BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF McCALL, IDAHO: ? F Q 1ZU1 ivC I-- Section 1. ZONING M. NAMED: ZONING MAP ADOPTED: (A) This ordinance shall be known as the "Zoning Ordinance of the Village of McCall". (B) This ordinance shall consist of the text hereof as well as that certain map identified by the approving signatures of the Board of Trustees, marked and designated as "Map of the Zoning Ordinance", which said map is now on file in the office of the Village Clerk. Said Map has been heretofore examined in detail by the Board of Trustees and is hereby adopted as a part of this Ordinance, but this Ordinance and said Map shall be subject to change from time to time as may be determined by the Board of Trus- tees by amendment of this ordinance. Section 2. DEFINITIONS: Words not defined herein shall be given the meaning ordinarily applied to such words as used in Zoning Ordinances. Accessory Use or Building: A subordinate use or building cus- tomarily incident to and located upon the same lot occupied by the main building or utilized for the main purpose. Alley: A street or way shown on the official plat of the Village or its additions and designated thereon as an alley. Apartment House: A building or portion thereof used or intended to be used as the home of three (3) or more families or households living indeptendently of each other. Duplex: A building arranged or designed to be occupied by two (2) families. Single Family Dwelling: A building arranged or designed to be occupied by not more than one (1) family. Family: Any number of individuals living together as a single housekeeping unit. Established Grade: The sidewalk line grade at the front lot line as established by the Board of Trustees or as given and estab- lished by the building inspector under the direction of the Zoning Board. Height of Building: The height of a building is the vertical distance at the center of a building's principal front measured from the established grade to the highest point of the roof, beams, or in case of a flat roof, to the deckline or mansard, or to the center height between eaves and ridges for gables, hip or gambrel roof line., The height may be measured from the average elevation of the finished sidewalk grade along the front of the building. Lots: Land occupied or to be occupied by a building and its accessory buildings including such open spaces as are required under this ordinance ana having a frontage upon a street or alley, where not appearing on any dedicated plat by a number. But where appearing on a dedicated official plat by a number, a lot shall mean the area and surface as shown on said plat and given a prescribed number, ex- cepting whereby any lot is subdivided and occupied by separate build- ings or units, then the term "lot" shall include each subdivision of the dedicated lot. • Puk}lie Garages: Any premises used for the storage or use of more than three (3) motor vehicles, or where such vehicles are re- paired or kept for-hire, use or sale. Front Yard: Any open unoccupied space on the same lot with a building between the front line of the building (exclusive of steps) and the front property line. Front Property Line: The front property line shall be the front lot line as shown upon the official plat of the property in question. Rear Yard: An open unoccupied space of the same lot with a building between the rear line of the building and the rear line of the lot. Side Yard: An open unoccupied space on the same lot with the building between the side wall line of the buildings and the side lines of the same lot. Story: That portion of a building included between the surface of any floor and the surface of the floor next above it, or it there be no floor above it, then the surface between such floor and the ceiling next above. Section 3. NAMING ZONING DISTRICTS: For the purpose of this Ordinance the Village of McCall shall be and is hereby divided in• to zoning districts as follows: Zone "A" Residence Zone Zone "B" Residence Zone Zone "C" Commercial Zone Zone "D" Industrial Zone Zone "E" Unrestricted Zone Section 4 BOUNDARIES ESTABLISHED ON ZONING MAP: The boundaries of the zones as designated by this Ordinance shall be established by indicating said boundaries upon the "Map of the Zoning Ordinance' as adopted by this Ordinance ZP iiiadeMeleggar Section 5. RESTRICTIONS IN RESIDENCE "A" ZONE: In the Resi- dence AA" Zone no building or premises shall be used or occupied or hereafter erected, or structurally altered except&rig for one (1) or more of the following uses: Residential Dwellings Apartments Churches Schools Colleges Libraries Museums Parks Play Grounds Private Swimming Pools or Public Swimming Pools in Public Parks Fire Station, built in residence style -2- In addition to the foregoing uses set forth in this section only the following structures and uses shall be permitted: (A) Isolated Private Garage: Private garage for use of oc- cupants of a building or buildings on the same premises, may be built upon lots isolated or detached from the dwelling or apartment house when special permission is obtained from the Zoning Commission after filing with the Village Clerk the consent of the two property owners on either side of the lot on which such private garage is to be erected or maintained. Where it is architectually possible itis recommended that all garages be incorporated in and made part of the dwelling house. Where the garage is not a part of the dwelling house no portion of the garage shall be nearer the front property line than the front building line. 4Bj Home Occupation: Families, offices of professional persons, if carried on in a part of the residence building, and which occupy not over fifty per cent (50%) of such residence building.shall be permitted. The name of resident owners or occupant of building sites may be displayed on a name and address plaque if approval thereof is first obtained from the Zoning Commission. (C) Out-Buildings: Shed for tools, fuel and accessories to and used in connection with the residence building or other buildings allowed in said "A" Zone shall be allowed. (D) No animals, livestock or poultry shall be raised, bred, or kept on any lot, except dogs, cats and other household pets, pro- vided the same are not kept, b red, or maintained for commercial pur- pose and are not of such numbers, or kept in such manner that they become a nuisance. No billboards or signboards may be erected, painted or displayed in Zone "A", except as herein provided. (B) Tourist Parke and Motels: Tourist parks, Trailer Courts, motels and cabins or camp grounds shall not be hereafter erected in Zone "A"; however, they may be erected in Zone "B", by special per- mit from the Zoning Commission after a public hearing. (F) Set-back Building Liras and Side Yards: (a) In Zone "A" Residence Zone, every building hereafter erected or structurally altered shall have a set back of at least twenty feet (20' ) from the street property line on which the build- ing front; provided however, that in each block in which fifty per cant (5(%) or more of the buildings on the same side of the street have been built in conformity with a fairly even and determinable front building line of less than twenty feet (2WW ) from the street line, all buildings thereafter erected, established or rebuilt shall be in conformity with said front building line. In determining whether or not a front building line has been determined or established the fair intents and purposes shall be considered and minor irregulari- ties ignored and where any dispute arises in the determining of any such front building line, the determination of the Zoning Commission shall be final. (b) In "A" Residence Zone, single story buildings shall be erected a distance of not lees than four feet (41) from the side of property line, which said distance shall not be less than six feet (6' ) fro a two story (2) building. None shall be nearer the side street than fifteen feet (15' ). Out buildings not used as dwellings may be constructed to the property line of any lot not nearer the front property line than the rear line of the main building -3- • and four feet (4' ) back of the property line of any street running right angles to the alley. For the purpose of this ordinance, fen- ces, walls, or other obstructions over four feet (41 ) in height shall be regarded as structures, this shall apply to the property frontage. Section b. RESTRICTIONS IN RESIDENCE "B" ZONE: All restrictions in Residence "'A"' Zone shall apply to Residence "B" Zone. In the Residence "B" Zone all buildings or premises may be used ''or occu- pied or hereafter erected, or structurally altered for any use per- mitted in the "A" Residence Zone and for any of the following addi- tional uses: Lodging Houses Boarding Houses Hotels Armories Court House Truck Gardening Nurseries Greenhouse Hospitals Sanitariums In addition to the uses provided in this section, the following regulations shall apply: (A) Retail Shops: Retail shops, if built in residence style by a special permit of the Zoning Commission and showing that such adttOtowill not cause damage and will be in accordance with the gen- eral purpose of this Ordinance, and provided further, that before a permit is issued by the Zoning Commission there shall be on file in the office of the Village Clerk the written consent of the owners of seventy-five per cent (75%) of the area of all the property within a radius of three hundred feet (300' ) of any part of the premises whereupon such retail shop is to be erected or occupied. (B) Public Garages: A public garage for storage purposes only where no repair facilities are maintained, when located not less that fifty feet (50' ) from the front lines andnot less than thirty feet (30' ) from any other street line on which the property faces; provided, that before a permit is issued by the Zoning Commission there shall be on file in the office of the Village Clerk the written consent of the owners of seventy-five per cent (75%) of the area of all the property within a radius of three hundred feet (300' ) of any part of the premises whereupon such public garage is to be established or maintained; provided, further, that a public garage shall have no entrances or exitsr.t©`r motor vehicles within three hundred feet (300' ) of an entrance or exit to a school, playground, public library, church, hospital, childrens' home or other similar public or semi-public institution. (LT) Automobile Gas Stations: Filling stations may be erected and operated by special permit of the Zoning Commission after con- sent of property owners has been filed as provided in the case of public garages, and also subject to the same restricitions as pub- lic garages as to location, and if a permit is issued therefor, )7 such building must conform to residence style architecture, and there shall be no advertising signs except of the kind and character permitted in the area by the Zoning Commission. -4- • (D) Storage for trucks, cars, building material, contractors' equipment shall not be permitted within "B" Zone unless stored within a building or is stored or piled for actual construction purposes then going on or about to be initiated. (E) Sign boards may be erected in Zone "B" only by special permit of the Zoning Commission and when there is filed in the office of the Village Clerk blfie consent of the owners of at least seventy- five percent (75%) of the frontage of the property on both aides of the street for a distance of three hundred feet (300' ) each way from the proposed board. (F) Apartment houses, wherever erected or established as such, shall have a side yard of not less than one fourth (1/14) of the height of the building to the eaves or top of coping. Side yards adjoining streets that are running at right angles to the alley shall not be required to be more than four feet (4' ) in width. (G) Privately owned trailer coaches may be parked in Residence Zones "A" or "B" only by special permission of the Zoning Commission and in no case shall be the only structure on any designated lot. Section 7. RESTRICTIONS IN COMMERCIAL "C" ZONE: In the "C" Commercial Zone, all buildings or premises may be used or occupied or hereafter errected or structually altered for any use permitted in the We or "B" Residence Zone and for any of the following addi- tional uses: Business and Professional Offices Retail Commercial Business Wholesale Commercial Business Places of Amusement Printing and Book-Binding Establishments Restaurants Light manufacturing which shall not be dangerous or offensive by reason of dust, gas, smoke or excessive noise, with or without street driveways, may be permitted in "C" Commercial Zone only with the permission of the Zoning Commission and then under such restric- tions and regulations as may be determined by the Zoning Commission. Section 8. RESTRICTIONS IN INDUSTRIAL "D" ZONE: In the "D" Industrial Zone all buildings or premises may be used or occupied for any use permitted in RA", "B", or "C" Zones and for any of the following additional uses: Flammable Liquids in underground storage, for retail use Poultry and Egg Industries Lumber Yards Railroad Yards Coal and Wood Yard Ice Plants Auto Wrecking Establishments confined within buildings Heavy Manufacturing Planing Mills Iron Foundries Gea Plants Heavy Industrial Uses Creameries Flour Mills Public Auction or Salesyard -5- • Section 9i PROVIDING FOR UNRESTRICTED "E" ZONE: In the un- restricted "E ' Zone all buildings and premises may be used or occu- pied for any use in the "A", "B", "C" or "D" Zones and for any use not otherwise prohibited and for the following additional used to-wit: Storage of flammable liquids in overhead tanks and flammable liquids in underground storage in unlimited quantities for use or for unloading or rehandling. Animals and poultry may be maintained and raised in buildings and enclosures when approved by the Zoning Commission. Stock yards, when a permit is issued by the Zoning Commission. Section 10. STANDS FOR SALE OF MERCHANDISE UR PRODUCE PROHIBITED: - Standasfor the sale of merchandise or produce shall not be per- mitted on the sidewalks, streets or parkings. Section 11, SIDE YARD AREAS: Dwellings erected in Zone "A", "B", "tn. or 1iEw, shall have the same side yard areas as those re- quired for dwellings in Zone "A". Section 12. NON-CONFORMING USES: (A) A non-conforming use existing at the time this ordinance takes effect may be continued, except that if it is voluntarily dis- continued for two (2) years or more, it shall then be deemed abandoned and any further use must be in conformity with the uses permitted in such aistrict. (B) Any building arranged, intended or designed for a noncon- forming use, the construction of which has been started at the time of the passage of this ordinance, but not completed, may be completed and put to such non-conforming use, providing it is done within one (1) year after this ordinance takes effect. (C) Any building or structure, existing as a non-conforming use at the time this ordinance takes effect, which is destroyed by fire or the elements, may be reconstructed and restored providing the same is done within two (2) years from the date of said destruction. (D) A building or structure devoted to a non-conforming use at the time this resolution takes effect may not be altered or en- larged so as to extend said non-conforming use more than 10% in area. (E) Whenever a non-conforming use has been changed to a more restricted use or to a conforming use, such use shall not thereafter be changed to a less restricted or non-conforming use. Section 13. PERMIT: A permit shall be Leaned by the Village Clerk for the construction, alteration, repair, removal or occupancy of any part of any building, structure or use, as provided in this Ordinance or as restricted hereby. Section 14. CONDITIuNS UNDER WHICH A PERMIT IS ISSUED: (A) Application for a permit shall be made to the Village Clerk setting forth the type of construction, alterations, changes or occu- pancy. The Village Clerk shall require the applicant to submit a -6- • . . plan showing the proposed construction, alteration or improvement and all other information pertinent to the proposed project. (B) On all matters of concern or interest to citizens generally involving the issuance of a permit for a purpose to which there might be general objection, the Zoning Commission shall order public not- ices to be given for a period of not less than five (5) dgys of a hearing to be had on such application and at such hearing all inter- ested parties shall be heard before a decision shall be made by the Zoning Commission on the question of issuing such permit or imposing such restrictions or conditions as the Commission shall require after such hearing. -6ag • REGULATIONS - CHANGES: section 15. e; :41, , ,..,4 r.,; ,: F.o.iriiil• y ,, ,o; (A) When imailms4111motatithe public convenience and welfare will be substantially served, regulations, restrictions and boundaries may from time to time be amended, supplemented, changed, modified, or meiealed. In cases, however, of a protest against such change signed by the owners of twenty percent (30%) or more either of the area of the lots included in such proposed change, or of those immediately adjacent to the rear thereof extending three hundred feet (3001) from the street frontage of such opposite lots, such amendment shall not become effective except by -the•favorable vote of bt3ree f'd'a thdfof all members of the legislative body of the Village. However, no such regulation, restriction or boundary shall become effective until after a public hearing in relation thereto, at which parties in interest shall have an opportunity to be heard. (B) Any applicant who is dissatisfied with any decision of the Zoning Commission may within ten (10) days after the decision is made, appeal to the Board of Trustees and the decision of the Board on appeal shall decide the question appealed. Section lb. APPLICATION OF ORDINANCE HELD TO MINIMUM REQUIREMENTS: In interpreting and applying the privisions of this Ordinance, the provisions hereof shall be held to be the minimum requirements adopted by the Board of Trustees for the promotion of the health, safety, morals, comfort and convenience of resddents of the Village and to promote the general welfare. Section 17. ZONING COMMIISSION MAY ALTER SET 6ACK LINE: The yard areas required by this Ordinance for a particular building shall not be diminished and shall not be included as a part of the required lot or yard areas of any other building, excepting; the Zoning Com- mission shall have the power to alter the required set back line in restricted districts in the case of public or semi-public buildings, after g public hearing, and after showing that such action will nojs cause damage, and will be in accordance with the general purpose of this Ordinance. The yam! areas of buildings existing at the time of the adoption of this Ordinance shall not be diminished below the requirements herein provided. Section 18. EXISTING AGREEMENTS NOT ALTERED: It is not intended by this Ordinance to alter or change an existing agreement between parties where this Ordinance imposes a greater restriction upon the height of buildings or requires larger lots or yards than acre imposed or required by existing permits, easements, covenants or agreements, but where there is such variation, then this ordinance shall be lib- erally construed to promote the best interest and welfare of the public. Section 19. CERTIFICATE OF COMPLICANCE REQUIRED: No building hereafter erected or altered shall be occupied, used or changed in use or occupancy, until a certificate of occupancy and compliance shall have been issued by the Zoning Commission or its aesignated agent, stating that the buildings or the proposed use of the build- ing or premises complies with the building requirements of the Village and the provisions of this Ordinance. Section 20. CHANGE OF USE REQUIRES CERTIFICATE OF COMPLIANCE: The use of a building already erected at the time of the passage of this Ordinance shall not be changed to some other use or occupied -7- • for any other purpose without the owner or his agent applying for and receiving a certificate of occupancy and compliance from the Zoning Commission. Section 21. INTERPRETATION: Nothing herein shall repeal, ab- rogate, annul, or in any way impair or interfere with any provision of law or any rules or regulations, other than zoning regulations, adopted or issued pursuant to law relating to the construction and use of buildings or premises. Where this ordinance imposes a greater restriction upon the use of buildings or premises or upon the height of buildings or requires larger yards than are imposed or required by other provisions of law, rules, regulations, covenants or agreements, the provisions of this ordinance shall control, but nothing herein shall, interfere with, abrogate or annul any easements, covenants, deed restrictions or agreements between parties which impose restrictions greater than those imposed by this ordinance. Section 22. ZONING OF TRAILERS AND TRAILER COURTS: Every trailer and trailer Court hereafter installed or constructed shall conferm to the following provisions: (A) Definitions: Trailer Court is any lot upon which two (2) or more trailer coaches are located. • Trailer Coach is a vehicle without means of self-propulsion which is constructed to permit occupancy as a dwelling or sleeping place for one (1) or more persons. Dependent Trailer Coach is one which does not have a water closet and a bathtub or shower. Indpend.ent Trailer Coach is one that has a water closet and a bathtub or shower. Trailer Coach Space is a plot of ground within a trailer court designated for the accommodation of one (1) trailer coach. Service Building is a building housing communal toilet, laundry, and other sanitary facilities necessary for the health and conveni- ence of the trailer occupants. (B) Site Selection: Location: A Trailer Court site must not be located close to swamps or other potential breeding places for insects or rodents, subject to flooding, fire, or ether hazards or exposed to chronic nusiances, such as noise, smoke, fumes, and odors. The site shoutck be bounded on a t least one (1) side by a public streatoor highitay. Topographtr: The topography must be favorable to goon sib drain- age, minimum grading, trailer placement, and ease of maintenance. Necessary Land Area: The area of a Trailer Court must be suffi- cient in size to accomodate the number of trailer coach spaces de- sired, roada and parking-areas for motor Vehicles, service areas, buildings and playgrounds ana on-site utilities where public utilities are not available. -8- • (C) Site Improvement: The physical improvements of the site must be arranged to provide a convenient means of pedestrain and vehicular access to each trailer coach space, parking areas, access- ory buildings, an adequate supply of potable water, a safe method of sewage disposal, electrical service for lighting and power and diversion of surface water away from buildings, trailer coach spaces, service and recreation areas and its disposal from the site. (D) Site Planning,: A plan of the proposed Trailer Court must be developed and submitted for approval of the Zoning Commission in- -8a- • • • dicating the layout of trailer coach spaces, roads, walks, service builaings, service areas, utilities, ana necessary grading. Determination must be made in the initial planning stage of the number of dependent and independent trailer coaches to be acco- modated. (E) Trailer Coach Space Sizes: Each trailer coach space must be not less than one thousand two hundred fifty square feet (1250 sq,( ft.)?, in area end shall be at least twenty five feet (25' ) wide. (F) Spacing of Trailers: The minimum spacing between trailer coaches or between trailer coaches and builaings must be: Side-to-Side spacing: Fifteen feet (151 ); End-to-end spacing: ten feet (10' ), such space shall be between ends of trailer bogies, not chassis. No trailer shall be located closer than twenty five feet (25' ) from the right-of-way line of a main highway, or closer than ten feet (10') from the trailer court property line. (G) Roads, Walks, and Parking Areas: General Circulat&on: Safety and conveience must be a major consideration in the layout of roads, walks, and parking areas within the trailer court. All roads must be continuous. Servicing: Suitable Vehicular access for fire fighting equip- ment, delivery of fuel, removal of garbage and refuse, and for other necessary services must be provided. Width of Roads and Parking Areas: Main access roads, two lanes--- twenty feet (20' ) excluding parking. An equal number of motor vehicle parking spaces must be provided to the number of trailer coach spaces. Such parking spaces must be provided in separate parking areas. Walks:• The trailer park walk system must include a walk from the entrance of each trailer to service facilities. Width of Walks Public Walks -minimum- Four Feet (! ') Entrance Walks (from public walk to trailer door) Two Feet (21) (R) Service Buildings; Each trailer court must be provided with one (1) or more service buildings containing the requisite number of plumbing fixtures and other service equipment. The service build- ings must conform in general to the following requirements: Location: Service buildings shall be located not more than two hundred feet (200') from any dependent trailer coach space. Construction: The materials and methods used in the construction of service buildings must conform to the Building Code for buildings of this nature. It must have an interior finish which is moisture resistant and can be readily cleaned. All rooms of service buildings must be ventilated ana all exterior openings provided with screens. -9- 4 . • Facilities: Separate men's and women's toilet rooms must be priviaed and distinctly marked. These rooms must be separated by a sound resistant wall. A vestibule or screen wall must be provi- ded to prevent direct view into the toilet rooms when exterior doors are open. Plumbing Fixtures: Every Trailer Court must provide adequate toilet and laundry facilities. In no instance should there be less than one (1) laundry unit (laundry tray or washing machine); one (1) water closet, one (1) lavatory and one (1) shower for women and one (1) water closet, one (1) lavatory and one (1) shower for men. A • slop water closet (water closet with seat removed) must be provided in each service building. The slop water closet shall be in a sep- arate room of the service building with a single direct opening to the outside. The facilities listed above will accommodate any number of in• dependent trailer coaches, and up to ten (10) dependent trailer coaches. One (1) water closet must be provided for each sex for every ten (10) additional dependent trailer coaches. (Urinals for men may be substituted for one third (1/3) of these water closets)A • One (1) lavatory must be provided for each sex for every ten (10) additional dependent coaches and one (1) shower or bathtub for each each sex for every twenty (20) additional dependent coaches. A laundry unit must be provided for every twenty (20) additional trailer coach spaces. All water closets end bathtubs or showers for women, and all water closets and bathtubs or showers for men must be located in separate compartments, with self closing doors. Gang type shower compartments may be used for men. Individual shower stalls must be approximately three by three feet (3/ x 3'). Showers for women must have a dressing compartment with stool or bench. The room containing the laundry units must be separated from the toilet rooms, and have an exterior entrance only. All plumbing installations shall conform to the State Plumbing Code. Electrical: All electrical installations shall conform to the State Electrical Code. Heating: Heating Facilities capable of maintaining a temperature of 70° F. in cold weather shall be provided. Hot Water: Facilities should provide for the continuous supply of three (3) to five (5) gallons of hot water per trailer coach space. Hot water at a temperature of about 180° F. shall be provided 1'or clothes washing equipment. (I) Laundry Drying Facilities: Mechanical laundry drying equipment or laundry drying yards must be provided. Laundry drying machines must be located in the service buildings. Where laundry drying yards are used, they must be convenient to service buildings and have an area of approximately fifty square feet (50 sq. ft.) per trailer coach space. -10- V (J) REFUSE COLLECTION: Refuse must be stored in fly-tight and rodent- proof containers. Each coach space shat be provided from four (4) to six (6) gallons of refuse storage capacity per day. Refuse container stations, where used shall be located not more than two hundred feet (200') from any trailer coach space. (K) RECREATION AREAS: At least one hundred square feet (100 sq. ft.) per trailer coach space must be made availabe in one (1) or more areas for re- creational uses. These areas shall be located so as to be free of traffic hazards. (L) SITE ENGINEERING: Grading and drainage must be performed so that water will drain away from trailer coach spaces, buildings, service and recreational areas, and off the site in a manner which will provide reasonable freedom from erosion. Walks, driveways and retaining walls must be so con strutted as not to interfere with drainage. Roads must be constructed of concrete or macadam, or of gravel, crushed stone, sand-clayslag, or other locally available suitable materials, with a light bituminous surface treatment, oil coating, or other dust-preventive material. Roads must be properly drained. Section 22. ZONING COMMISSION. (A) This Ordinance shall be administered and enforced by a Zoning Commission consisting of not more than seven (7) members to be hereafter appointed by the Board of Trustees of the Village of McCall, Idaho. (B) The members of such commission shall hold office for such term as shall hereafter be designated by the said Board of Trustees of Village of McCall, Idaho. (C) The said Zoning Commission shall have the duties, powers and obligations that shall hereafter be promulgated by the said Board of Trustees of the Village of McCall, Idaho. Section 24. PENALTY: Any person Convicted of a violation of any Section of this Code shall be fined in a sum not to exceed one hundred dollars ($100.00) for any one offense and such person may be confined in the Municipal Jail for a period of not more than thirty (30) days. Either or both such fine and im- prisonment may be imposed. (1959 Code). Section 25. VALIDITY: Each section, subsection, provision, requirement, regulation or restriction established by the ordinance or any amendment thereto, is hereby declared to be independent, and the holding of any part to be un- constitutional, invalid or ineffective for any cause shall not affect nor render invalid the ordinance or amendments thereto as a whole or any other part thereof except the particular part so declared to be invalid. Front Yard: Any open unoccupied space on the same lot with a building between the front line of the builaing (exclusive of steps) and the front property line. Front Property Line: The front property line shall be the front lot line as shown upon the official plat of the property in question. Rear Yard: An open unoccupied space of the same lot with a building between the rear line of the building and the rear line of the lot. Side Yard: An open unoccupied space on the same lot with the builaing between the side wail line of the buildings and the siae lines of the same lot. Story: That portion of a builaing included between the surface of any floor and the surface of the floor next aDove it, or if there be no floor above it, then the surface between such floor and the ceiling next above. Section 3. NAMING ZONING DISTRICTS: For the purpose of this Ordinance the Village of McCall shall be and is hereby divided in- to zoning districts as follows: Zone "A" Residence Zone Zone "E" Residence Zone Zone "C" Commercial Zone Zone "D" Industrial Zone Zone "E" Unrestricted Zone Section L . RESTRIUl'ION6 IN RESIDENCE "A" ZONE: In the Resi- dence7 Zone no building or premises shall be used or occupied or hereafter erected, or structurally altered excepting for one (1) or more of the following uses: Residential Dwellings Apartments Churches Schools Colleges Libraries Museums Parks Flay Grounds Private Swimming Pools or Public Swimming Pools in Public Parks Fire Station, built in residence style -2- In addition to the foregoing uses set forth in this section only the following structures aria uses shall be permitted: (A) Isolated Private Garage: Private garage for use of oc- cupants of a building or buildings on the same premises, may be built upon lots isolated or detached from the awelling or apartment house when special permission is obtained from the Zoning Commission after filing with the Village Clerk the consent of the two property owners on either side of the lot on which such private garage is to be erected or maintained. Where it is architectually possible itis recommended that all garages be incorporated in and made part of the dwelling house. Where the garage is not a part of the dwelling house no portion of the garage shall be nearer the front property line than the front building line. cB) Home Occupation: Families, offices of professional persons, if carried on in a part of the residence building, and which occupy not over fifty per cent (50$) of such residence builaing.shall be permitted. The name of resident owners or occupant of building sites may be displayed on a name and address plaque if approval thereof is first obtained from the Zoning Commission. (C) Out-Buildings:, Shed for tools, fuel and accessories to and used in connection with the residence building or other buildings allowed in said "A" Zone shall be allowed. (D) No animals, livestock or poultry shall be raised, bred, or kept on any lot, except dogs, cats and other household pets, pro- vided the same are not kept, b red, or maintained for commercial pur- pose and are not of such numbers, or kept in such manner that they become a nuisance. No billboards or signboards may be erected, painted or displayed in Zone "A", except as herein provided. (E) Tourist Parks and Motels: Tourist parks, Trailer Courts, motels and cabins or camp grounds shall not be hereafter erected in Zone "A"; however, they may be erected in Zone "3", by special per- mit from the Zoning Commission after a public hearing, (F) Set-back Building Lines and Side Yards: (a) In Zone "A" Residence Zone, every building hereafter erected or structurally altered shall have a set back of at least twenty feet (201 ) from the street property line on which the build- ing front; provided however, that in each block in which fifty per cent (.50%) or more of the builaings on the same side of the street have been built in conformity with a fairly even and determinable front building line of less than twenty feet (20' ) from the street line, all buildings thereafter erected, established or rebuilt shall be in conformity with said front building line. In determining whether or not a front building line has been determined or established the fair intents and purposes shall be considered and minor irregulari- ties ignored and where any dispute arises in the determining of any such front building line, the determination of the Zoning Commission shall be final. (b) In "A" Residence Zone, single story buildings shall be erected a distance of not less than four feet (bI) from the side of property line, which said distance shall not be less than six feet (6' ) fro a two story (2) building. None shall be nearer the side street than fifteen feet (l.5' ). Out buildings not used as dwellings may be constructed to the property line of any lot not nearer the front property line than the rear line of the main building -3- and four feet (141 ) back of the property line of any street running right angles to the alley. For the purpose of this ordinance, fen- ces, wails, or other obstructions over four feet (4' ) in height shall be regarded as structures, this shall apply to the property frontage. Section b. RESTRICTIONS IN RESIDENCE "B" ZONE: All restrictions in Residence "A" Zone shall apply to Residence "B" Zone. In the Residence "B" Zone all builaings or premises may Oe used or occu- pied or hereafter erected, or structurally altered for any use per- mitted in the "A" Residence Zone and for any of the following addi- tional uses: Lodging Houses Boarding Houses Hotels Armories Court House Truck Gardening Nurseries Greenhouse Hospitals Sanitariums In addition to the uses provided in this section, the following regulations shall apply: (A) Retail Shops: Retail shops, if built in residence style by a special permit of the Zoning Commission and showing that such aCtibnwill not cause damage ana will be in accordance with the gen- eral purpose of this Ordinance, and provided further, that before a permit is issued by the Zoning Commission there shall be on file in the office of the Village Clerk the written consent of the owners of seventy-five per cent (75%) of the area of all the property within a radius of three hundred feet (300' ) of any part of the premises whereupon such retail shop is to be erected or occupied. (B) Public Garages: A public garage for storage purposes only where no repair facilities are maintained, when located not less than fifty feet (50' ) from the front lines andnot less than thirty feet (30f ) from any other street line on which the property faces; provided, that before a permit is issued by the Zoning Commission there shall be on file in the office of the Village Clerk the written consent of the owners of seventy-five per cent (75%) of the area of all the property within a radius of three hundred feet (300' ) of any part of the premises whereupon such public garage is to be established or maintained; provided, further, that a public garage shall have no entrances or exitsifor motor vehicles within three hundred feet (300' ) of an entrance or exit to a school, playground, public library, church, hospital, childrens' home or other similar public or semi-public institution. (0) Automobile Gas Stations: Filling stations may be erected and operated oy special permit of the Zoning Commission after con- sent of property owners has been filed as provided in the case of public garages, ana also subject to the same restricitions as pub- lic garages as to location, and if a permit is issued therefor, such building must conform to residence style architecture, and there shall be no advertising signs except of the kind and character permitted in the area by the Zoning Commission. -4- (D) Storage for trucks, cars, building material, contractors' equipment shall not be permitted within "B" Zone unless stored within a building or is stored or piled for actual construction purposes then going on or about to be initiated. (E) Sign boards may be erected in Zone "B" only by special permit of the Zoning Commission and when there is filed in the office of the Village Clerk the consent of the owners of at least seventy- five percent (75%) of the frontage of the property on both sides of the street for a distance of three hundred feet (300' ) each way from the proposed board. (F) Apartment houses, wherever erected or established as such, shall have a side yard of not less than one fourth (//)4) or the height of the building to the eaves or top of coping. Side yards adjoining streets that are running at right angles to the alley shall not be required to be more than four feet ()4f ) in width. (G) Privately owned trailer coaches may be parked in Residence Zones "A" or "B" only by special permission of the Zoning Commission and in no case shall be the only structure on any designated lot. Section 7. RESTRICTIONS IN COMMERCIAL "U" ZONE: In the "C" Commercial Zone, all buildings or premises may be used or occupied or hereafter errected or structually altered for any use permitted in the "A" or "B" Residence Zone and for any of the following addi- tional uses: Business and Professional Offices Retail Commercial Business Wholesale Commercial Business Places of Amusement Printing and Book-Binding Establishments Restaurants Light manufacturing which shall not be dangerous or offensive by reason of dust, gas, smoke or excessive noise, with or without street driveways, may be permitted in "C" Commercial Zone only with the permission of the Zoning Commission and then under such restric- tions and regulations as may be determined by the Zoning Commission. Section 8. RESTRICTIONS IN INI)USTRIAL "D" ZONE: In the "D" Industrial Zone ail buildings or premises may be used or occupied for any use permitted in "A", "3", or "C" Zones and for any of the following additional uses: Flammable Liquids in underground storage, for retail use Poultry and Egg Industries Lumber 'Yards Railroad -Yards Coal and Wood Yard Ice Plants Auto Wrecking Establishments confined within bui/dings Heavy Manufacturing Planing Mills Iron Foundries Gas Plants Heavy Industrial Uses Creameries Flour Mills Public Auction or Sales-yard -5- Section 9. PROVIDING FOR UNRESTRICTED "E" ZONE: In the un- restricted "E" Zone all buildings and premises may oe used or occu- pied for any use in the "A", "B", "C" or "D" Zones and for any use not otherwise prohibited ana for the following additional used to-wit: Storage of flammable liquids in overhead tanks ana flammable liquids in underground storage in unlimited quantities for use or for unloading or rehanaling. Animals and poultry may be maintained and raised in buildings and enclosures when approved by the Zoning Commission. Stock yards, when a permit is issued oy the Zoning Commission, Section 1O. STANDS FOR SALE OF MERCHANDISE UR PRODUCE PROHIBITED: Standssfor the sale of merchandise or produce shall not be per- mitted on the sidewalks, streets or parkings. Section 11. SIDE YARD AREAS: Dwellings erected in Zone "A", "B", "Co or "E", shall have the same side yard areas as those re- quired for awellings in Zone "A". Section 12. NON-CONFORMING USES: (A) A non-conforming use existing at the time this ordinance takes effect may be continued, except that if it is voluntarily dis- continued for two (2) years or more, it shall then be deemed abandoned and any further use must be in conformity with the uses permitted in such aistrict. (B) Any building arranged, intended or designed for a non-con- forming use, the construction of which has been started at the time of the passage of this ordinance, but not completed, may be completed ana put to such non-conforming use, providing it is done within one (1) year after this ordinance takes effect. (C) Any building or structure, existing as a non-conforming use at the time this ordinance takes effect, which is destroyed by fire or the elements, may be reconstructed and restored providing the same is done within two (2) years from the date of said destruction, (D) A building or structure devoted to a non-conforming use at the time this resolution takes effect may not be altered or en- larged so as to extend said non-conforming use more than 10% in area. (E) Whenever a non-conforming use has been changed to a more restricted use or to a conforming use, such use shall not thereafter be changed to a less restricted or non-conforming use. Section 13. PERMIT: A permit shall be issued by the Village Clerk for the construction, alteration, repair, removal or occupancy of any part of any building, structure or use, as provided in this Ordinance or as restricted hereby. Section 14. CONDITIoNS UNDER wHICH A l'ERPIIT IS ISSUED: (A) Application for a permit shall be made to the Village Clerk setting forth the type of construction, alterations, changes or occu- pancy. The Village Clerk shall require the applicant to submit a -6- plan showing the proposed construction, alteration or improvement and ail other information pertinent to the proposed project. (B) On all matters of concern or interest to citizens generally involving the issuance of a permit for a purpose to which there might be general objection, the Zoning Commission shall order public not- ices to be given for a period, of not less than five (5) days of a hearing to be had on such application and at such hearing all inter- ested parties shall be heard before a decision shall be made by the Zoning Commission on the question of issuing such permit or imposing such restrictions or conditions as the Commission shall require after such hearing. -6a REGULATIONS CHANGES: section 15. 4vmcorioltelt0AJMXXIXXX (A) When imxt±xxx±xthe public convenience and welfare will be substantially served, regulations, restrictions and boundaries may from time to time be amended, supplemented, changed, modified,, or repealed. In cases, however, of a protest against such change signed by the owners of twenty percent (?0%) or more either of the area of the lots included in such proposed change, or of those immediately adjacent to the rear thereof extending three hundred feet (300, ) from the street frontage of such opposite lots, such amendment shall not become effective except by the favorable vote of threet:Tburttgfof all members of the legislative body of the Village. However, no such regulation, restriction or boundary shall become effective until after a public hearing in relation thereto, at which parties in interest shall have an opportunity to be heard. (B) Any applicant who is dissatisfied with any decision of the Zoning Commission may within ten (10) days after the decision is made, appeal to the Board of Trustees ana the decision of the Board on appeal shall decide the question appealed. Section 16. APPLICATION OF ORDINANCE HELD TO MINIMUM REQUIREMENTS: In interpreting and applying the privisions of this Ordinance, the provisions hereof shall be held to be the minimum requirements adopted by the Board of Trustees for the promotion of the health, safety, morals, comfort and convenience of residents of the Village and to promote the general welfare. Section 17. ZONING COMMISSION MAY ALTER SET SACK LINE: The yard areas required by this Ordinance for a particular building shall not be diminished and shall not be included as a part of the required lot or yard areas of any other building, excepting; the Zoning Com- mission shall have the power to alter the required set back line in restricted districts in the case of public or semi-public buildings, after a public hearing, and after showing that such action will not cause damage, and will be in accordance with the general purpose of this Ordinance. The yard areas of buildings existing at the time of the adoption of this Ordinance shall not be diminished below the requirements herein provided. Section lb. EXISTING AGREEMENTS NOT ALTERED: It is not intended by this Ordinance to alter or change an existing agreement between parties where this Ordinance imposes a greater restriction upon the height of buildings or requires larger lots or yards than are imposed or required by existing permits, easements, covenants or agreements, but where there is such variation, then this ordinance shall be lib- erally construed to promote the best interest and welfare of the public. Section 19. CERTIFICATE OF COMPLICANCE REQUIRED: No building hereafter erected or altered shall be occupied, used or changed in use or occupancy, until a certificate of occupancy and compliance shall have been issued by the Zoning Commission or its designated agent, stating that the buildings or the proposed use of the build- ing or premises complies with the building requirements of the Village and the provisions of this Ordinance. (D) Site Planning: A plan of the proposed Trailer Court must be developed and submitted for approval of the Zoning Commission in- -8a- dicating the layout of trailer coach spaces, roads, walks, service buildings, service areas, utilities, ana necessary grading. Determination must be made in the initial planning stage of the number of dependent ana independent trailer coaches to be acco- modated. (E) Trailer Coach Space Sizes: Each trailer coach space must be not less than one thousand two hundred fifty square feet (1250 sqA ft.) in area and shall be at least twenty five feet (25' ) wide. (F) Spacing of Trailers: The minimum spacing between trailer coaches or between trailer coaches and buildings must be: Side-to-Side spacing: Fifteen feet (15' ); End-to-end spacing: ten feet (101 ), such space shall be between ends of trailer bodies, not chassis. No trailer shall be located closer than twenty five feet (25' ) from the right-of-way line of a main highway, or closer than ten feet (101 ) from the trailer court property. line. (G) Roads, Walks, and t'arking Areas: General Circulation: Safety and conveience must be a major consideration in the layout of roads, walks, and parking areas within the trailer court. Ail roads must be continuous, Servicing: Suitable Vehicular access for fire fighting equip- ment, delivery of fuel, removal of garbage and refuse, and for other necessary services must be provided. Width of Roads and i'arking Areas: Main access roads, two lanes--- twenty feet (20' ) excluding parking. An equal number of motor vehicle parking spaces must be provided to the number of trailer coach spaces. Such parking spaces must be provided in separate parking areas. Walks: The trailer park walk system must include a walk from the entrance of each trailer to service facilities. Width of Walks Public Walks -minimum- Four Feet (41 ) Entrance Walks (from public walk to trailer door) Two Feet (2' ) (H) Service Buildings: Each trailer court must be provided with one (1) or more service buildings containing the requisite number of plumbing fixtures and other service equipment. The service build- ings must conform in general to the following requirements: Location: Service buildings shall be located not more than two hundred feet (200' ) from any dependent trailer coach space. Construction: The materials and methods used in the construction of service buildings must conform to the Builaing Code for buildings of this nature. It must have an interior finish which is moisture resistant and can be readily cleaned. All rooms of service buildings must be ventilated ana all exterior openings provided with screens. -9-. Facilities: Separate men's and women's toilet rooms must be privided and distinctly marked. These rooms must be separated by a sound resistant wall. A vestibule or screen wall must be provi- ded to prevent direct view into the toilet rooms when exterior doors are open. Plumbing Fixtures: Every Trailer Court must provide adequate toilet and laundry facilities. In no instance shoula there be less than one (1) laundry unit (laundry tray or washing machine); one (1) water closet, one (1) lavatory and one (1) shower for women and one (1) water closet, one (1) lavatory and one (1) shower for men. A slop water closet (water closet with seat removed) must be provided in each service building. The slop water closet shall be in a sep- arate room of the service building with a single direct opening to the outside. The facilities listed above will accommodate any number of in- depenaent trailer coaches, and up to ten (10) dependent trailer coaches. One (1) water closet must be provided for each sex for every ten (10) additional dependent trailer coaches. (Urinals for men may be substituted for one third (1/3) of these water closets) One (1) lavatory must be provided for each sex for every ten (10) additional dependent coaches and one (1) shower or bathtub for each each sex for every twenty (20) additional dependent coaches. A laundry unit must be provided for every twenty (20) additional trailer coach spaces. All water closets and bathtubs or showers for women, and all water closets and bathtubs or showers for men must be located in separate compartments, with self closing doors. Gang type shower compartments may be used for men. Individual shower stalls must be approximately three by three feet (3' x 3' ). Showers for women must have a dressing compartment with stool or bench. The room containing the laundry units must be separated from the toilet rooms, and have an exterior entrance only. All plumbing installations shall conform to the State Plumbing Code. Electrical: All electrical installations shall conform to the State Electrical Code. Heating: heating Facilities capable of maintaining a temperature of 70° F. in cola weather shall be provided. Hot Water: Facilities shoula provide for the continuous supply of three (3) to five (5.) gallons of hot water per trailer coach space. Hot water at a temperature of about lbO° F. shall be provided for clothes washing equipment. (I) Laundry Drying Facilities: Mechanical laundry drying equipment or laundry drying yards must be provided. Laundry drying machines must be located in the service buildings. Where laundry drying yards are used, they must be convenient to service buildings and have an area of approximately fifty square feet (50 sq. ft.) per trailer coach space. -10- (J) REFUSE COLLECTION: Refuse must be stored in fly-tight and rodent- proof containers. Each coach space shal be provided from four (4) to six (6) gallons of refuse storage capacity per day. Refuse container stations, where used shall be located not more than two hundred feet (200') from any trailer coach space. (K) RECREATION AREAS: At least one hundred square feet (100 sq. ft.) per trailer coach space must be made availabe in one (1) or more areas for re- creational uses. These areas shall be located so as to be free of traffic hazards. (L) SITE ENGINEERING: Grading and drainage must be performed so that water will drain away from trailer coach spaces, buildings, service and recreational areas, and off the site in a manner which will provide reasonable freedom from erosion. Walks, driveways and retaining walls must be so con strutted as not to interfere with drainage. Roads must be constructed of concrete or macadam, or of gravel, crushed stone, sand-clayslag, or other locally available suitable materials, with a light bituminous surface treatment, oil coating, or other dust-preventive material. Roads must be properly drained. Section 22. ZONING COMMISSION. (A) This Ordinance shall be administered and enforced by a Zoning Commission consisting of not more than seven (7) members to be hereafter appointed by the Board of Trustees of the Village of McCall, Idaho. (B) The members of such commission shall hold office for such term as shall hereafter be designated by the said Board of Trustees of Village of McCall, Idaho. (C) The said Zoning Commission shall have the duties, powers and obligations that shall hereafter be promulgated by the said Board of Trustees of the Village of McCall, Idaho. Section 24. PENALTY: Any person Convicted of a violation of any Section of this Code shall be fined in a sum not to exceed one hundred dollars ($100.00) for any one offense and such person may be confined in the Municipal Jail for a period of not more than thirty (30) days. Either or both such fine and im- prisonment may be imposed. (1959 Code). Section 25. VALIDITY: Each section, subsection, provision, requirement, regulation or restriction established by the ordinance or any amendment thereto, is hereby declared to be independent, and the holding of any part to be un- constitutional, invalid or ineffective for any cause shall not affect nor render invalid the ordinance or amendments thereto as a whole or any other part thereof except the particular part so declared to be invalid. Trailer Coach is a vehicle without means of self-propulsion whilh is constrloted to permit occupancy as a dwelliae o sleeping place for one (1) or more persons. Dependent Trailer Coach is one which does not have a water closet and a bathtub or shower. Indpendent Trailer Coach is one that has a water closet and a bathtub or shower. Trailer Coach Space is a plot of ground within a trailer court deste;nated for the accommodation of one (1) trailer coach. Service Building is a building housing communal toilet, laundry, and other sanitary facilities neceseary for the health and conveni- ence of the trailer occupants. (B) Site Selection: Location: A Trailer Court site must not be located close to swamps or other potential breedina places for insects or rodents, subject to flood me, fire, or 6ther hazards or exposed to chronic nusiances, such as noise, smoke, fumes, and odors. The site should be boinded on a t least one (1) side by a public streateor hi7hway.
