RESOLUTION NO. 20-9771
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
OPA-LOCKA, FLORIDA, URGING MIAMI-DADE COUNTY
MAYOR CARLOS A. GIMENEZ AND THE BOARD OF COUNTY
COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA TO
TRANSFER CORONAVIRUS AID, RELIEF, AND ECONOMIC
SECURITY ACT (CARES) ACT DIRECT FEDERAL FUNDS
RECEIVED BY MIAMI-DADE COUNTY TO THE CITY OF OPA-
LOCKA AND TO OTHER UNITS OF LOCAL GOVERNMENT
WITHIN THE COUNTY BASED ON POPULATION AND RATES
OF COVID-19 CASES; FURTHER DIRECTING THE CITY CLERK
TO TRANSMIT A COPY OF THIS RESOLUTION TO THE
OFFICIALS NAMED HEREIN; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Coronavirus Aid, Relief, and Economic Security ("CARES") Act
was signed into law on March 27, 2020 and appropriated $150 billion of direct federal
funding for state and local governments to address unforeseen financial needs and risks
created by the Novel Coronavirus ("COVID-19") pandemic public health emergency;
and
WHEREAS, states and units of local government with more than 500,000
residents received direct federal funding through the Coronavirus Relief Fund; and
WHEREAS, twelve (12) localities in the State of Florida ("State") received direct
federal funds and NO city in Florida (except the combined city/county government of
Jacksonville / Duval County) received direct funding; and
WHEREAS, the CARES Act appropriated nearly half a billion dollars
($474,085,078.50) to Miami -Dade County ("County"), making this the highest amount in
direct federal funding to any eligible local government in the State as indicated in the
attached and incorporated list of Payments to States and Eligible Units of Local
Governments; and
WHEREAS, the City has taken unprecedented steps in response to the impact of
the COVID-19 pandemic on our community to include hosting various testing and
feeding sites that have served residents from the County; and

WHEREAS, the City has experienced unforeseen financial needs and risks
created by the COVID-19 pandemic public health emergency; and
WHEREAS, other units of local government within the County have also
experienced unforeseen financial needs and risks created by the COVID-19 pandemic
public health emergency; and
WHEREAS, in conversations with the Miami -Dade County League of Cities, the
County committed to transferring CARES Act funds to units of local government within
the County; and
WHEREAS, the City Commission finds that it is in the best interest of the City
and its residents to urge the County Mayor and Board of County Commissioners to
transfer Coronavirus Aid, Relief, and Economic Security Act direct federal funds
received by Miami -Dade County to the City and other local government units
within the County.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA LOCKA, FLORIDA:
Section 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
Section 2. AUTHORIZATION
The City Commission of the City of Opa-Locka urges Miami -Dade County Mayor
Carlos A. Gimenez and the Board of County Commissioners to transfer CARES Act
funds to the City of Opa-Locka and to other units of local government within the
County based on population and rates of COVID-19 cases.
Section 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected copy of same with the City Clerk.
Section 4. INSTRUCTIONS TO THE CITY CLERK.
The City Clerk is directed to transmit a copy of this Resolution to Miami -Dade County
Mayor Carlos A. Gimenez and the Board of County Commissioners.
Section 5. EFFECTIVE DATE.
This Resolution shall take effect immediately upon adoption, and is subject to the
review of the State of Florida Financial Emergency Board for the City of Opa-locka, FL.

Short Title:

Staff Summary:
The City of Opa-locka has experienced unforeseen financial needs and risks created by the COVID-19
pandemic public health emergency, therefore staff recommends the approval of this legislation which will
immediately protect the public health, welfare, and safety of the City s residents.
Proposed Action:
Staff is recommending the legislation and immediately transmit a copy to the Miami -Dade County Board of
County Commissioners.
