Dear Mr. Murray,
This letter is in response to your recent request for an. extension of Shore Protection Act

Per O.C.G.A 12- 5- 229(e), staff hereby authorizes the one -time extension of Shore Protection
Act Permit W339 for an additional Eve (5) years. All conditions rernain. applicable as
permitted. and agreed to in the original permit. The extended expiration date for the permit
will be June 4, 2014. Any changes or revisions to the project may require a new Store
Protection Act Pt:rmit.

Dear Mr. Murray:
The Shore Protection Committee considered and approved permit #339 referenced above on June
4, 2004 under the Shore Protection Act O.C.G.A. § 12 -5 -230 et. seq. The permit placard and
permit conditions are attached to this letter. All decision documents (attached), as well as all
other plans, documents and materials submitted during the application process become terms of
this permit and are now enforceable conditions.
The permit entails the restoration of native vegetation to the landward face of the tertiary sand
dune within the State's Shore jurisdiction. A temporary irrigation system will be installed to
ensure the success of the native vegetation which will include: Uniolia paniculata, Spartina
patens, Mulhenburgia filipes, Yucca gloriosa, Opuntia humifusa, Lonicera sempervirens,
Lantana camara and Myrica cerifera. In addition, a cluster of Sabel palmettos will be
transplanted from the western portion of the property to an area landward of the toe of the dune.
Minimal grading will be performed landward of the toe of the dune to divert water away from an
existing 1950's single - family residence. St. Augustine sod will be installed in the newly graded
area landward of the toe of the dune. The permit also includes the construction and maintenance
of a masonry and wooden picket fence along the southern property line to mirror the length of
the existing privacy fence on the northern property boundary. After restoration of the native dune
vegetation, more than 40% of Lot #1 will be maintained in a naturalized vegetated state.
Standard and special conditions apply to this permit.
Enclosed is the permit placard to be posted at the work site (within 24 hours) for the duration of
the construction activity. Please note that you will also need to notify the Department when
you are within 10 -30 days of beginning your project to obtain a separate construction
placard. DNR staff will arrange a site visit to confirm the project footprint before construction
begins and to initial the construction placard at the identified intervals during the project. This
placard will also need to be posted on the site during construction.
Also enclosed is a Certification of Compliance that must be submitted to us within 30 days
following completion of the permitted activity. Please include this compliance form with
the post- construction survey, as required under the special conditions.

This letter and attachments are to be held by you for your files and for inspection by any
authorized persons. The expiration date for the permit is five (5) years from the date of
issuance (i.e. June 4, 2009). However, no construction may commence within the area of
jurisdiction of the Act until the expiration of thirty (30) days following the date of issuance. You
may start construction as soon as July 5, 2004, provided there is no legal appeal of this permit.
If you as the permit holder sell, lease, rent, or otherwise convey the land or any portion of
the land for which the permit was issued, you must notify the Department within 30 days of
this transfer or conveyance. The permit shall continue in force in favor of the new owner,
lessee, tenant, or other assignee so long as there is no change in the use of the land as set forth in
the original application. The Department will transfer the permit to the new owner with all of the
original terms and conditions.
We ask that you carefully read through this document and attachments and comply with the
terms and conditions of this permit. Feel free to contact me if you need clarification of any of

conditions apply to this permit.
FINDINGS OF THE SHORE PROTECTION COMMITTEE:
1. The applicant proposes to restore native vegetation to the landward face of the tertiary sand
dune within the State's Shore Jurisdiction thereby increasing native habitat within the State's
Shore Jurisdiction and stabilizing the landward face of the dune.
2. The applicant proposes to install an irrigation system to ensure the success of the restored
native landscaping within the State's Shore Jurisdiction.
3. The applicant proposes minimal grading to an area that is landward of the toe of the dune in
order to divert water away from the existing 1950's single - family residence.
4. The applicant proposes to install St. Augustine sod and Sabel palmettos within the graded
area landward of the toe of the dune.
5. The applicant proposes to construct and maintain a 4' masonry and wooden picket fence
along the southern property line partially within the State's Shore Jurisdiction. An existing
wooden privacy fence partially within the State's Shore Jurisdiction on the northern property
boundary will be maintained.
6. There is a non - structure alternative approach to stabilize the encroaching dune, involving the
restoration of shrub scrub habitat that should be implemented prior to hard structure being
installed along the existing landward toe of the dune as depicted on the permit drawings.
7. After restoration, approximately 40% of the Lot #1 will be maintained in a naturally
vegetated condition, exceeding the minimum requirement under the Shore Protection Act to

maintain at least 33% of the parcel in its native vegetated and topographical state.
8. The proposed 4' fence along the southern property line is located 9.5' from the northern curb
of Sixth Street right of way. The proposed fence will not inhibit vehicular traffic on the Sixth
Street right of way.
9. There will be no net increase in impervious surface on Lot #1 as a result of the proposed
project.
10. The proposed project also includes a three -foot high retaining wall to be located along the
landward toe of the dune.
11. The project will not result in unreasonably harmful, increased alteration of the dynamic dune
field or submerged lands, or function of the sand - sharing system. The project will not
interfere with the conservation of marine life, wildlife, or other resources. The project will
not unreasonably interfere with access by and recreational use & enjoyment of public
properties.

STANDARD PERMIT CONDITIONS
1. The project must comply, as applicable, for areas permitted herein, with all other Federal,
State, and local statutes, ordinances, and regulations, and the applicant must obtain all
licenses and permits prior to commencement of construction.
2. This permit does not resolve actual or potential disputes regarding ownership of or rights in
or over the property upon which the subject project is proposed, and shall not be construed as
recognizing or denying any such rights or interests.
3. All plans, documents, and materials contained in this permit application, required by the
Shore Protection Act O.C.G.A. 12 -5 -230 et. seq. are a part of this permit and conformance to
such plans, documents, and materials are a condition of this permit. No change or deviation
from these plans, documents, and materials shall be permitted without prior notification and
approval by the Department or Committee.
4. No further encroachment or construction shall take place within State jurisdiction, except as
permitted by the Shore Protection Committee. Any modification of the plans or structure in
the jurisdictional area must be reviewed and approved by the Department prior to
construction.
5. A construction placard will be required to be obtained from the Department up to 30 days
prior to the start of project construction and must be posted at the site. This placard will
include certain steps in the construction of the permitted project that must be approved by the
Department prior to construction.
6. The exact location and configuration of this project must be reviewed onsite and approved by
Department staff immediately prior to beginning construction. Minor changes to the location
may be allowed or required in areas that have eroded or accreted subsequent to the original
jurisdictional determination.
7. No construction materials or debris may be placed, disposed of, or stored in a jurisdictional
area of the Shore Protection Act.
8. Any incidental impacts associated with the construction of this project must be rectified by
restoring areas to their pre - construction topographic and vegetative states.
9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of
the ordinary high water mark.

10. If the shoreline erodes, it is the responsibility of the permittee /owner to move the permitted
structure, improvement or asset inland to the dry sand beach.
11. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not
meeting their expected usefulness, or are not maintained at a serviceable level, then it is the
responsibility of the owner to remove the improvements. A new permit will be required to
retain and repair the structure, improvement or asset if it loses its structural integrity and is
no longer serviceable.
12. The Shore Protection Committee is not bound in the future to protect any asset or
improvements authorized by the permit.
13. The permit must be posted onsite within twenty -four (24) hours of beginning construction.
14. A copy of the above conditions must be supplied to the person in charge of construction.
SPECIAL CONDITIONS:
1. Irrigation must be provided for minimum of two years to ensure the survival of all of the
plantings. During the first two growing seasons following the planting, any plants must be
replaced which do not survive.
2. Permittee must provide the Department with a survey depicting the toe of the dune and the
State's Jurisdiction area within six months of the permit issue date to establish a baseline
against which to monitor the landward movement of the dynamic dune field.
3. This permit does not authorize the construction of the proposed retaining wall.
4. Permittee shall provide a post - construction survey that locates all improvements including
landscaped native trees, as depicted in the application materials. Such survey shall comply
with the Georgia Plat Act, O.C.G.A. §15 -6 -67 et. seq. This survey must also reflect the
current jurisdiction line as identified by Department staff. Each tree must be depicted on
this survey as being landscaped and these trees will not alter the State's Shore Jurisdiction in
the future.
5. After one year, during which time the restoration of native vegetation is established, if the
toe of the dune moves landward by more than twelve inches, the Committee authorizes the
installation of a wooden fence not to exceed 3' in height along the landward of toe of the
dune within the State's jurisdiction. This must be accomplished in consultation with the
Department and the fence along the landward toe of the dune. The fence structure will then
be recorded on the most recent survey at the expense of the permittee.
6. There is no fill requested in association with this proposed project, and no fill is authorized
by this permit.

Attached is a revised plan and application which I received today from contractor Stephen Brannen
(655 -4327) for 2 Sixth Street / Anne & Morgan Murray. The project has been scaled back since it was
last discussed in early October.
Downer: Does this plan resolve any issues you may have had during the September 27t" site visit?
Joe: The palms and oleanders in the right -of -way were discussed at the September 27t" site visit. Is
there any language related to those or any other issues that you would like added to the plan before
this permit is issued?
Deb: In the attached email you and I discussed a permit renewal for the Murray project. I do not
have a copy of that for the file. Could I get a copy of the DNR permit renewal and would you review
the attached plan and let me know if you have any concerns?

Ok. This is comparable to that situation. We will offer at tomorrow's meeting that a curb cut will be approved
when a structure is built on the lot. Would a shed meet that requirement or does it have to be a dwelling? Well,
the Accessory Structures ordinance (3 -070) does not speak directly to allowing a shed if there is not a principle
building. And if the Murray's combined the two lots to add a shed they would not be granted a second driveway
because the one they have uses all of the 25 feet that is allowed.

As this is no only an existing single family gardening activity, they are exempt from the formal plan
requirements. However, if you could give him a copy of the handout you normally give contractors and add to
the permit that "Sediment Barrier will be installed between the proposed grading activity and remain until 100%
of the disturbed area had a 75% density grass or other permanent permeable stabilization. ", we'd be more
assured that sediment will not leave the site.

Diane,
Attached is Section 3 -080, Off - street Parking Requirements. Subsection (B)(5) is about off - street parking
requirements "on a lot that has not been otherwise improved" but has a private dock. That situation would
necessitate a driveway to the 2 off - street parking spaces.
The Murray's request is access to a garden, not a dock. This reminds me of the situation a while back over on
Polk Street. The owner of the vacant property had issues with the parking meters that were installed in front of
his property. Was he granted a gap in the metering for access to his land or was he told that the parking meters
would be moved when he built a structure on the lot?

2. Curb cut application - This is 2 lots of record. A new driveway is proposed for Lot 2. See site plan. The
driveway is for access to a garden. This will result in the loss of street parking.
3. Application for fences on west & street sides, landscaping, add another driveway, hardscapes, grading,
gates at driveways -
a. DNR - permit expired 06/04/2009.
b. Fences & gates
c. Hardscapes
d. Grading - and filling? Flood map attached. V -zone. See Section 8 -230 below.
Sec. 8 -230. Coastal high hazard areas (V- zones).
(9) There shall be no fill used as structural support. Non - compacted fill may be used around the perimeter of a
building for landscaping /aesthetic purposes provided the fill will wash out from storm surge, (thereby rendering
the building free of obstruction) prior to generating excessive loading forces, ramping effects, or wave
deflection. The building and zoning department shall approve design plans for landscaping /aesthetic fill only

after the applicant has provided an analysis by an engineer, architect, and /or soil scientist, which demonstrates
that the following factors have been fully considered:
a. Particle composition of fill material does not have a tendency for excessive natural compaction;
b. Volume and distribution of fill will not cause wave defection to adjacent properties; and
c. Slope of fill will not cause wave run -up or ramping.

Dear all,
The attached applications and site plan were received yesterday. I need help.
1. Tree removal application - This is for relocating 3 palms. One of the palms will be moved to the
right -of -way.
2. Curb cut application - This is 2 lots of record. A new driveway is proposed for Lot 2. See site
plan. The driveway is for access to a garden. This will result in the loss of street parking.
3. Application for fences on west & street sides, landscaping, add another driveway,
hardscapes, grading, gates at driveways -
a. DNR - permit expired 06/04/2009.
b. Fences & gates
c. Hardscapes
d. Grading - and filling? Flood map attached. V -zone. See Section 8 -230 below.
Sec. 8 -230. Coastal high hazard areas (V- zones).
(9) There shall be no fill used as structural support. Non - compacted fill may be used around the perimeter of
a building for landscaping /aesthetic purposes provided the fill will wash out from storm surge, (thereby
rendering the building free of obstruction) prior to generating excessive loading forces, ramping effects, or
wave deflection. The building and zoning department shall approve design plans for landscaping /aesthetic fill
only after the applicant has provided an analysis by an engineer, architect, and /or soil scientist, which
demonstrates that the following factors have been fully considered:
a. Particle composition of fill material does not have a tendency for excessive natural compaction;
b. Volume and distribution of fill will not cause wave defection to adjacent properties; and
c. Slope of fill will not cause wave run -up or ramping.
The contractor is Stephen Brannen of Brannen Construction (655- 4327). Please advise.
