The original public records request can be found at the following link: http://www2.gulf-stream.org/weblink/0/doc/119051/Page1.aspx With respect to part 1 of your request, which seeks “All records related to James Lundy,” the Town notes this is similar to a request made by you on July 10, 2017. In that request, you sought “all files pertaining to Jim Lundy, an officer of the Gulf Stream Police department”. On July 12, 2017, the Town wrote to you, informing you that: ….your request for “all files pertaining to” a particular police officer is also not sufficient for the Town to fully identify all records you seek. However, in an effort to respond in good faith, the Town interprets this request to be seeking the personnel file of the named police officer. Based on our previous correspondence and the similarity of your new request, we interpret this request to be seeking the same records. Therefore, the Town estimates that to respond to your request will require approximately two hours of administrative support at $41.48 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (Two hours @ $41.48 = $82.96) – (.25 @ $41.48 = $10.37) = Deposit Due: $72.59 in cash or check. With respect to part 2 of your request, “All criminal complaints between 1980 and 1990 filed against Martin O’Boyle,” the Town follows the General Records Schedule GSI-SL for State and Local Government Agencies and other General Records Schedules that may apply to specific records maintained by the Town, e.g. records pertaining to Law Enforcement. The Town systematically disposes of public records that have met their retention requirements and are no longer needed. Therefore, if there were any records responsive to your request, dated between 28 and 38 years old, they may have been disposed of pursuant to the Town’s Public Records Compliance Program and these records schedules. With respect to part 3 of your request, this letter requests clarification as to the time period of your request, specifically, whether it seeks records from 1980 through 1990; and the Town also seeks clarification as to whether you are seeking records between the Mayor and Police Chief or all records regarding Martin O’Boyle sent or received by the Mayor, as well as separately, and additionally, all records regarding Martin O’Boyle sent or received by the Police Chief, before determining whether to provide you with an estimate for the extensive use of information technology resources or extensive clerical or supervisory assistance as described in Fla. Stat. § 119.07(4)(d). Upon receipt of your deposit and/or clarification, the Town will use its very best efforts to further respond to your public records request in a reasonable amount of time. As for Part 1 of my request it seems to me that your interpretation is reasonable. Essentially, I want any records associated with Mr. Lundy including any hand written notes or instructions that may be in his file or in other Town files. Your response to Part 2 is also reasonable though it says that the records "may have been disposed of". Will those records be researched as you left open the possibility they exist? As it relates to Part 3, yes, your time period assumption is correct. I am seeking the records between the Mayor and Police Chief or between anyone else and those parties as it relates to Martin O'Boyle so your latter description seems accurate to me. Is the address in your signature block the appropriate one to send the deposit? Does the Town have a Paypal account that I could simply transfer the money into? A very small percentage of the Town’s records are required to be maintained for more than 30 to 40 years. Lundy On 1/24/86, during the evening shift (3-11), I observed Officer Lundy parked at the entrance to Ave Au Soleil on five different occasions while on patrol of that area. At one period during this shift, I was looking for over i hour for Officer Lundy and finally found him parked in a vacant lot, with his lights out, at 2929 No. Ocean Blvd. Also, earlier during this same shift, I observed Officer Lundy in the 7-11 Store on N.E. 8 St. reading a book. After observing him there for 24 min. I called him into the office. At this time I spoke to Officer Lundy and asked him if he was having financial problems or problems at home. He stated he was not. I then advised him that he was not performing his duties as an officer of Gulf Stream. He stated he was just "burnt out" with police work and that there was nothing to do. As Officer Lundy's immediate supervisor, I feel that he is only "putting in his hours" and failing to perform the duties required of him. I also received a complaint from Officer Burtka this same evening, about Officer Lundy's behavior while acting as a back-up officer. Officer Lundy's behavior during this call embarrassed not only Officer Burtka, but the Department as well. Due to the events of this date and Officer Lundy's general attitude I am requesting a 5 day suspension without pay, and an unlimited probationary period. • - • HaHon To: Chief James W. Lundy On 6/20/84 I received information that a uniformed Gulf Stream Police Officer was observed at a convenience store on N.W. 2 Av. in Boynton Beach at approximately 9:30 P.M. on 6/19/84. I checked communications in Boca Raton and ran the tapes which revealed that Ptlm. Lundy had received a phone call from a female at approx- imately 2115 hrs. requesting he call her back at a phone number and when checked was found to be a pay phone at 744 N.W. 2 Av. Voice traffic shortly afterwards on the tape revealed Lundy advising he was enroute to that location. The voice tape further revealed telephone conversation between Lundy and communications dispatcher at approximately 2145 hrs. advising he had the vehicle started and was not going to need a wrecker, indicating he was, in fact, at the location on N.W. 2 Av. Lundy was questioned on 6/20/84 in reference to his leaving the City in his own vehicle without notifying his co-workers or requesting permission to do so from a supervisor. He admitted to leaving the Town in his own vehicle to assist his girlfriend as her car broke down. Ptlm. Lundy stated he knew he should have notified someone or requested permission from a supervisor, but did not as he thought it was more imperative to respond to assist her as he thought she was broken down in the roadway. I can understand Ptlm. Lundy's wanting to assist his girlfriend as quickly as possible in her distress, however, I also feel that ration- alization should have prevailed on his part, and considering the alternatives avail- able, feel that Ptlm. Lundy did use poor judgement by leaving his assigned duty station without proper authority and especially so by not at least advising his co- workers so someone would at least know where he was. It has been brought to my attention by C.D.C. personnel that you have been receiving an extraordinary number of personal phone messages through the dispatch center. I called C.D.C. Supervisor Robinson to discuss the situa- tion. She pulled some records that indicated that an abnormally high amount of phone messages have been received by you in recent weeks. This is contrary to C.D.C. policy. We both agreed that intervention at this time may prevent a written complaint from C.D.C. It has been my experience that in the past, the police officers working under C.D.0 have enjoyed a leniency, by C.D.C. concerning phone messages, I.E. C.D.C. does not usually question the officiality of an occasional caller, but in this particular situation, I was in agreement, that the repetitiveness of an unnamed person calling you through C.D.C., warrants further attention to the matter. Realizing that C.D.C. can stop conveying non -emergency messages at their descretion, I am directing you to immediately remedy the situation for the following reasons: To prevent an official, written complaint from C.D.C. to the Chief. This could adversely affect others who enjoy the current dispatch system. To prevent stricter guidelines by G.S.P.D. concerning the current dispatch system. This could also affect others around you. This letter is a record, and if needed, it will stand as a written warning for disciplinary action in the future. This letter could also provide tangible evidence, to give to your caller/s that a noticeable problem does exist. Recently though, the situation has become a disruption for the GSPD. Therefore, as your supervisor, I am forced to involve myself and deal with this problem. No matter the reasons for the conflict/s, a behavior change on your part will have to occur. Starting immediately, you will no longer direct any rude, insulting or derogatory gestures toward, around, or in the presence of Ms. He1mes. Lundy On 6/20/84 I received information that a uniformed Gulf Stream Police Officer was observed at a convenience store on N.W. 2 Av. in Boynton Beach at approximately 9:30 P.M. on 6/19/84. 1 checked communications in Boca Raton and ran the tapes which revealed that Ptlm. Lundy had received a phone call from a female at approx- imately 2115 hrs. requesting he call her back at a phone number and when checked was found to be a pay phone at 744 N.W. 2 Av. Voice traffic shortly afterwards on the tape revealed Lundy advising he was enroute to that location. The voice tape further revealed telephone conversation between Lundy and communications dispatcher at approximately 2145 hrs. advising he had the vehicle started and was not going to need a wrecker, indicating he was, in fact, at the location on N.W. 2 Av. Lundy was questioned on 6/20/84 in reference to his leaving the City in his own vehicle without notifying his co-workers or requesting permission to do so from a supervisor. He admitted to leaving the Town in his own vehicle to assist his girlfriend as her car broke down. Ptlm. Lundy stated he knew he should have notified someone or requested permission from a supervisor, but did not as he thought it was more imperative to respond to assist her as he thought she was broken down in the roadway. I can understand Ptlm. Lundy's wanting to assist his girlfriend as quickly as possible in her distress, however, I also feel that ration- alization should have prevailed on his part, and considering the alternatives avail- able, feel that Ptlm. Lundy did use poor judgement by leaving his assigned duty station without proper authority and especially so by not at least advising his co- workers so someone would at least know where he was. I should therefore recommend a one (1) day suspension without pay and any future violations of this nature be grounds for dismissal. LT - a Lt. Earl C.
