Roll Call:— W. E. Jordan, Chairman M. R. Bonecher N. A. Carr Meeting was called to order by Chairman Jordan. R. Bonecher moved that the attached street lighting contract submitted by the Idaho Power Company be accepted, motion seconded og m. 4. Carr. Motion carried. Ordinance No. 100 was then introduced. Moved by N. A. Carr, second ed by M. R. Bonecher that an emergency exists and ordinance Bo. 130 oe read once in cull and twice by title. Motion carried by the following vote:- M. B. Bonecher, .eye; N. Carr, Aye; 4. E. Jordan, :eye. Ordinance Sao. 161 was then introduced uy N. A. Carr, seconded oy M. R. Bonecher that an emergency exists and Ordinance No. 131 be read once in roll and twice by title. Motion carried uy the following vote:-ia. R. Bonecher, _ye; m. Carr, .;ye; W. E. J or dace , Wallace Hiatt was appointed as Trustee of the Village of McCall to fill the unexpired term of w. E. Mowrey, who resigned. Treasurer rteport : -- Deposited in Donnelly Bank July 1 to July 31, 1944 43088.58 warramts Drawn 1473.14 Balance on Deposit July 3k, 1944 7206.52 Attest:- P - / ORDINANCE NO. /2 9 AN ORDINANCE GRANTING TO IDAHO POWER COMPANY, ITS SUCCESSORS AND ASSIGNS, AN FT.ECTRIC LIGHT, HEAT AND POWLR FRANCHISE. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF McCALL, VALLEY COUNTY, IDAHO, THAT: Section 1. There is hereby granted to Idaho Power Company, its successors and assigns (herein called the Grantee), the right, privilege or franchise until July 1, 1994, to construct, maintain and operate in the present and future streets, alleys and public places in the Village of McCall, Valley County, Idaho, and its successors, electric light and power lines, together with all the necessary or de- sirable appurtenances (including underground conduits, poles, towers, wires, trans- mission lines and telegraph lines and telephone lines for its own use), for the purpose of supplying electricity to said Village, the inhabitants thereof and persons and corporations beyond the limits thereof, for light, heat, power and other pur- poses. Section 2. Poles and towers shall be constructed in a good and substan- tial manner, and shall be so erected as to interfere as little as possible with traffic over streets and alleys. The location of poles, towers and conduits shall be fixed under the supervision of the Board of Trustees of the Village, but not so as to interfere unreasonably with the proper operation of the Grantee's lines. Section 3. The Grantee shall indemnify and save the Village harmless from any and all expense or liability which may accrue to it by reason of the negligence or misconduct of the Grantee in the construction, operation or maintenance of its system hereunder. Section 4. The Grantee shall file with the Clerk of the Board of Trustees of the Village an acceptance in writing of this franchise, on or before thirty days after the final passage hereof. Section 5. This ordinance shall take effect upon approval by the Chair- man of the Board of Trustees, acceptance as required herein and publication within one month after its passage.
