TO PASS THROUGH TO RICHMOND NEIGHBORHOOD RESTORATION, INC., A NON-PROFIT DOMESTIC CORPORATION AND AMENDING PRIOR DONATION ORDINANCE 14-2015 WHEREAS, On March 16, 2015, the Common Council of the City of Richmond, Indiana, passed a donation ordinance designated as Ordinance 14-2015 in connection with the receipt of a donation of money and real property (located at 36 South 191h Street in Richmond) to be used as a pass through from Wells Fargo Bank, N.A. to Richmond Neighborhood Restoration, Inc.; and WHEREAS, Upon the closing of said property, the funds received exceeded the $3,000.00 amount listed in the donation Ordinance and was issued in the amount of Three Thousand Eight Hundred Forty-nine Dollars and Ninety-nine Cents ($3,849.99); and WHEREAS, The City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and WHEREAS, The acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose; and WHEREAS, It is in the best interest of the City of Richmond, Indiana, to amend the prior donation ordinance passed by the Common Council on March 16, 2015, to reflect the increased amount. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the prior donation ordinance passed on March 16, 2015, and designated as Ordinance No. 14-2015 shall be amended to the increased amount of Three Thousand Eight Hundred Forty-nine Dollars and Ninety-nine Cents ($3,849.99) of the cash contribution that is donated and appropriated to be passed through to Richmond Neighborhood Restoration Inc. for the closing of the real property. TO PASS THROUGH TO RICHMOND NEIGHBORHOOD RESTORATION, INC., A NON-PROFIT DOMESTIC CORPORATION WHEREAS, The City of Richmond, Indiana, has been approached by Richmond Neighborhood Restoration Inc., a non-profit domestic corporation registered with the Indiana Secretary of State, in connection with the possible donation of certain property located at 36 South 19d' Street, Richmond, Indiana as well as the sum of Three Thousand Dollars and Zero Cents ($3,000.00) as a cash contribution at closing of said real property; and WHEREAS, The real property is currently owned by Wells Fargo Bank, N.A., and may be transferred by the Richmond Board of Public Works and Safety in accordance with Indiana Code (IC) 36-1-11-1(bx21); and WHEREAS, The cash contribution that would be passed through to Richmond Neighborhood Restoration Inc. would be deemed a donation initially accepted by the City of Richmond, Indiana from Wells Fargo Bank, N.A.; and WHEREAS, The City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and WHEREAS, The acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the proposed cash contribution in the amount of S3,000.00 to be received by the City at the closing to transfer real property located at 36 South 19`h Street in Richmond, Indiana, from Wells Fargo Bank, N.A. 1 be accepted and gratefully acknowledged by the citizens of Richmond, and both the real erty and cash contribution shall be passed through to Richmond Neighborhood Restoration Inc. n tjosing of said real property. The Department of Metropolitan Development is requesting approval of Ordinance # 8 - 2016, amending prior donation Ordinance #14-2015. On March 16, 2015, Ordinance #14-2015 was passed in connection with the receipt of a donation of money and real property (36 South 19`h St.) to be used as a pass through from Wells Fargo Bank, N.A. to Richmond Neighborhood Restoration. Upon closing, the funds received totaled $3,849.99, which exceeded the $3,000 amount listed in the original donation ordinance. I am requesting that the prior ordinance (#14-2015) be amended to reflect the actual amount being passed through ($3,849.99). Attached please find a copy of the original Ordinance #14-2015.
