CALL TO ORDER - At 7:00 p.m. the special meeting was called to order by Mayor McGowan. 2. ROLL CALL - Councilmembers Breazeal, Budds, Manning, Wilson and Mayor McGowan and Planning Commissioners Griffiths, Muto and Seibert. Mayor McGowan excused Planning Commissioner Souder. Also present were City Manager Ovrom and Community Development Director Dawson. 3. CONSENT CALENDAR - A. APPROVAL OF MINUTES - Joint City Council /Planning Commission Meeting of May 12, 1992 Councilmember Breazeal moved to approve the Consent Calendar, seconded by Commissioner Griffiths. 5. INTRODUCTION - City Manager Ovrom stated that the purpose of the meeting tonight was to go over the process of preparing the Housing Element and reviewing the draft document prepared by Cotton Beland. She stated that the process would include a number of workshop meetings hosted by the Commission and public hearings. Commissioner Souder arrived at 7:20 p.m. 6. OVERVIEW OF HOUSING ELEMENT UPDATE - Paula Kelly of Cotton Beland Associates stated that there were some inconsistencies in the draft in terms of the number and the tables. She said that since the 1990 census data was not yet available, she used estimates provided by the State Department of Finance, the 1980 census and SCAG numbers. She said that there had not been a lot of change in the city and that it continues to remain a city of family households. She said that the number of units required by the Housing Needs Assessment needed was 403 and that two - thirds of that is for upper income housing. Joint Special Meeting Page 2 May 12, 1992 Commissioner Seibert asked why the city needs to prepare an updated housing element. Dale Beland said that the State's goal is to provide adequate housing. He stated that at this time it might not be feasible, but the city is required by law to provide the document. 7. OVERVIEW OF STATE MANDATES He said that there was a very strong movement in the legislature to change the law. He said that currently SB1711 was being reviewed and that a number of changes are being proposed to the bill. He also pointed out that the 20% Set - Aside monies was not happening. He said that Cotton Beland has made suggestions in the draft housing element, but that the city will give the input. He concluded by stating that in its current format would not be accepted by Housing and Community Development, but it shows the City's good faith. He said that the City had some options: 1) not to do anything and possibly be the target of certain groups or 2) continue on the current course of preparing the housing element update. He recommended the second option. Councilmember Breazeal said that he was very concerned with the numbers and also agreed with Commissioner Seibert. He also said that SCAG did not take into consideration the current economic problems. He also said that the draft element mentions re- financing the CRA debt and the Council already voted not to do that. He wanted that reference removed from the element. Mayor McGowan stated that Councilmembers Manning and Budds were not present at that meeting and that they should have an opportunity to speak to that. Councilmember Manning pointed out that there would be a great impact upon the schools. City Manager Ovrom asked Mr. Beland if submittal of the document meant that the City had to start building. Mr. Beland said that the requirement is that you prepare a document that addresses housing needs and the actual building was done by private or non - profit organizations. 8. DISCUSSION OF ZONING AND LAND USE CHANGES TO IMPLEMENT PROVISIONS OF THE HOUSING ELEMENT - Commissioner Seibert said that he felt allowing granny flats • • " " Joint Special Meeting Page 3 May 12, 1992 in the R -1 zone would contaminate that zoning. Councilmember Breazeal said that there are certain conditions that would need to be met and if those conditions can be met the request for a granny flat should be granted. Councilmember Budds, referring to page II -6, asked how the increase in the amount of renters affected the entire process. Ms. Kelly stated that the State required that certain information be included in the report and it was for information purposes only to establish what was currently existing. Councilmember Wilson stated that on one page a number was given for the number of households and on another page it was a different number. Ms. Kelly stated that the reason for the different numbers was because different sources were used. Mr. Beland added that when the element was started one source was available and as the time went by additional sources became available which had different numbers. Councilmember Budds said that the Planning Commission requested possible reductions in the R -2 Zone, change the zoning from R -3 to R -2 in the area surrounding Ralphs and that Camellia Avenue be reduced from R -2 to R -1 zoning. The other Commissioners and Councilmembers agreed that it should be reviewed. Councilmember Breazeal said that the amount of vacant land was not a true number because some have tentative map approval and he asked for some actual numbers of vacant land. Commissioner Griffiths, referring to page VI -1, Policy 1.2, asked that it be removed or end the sentence at "... of high quality housing." There was a consensus. Councilmember Breazeal, referring to page VI -1, Policy 1.3, asked that it read as follows: "Promote ... income housing for senior citizen ...." He also asked that Policy 1.4 be eliminated. There was a consensus. Councilmember Breazeal said that he did not want to see high density near the parks and asked that Policy 1.5 be changed to eliminate "and recreation" and add an "and" between "public transportation and services ". There was a consensus. Joint Special Meeting Page 4 • May 12, 1992 Councilmember Breazeal, referring to page VI -8, No. 1, asked that in the second line the word "will" be changed to "may ". There was some discussion as to what was required for emergency shelters and if it needed to be included in the element at all. Commissioner Griffiths asked for clarification of the city's role in preparing this document for the State. Mr. Beland stated that the State requires that this document should address the regional housing needs assessment and should be prepared and submitted to HCD for the review and approval. He said that the document in its present state will not be approved by HCD. He said once submitted, HCD will review it and then send a letter to the City listing the deficiencies. He said that not submitting a Housing Element document would only open the City up to certain groups that might want to take legal action against the City. He did not recommend totally removing emergency shelters from the element. Mayor Pro -Tem Manning asked if the schools and public facilities could be considered emergency shelters. Director Dawson said that they were referring to shelters for the homeless. It was decided that emergency shelters would be allowed in the M -2 Zone only with a conditional use permit. Page VI -9 should reflect that change. Councilmember Budds, referring to page VI -2, Policy 1.8, asked that the word "Encourage" be changed to "Require ". Councilmember Breazeal suggested the wording "Continue to require..." There was a consensus on the later wording. Councilmember Breazeal, referring to Policy 2.1, said that he did not think the city would have a residential rehabilitation program. City Manager Ovrom said that possibly at some future time this type of program might be possible in order to upgrade the housing stock. Councilmember Budds asked if the city charges property owners a fee for rentals, which results in some type of permit being issued. City Manager Ovrom said that was a business license. 2, 41, Joint Special Meeting Page 5 May 12, 1992 Councilmember Budds stated that the business license had certain conditions which are enforceable when the rental permit is obtained. He asked if that could not be a way of enforcing maintenance of the property through the business license and could that not be used as a rehabilitation program. Director Dawson said that fee was used as revenue to the City and would not effectively promote a rehabilitation program. Councilmember Budds said that it should be used as a way to control compliance with our maintenance requirements. Director Dawson said that it was used for the business license programs and no inspections are done in conjunction with the application process. He said that staff did take a look at a resale inspection program which would require an inspection upon sale of the property. Councilmember Breazeal said that state law requires that realtors verify that proper permits are on file. • Policies 2.2 and 2.3 were okay. Councilmember Budds asked what Policy 3.1 meant. Ms. Kelly stated that it addresses housing discrimination. Mr. Beland said that the wording could be changed to make it clearer. Commissioner Griffiths asked if the implementation status needed to be included. Ms. Kelly said that it was required by HCD. Councilmember Breazeal, referring to page VI -8, No. 1, asked that on the second line, the word "will" be changed to "may ". There was some discussion of the housing rehabilitation program and the consensus was to keep it in the element even though the money was not available at this time. Ms. Kelly suggested changing the wording on page VI -10, No. 6, the last sentence, placing a period after "monies ". There was also a consensus that on Page VI -10, No. 7 should be removed. Nos. 8 -11 were acceptable. In No. 12, in the first sentence the word "will" should be changed to "may ". Director Dawson outlined the possible code amendments relative to parking requirements which would change the standards to Joint Special Meeting May 12, 1992 Page 6 • encourage a variety of 1 and 2 bedrooms. Some felt that the number of bedrooms was regulated by the market not the standards. Some disagreed and felt that some people would prefer 1 and 2 bedroom units. It was decided that it would be taken to the Planning Commission for review. Director Dawson then addressed rezonings within the city; along Oak, Cloverly and Primrose (near Ralphs) from R -3 to R -2 and Camellia Avenue above Woodruff from R -2 to R -1. Mayor Pro -Tem Manning suggested that the residents be surveyed to see who actually wants to be down zoned. 9. DISCUSSION OF FUNDING FOR HOUSING PROGRAMS - 10. ADJOURNMENT June 17th - 7:00 p.m. June 23th - 7:30 p.m. June 30th - 7:00 p.m. Mayor McGowan adjourned the meeting at 9 p.m. The next regular meeting of the City Council will be on Tuesday, May 19, 1992 at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue.
