TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: NONE 5. CONSENT CALENDAR: A. APPROVAL OF MINUTES - Meeting of May 10, 1994 Commissioner Seibert moved to approve the Minutes as written, seconded by Commissioner Keelin and carried. 6. UNFINISHED BUSINESS: NONE 7. NEW BUSINESS: A. PUBLIC HEARING: CODE AMENDMENT RELATIVE TO FAMILY DAYCARE HOMES AND CHILDCARE CENTERS Site: CITYWIDE Owner: CITY OF TEMPLE CITY Request: A Zoning Code Amendment which would define small and large family daycare homes as well as childcare centers. Additionally, the Zoning Code Amendment would incorporate special development standards and a modified conditional use permit process for large family daycare homes in accordance with State requirements. Planning Commission Minutes Page 2 Date of Hearing: May 24, 1994 Community Development Director Dawson stated that a notice was duly published in the Pasadena Star News and provided the background information contained in the staff report dated May 24, 1994. Director Dawson stated this code amendment is an outgrowth of a family daycare application for a conditional use permit which the Planning Commission denied following a public hearing on April 26, 1994. Subsequently, staff learned that the State preempts the City's Zoning Code regarding daycare homes of up to twelve children. The new State provisions to the Health and Safety Code relating to a license for family daycare businesses of 7 -12 children prohibits a city' from requiring a regular C.U.P. The City's Code currently states that a daycare home greater than three children requires a C.U.P. The proposed code amendment will bring the City's Code into conformity with State law by clarifying the definition of a small family daycare home, large family daycare home and daycare center. Director Dawson stated the draft resolution contains eight standards for granting a permit for a large family daycare home as an accessory residential use. Commissioner Seibert corrected resolution standard #7 to state that "A license shall be obtained for such use from the State of California ". Director Dawson stated the correction will be made. Commissioner Keelin asked if fees were received from the C.U.P. applicant for a family daycare. Director Dawson answered yes, however, all fees will be refunded to the applicant. Commissioner Seibert asked if the Planning Commission could require the applicant to reapply, per adoption of the Zoning Code Amendment. Director Dawson answered that it may become necessary if the situation became a code enforcement problem in the future. There being no further questions from the Commission, Vice - Chairman Griffiths opened the public hearing. • • • Planning Commission Minutes Page 3 Date of Hearing: May 24, 1994 There being no one to speak, Commissioner Keelin moved to close the public hearing, seconded by Commissioner Seibert and unanimously carried. Commissioner Seibert could approve the staff recommendations for the Code Amendment. Commissioner Keelin felt that additional off - street parking for family daycare homes was not necessary and he could approve the Code Amendment. Commissioner Muto stated the Code Amendment would bring the City's regulations into line with the State standards and he could approve the Amendment. Vice - Chairman Griffiths asked regarding the front yard play area. Director Dawson answered that a family daycare could not have a play area in the front yard area. A daycare facility with more than twelve children would require a C.U.P. and conditions would then be imposed. Commissioner Seibert moved to adopt a resolution as corrected, recommending an amendment to the Zoning Code relative to family daycare homes as well as childcare centers, seconded by Commissioner Keelin and unanimously carried. 8. COMMUNICATIONS: NONE 9. MATTERS FROM CITY OFFICIALS A. Director Dawson stated that the City Council held a budget study session on May 23rd, and another will be held on May 31st, 6:00 p.m. in the Community Room. B. Director Dawson stated the cut -off date for Planning Commissioner applications was May 20th and it is anticipated that the City Council will make an appointment in the near future so that we have a full Planning Commission. C. Director Dawson indicated that it may be necessary to cancel the Planning Commission meeting of June 28th. 10.
