray did call me about this job. He said he made it very clear to Keith, Jr., on Friday that despite what was written on the inspection report about a temporary C.O. and a May 21 building final deadline, he was not the decision -maker on issuing or not issuing a temporary C.O. The repairs that are now needed due to the April 21 electrical fire can be accomplished along with the items on the above list. Please call following completion of the work to schedule an inspection. A Certificate of Occupancy will be issued as soon as the remainder of the electric work passes inspection and the reinspection of the building final passes inspection. Over and over Ray and I hear contractors /property owners /business owners express their anticipated completion dates but those dates are not met due to unexpected construction delays. My position remains that a deadline date established by an owner or a contractor will not be the basis for issuing a Certificate of Occupancy, nor will it be a reason for allowing temporary or conditional occupancy. Keith is still overlaying the existing ground with porous pavement. There has been no land disturbing activity,.... until now. I sent you two pictures earlier. They show dirt on the sidewalk, drive, HWY80 gutter and the Hwy 80 pavement. I had a second discussion with Keith Gay and his workers on this Sunday morning around Sam as they commenced work. They assured me that there would be no traces of sand or stone outside of their work area. I will reinspect this work at 4pm today. Please forward this to Keith to advise him of the violation. As simple as this is to sweep, there is NO EXCUSE for this. I am concerned no only about the sand, soil, etc... reaching state waters, but also the safety concerns of the stone on the sidewalk and pavement. Last Sunday was not the first time I discussed this with Keith and site personnel. While there is not an exemption that exactly matches this situation, the replacement does not pose a threat to state waters. Specifically, the proposed activity is located in the rear south side of the commercial lot at 1106 E HWY 80, Tybee Island, GA 31328 (PIN 4- 0026 -11 -008). The rear of the building is within 25' of the top of bluff along an existing tidal canal at the marsh. The area beneath the building and south to the top of the bluff is a mixture of concrete slab and patio consisting of both concrete and brick. Specifics as I understand them and described to Shannon are: 1) The Engineer's concern is that there is no basis for supporting even an assumption that the 3 post foundations supporting the elevated rear of the building are properly sized and installed. The Engineer pointed to the post support appearing to be only one layer of concrete blocks over what appears to be a patio. While the two end posts do not show any evidence of failure, the slab has cracked at the middle post support. The Engineer pointed to the lack of proper connection of the posts to the existing concrete block supports as justification for his concern. It is due to the Engineer's concern for safety of building occupants that I pursued this matter to closure within 24 hours of it being presented yesterday. 2) The area to be removed and replaced would be well under 100sf. 3) The Engineer's plans will call for all excavated soil to be placed in small containers such as wheelbarrows and not deposited onto the brick or concrete surface. Additionally the plans will call for a row of pine straw bales along the top of the bluff which can later be used for mulch maintenance in the flower beds at the front. i In summary, I find the proposed work to be a minor land disturbance activity. Please advise when the formal submittal is ready for my concurrence. A natural canopy is left in sufficient quantity to keep shade on the stream bed; and f. No concrete and /or asphalt slabs, pads or foundations. constructed or placed as a part of the site preparation, construction or subsequent development. 2. A pervious ground level walkway approach to a dock and /or similar structure, provided: a. No more than 100 square feet of the constructed walkway extends into the buffer, with an exception for structures compliant with the Americans with Disability Act (ADA); b. No grading, cutting, filling or similar land- disturbing activities occurring as a part of the site preparation, construction or subsequent development; c. No concrete and /or asphalt slabs, pads, supports or foundations constructed or placed as a part of the site preparation, construction or subsequent development; and d. All ground preparation and walkway material placement is completed with the use of hand -held equipment. 3. Restoration of buffer area after the removal of an existing structure, provided: 1 Revised September 2009 a. No more than 100 square feet of the structure footprint is in the buffer; and b. The buffer area must be replanted with native vegetation. 4. Maintenance or repair of existing structures, the failure of which would result in a threat to human health or State waters, such as sewer lines, water lines, dams, or gas lines. Total disturbance must be less than 100 square feet. 5. Placement of rock riprap within the buffer not to exceed 100 square feet on any one property, provided: a. The placement of the rip -rap does not result in soil disturbance outside the placement area; and b. No grading, cutting, filling or similar land- disturbing activities occurring as part of the site preparation, construction or subsequent development. B. The following land- disturbing activities are examples of projects that are NOT considered minor land- disturbing activities and therefore, NOT exempt from the Georgia Erosion and Sedimentation Act and the applicable buffer requirements for State waters: '1. Any land- disturbing activity utilizing wheeled or tracked machinery and equipment resulting in soil erosion within the buffer; 2. Paving with poured or prefab concrete and /or asphalt; 3. Any project or combination of projects occurring within the same calendar year on the same property resulting in more than 100 square feet of any elevated structures and /or pervious ground level walkways within or extending into the buffer; , 4. Construction of a barbeque pit on a concrete and/or asphalt slab or pad within the buffer; 5. Construction of a ground level patio within the buffer; 6. Construction of a swimming pool within the buffer; 7. Construction of a structural or decorative retaining wall within the buffer; 8. Construction of a new seawall with land - disturbing activities occurring within the buffer; and 9. Backfilling any new seawall construction within the buffer. In addition, O.C.G.A. 12- 7- 6(b)(15)(A) and O.C.G.A. 12- 7- 6(b)(16)(A) state that "No land disturbing activities shall be conducted within a buffer and a buffer shall remain in its natural, undisturbed, state of vegetation until all land - disturbing activities on the construction site are completed. Once final stabilization of the site is achieved, a buffer may be thinned or trimmed of vegetation as long as a protective vegetative cover remains to protect water quality and aquatic habitat and a natural canopy is left in sufficient quantity to keep shade on the stream bed; provided, however, that any person constructing a single- family residence, when such residence is constructed by or under contract with the owner for his or her own occupancy, may thin or trim vegetation in a buffer at any time as long as protective vegetative cover remains to protect water quality and aquatic habitat and a natural canopy is left in sufficient quantity to keep shade on the stream bed." Therefore, for Common Development construction projects covered under the NPDES General Permit for Storm Water Discharges Associated with Construction Activity (Permit), the exemption for minor land- disturbing activities (O.C.G.A. 12 -7- 17(3)) within the buffer for State waters would not be applicable for an individual lot(s) until such time as a Notice of Termination (NOT) for the Common Development had been submitted in accordance with the Permit. 2 Revised September 2009 For Stand Alone and Infrastructure construction projects covered under the Permit, the exemption for minor land- disturbing activities (O.C.G.A. 12- 7- 17(3)) would not be applicable for a construction project until such time as a NOT is submitted in accordance with the Permit. Based on the minor land disturbing guidelines, it is the City's position that based on current ordinances this would not be a minor activity which Tybee could permit as the issuing authority but would instead require a state buffer encroachment variance. While the deficiencies are not necessarily the fault of the Owner or his agent, they are their responsibilities. The two areas of deficiencies are in the two most basic and common BMPs on local projects. They are: Co — Construction Exit Sdl — Sediment Barrier Correct installation information can be found not only in the "Green Book" but in the Field Manual for Erosion and Sediment Control in Georgia, Fourth Edition 2002, 4310 Lexington Road, P.O. Problems with the Co is not limited to the installation, but to the material. Specifically, the job site personnel are telling me the stone delivered is the 1.5 " -3.5" stone they requested. I have experienced on my own proj ects suppliers not adhering to the specs they are given with the orders. While I regret this situation, I will no longer be accepting any deviation from the State requirements. The stone will be a representation of 1.5 " -3.5" stone or larger. Gradations that are obviously smaller will no longer be tolerated. The smaller stone allows for a smoother surface with smaller voids, thereby reducing the function of the construction exit. Similarly, I am finding Type A sediment barriers installed where Type C is required and shown on the permit drawings. I have attempted to work with the Owners through increased inspections, additional backup BMPs, etc. This has evidently become common knowledge based on the installations I am finding. Where two rows are called for they will be installed with a separation that allows for the first one to fail (fall over) without impacting the second one. The complete assembly and installation must be compliant; steel or wood posts, post spacing, Type C or A. There has been no discharge into state waters due to previous occasional deficiencies. However, the increased frequency has created unnecessary exposure to: 1) Sediment discharge into nearby waters of the State, 2) Increased maintenance efforts by the DPW on downstream lines. 3) Due to #2, higher cost to island taxpayers. I will be adhering strictly to the manual on all BMPs and not just these two.
