APPROVAL OF MINUTES - Meeting of October 25, 1994 Commissioner Seibert moved to approve the Minutes as written, seconded by Commissioner Larson and unanimously carried. 6. UNFINISHED BUSINESS: NONE 7. NEW BUSINESS: A. PUBLIC HEARING: CONDITIONAL USE PERMIT 94 -1212 Site: 952011 LAS TUNAS DRIVE Property Owner: Applicant: TSAI AND ASSOCIATES 114 WEST LAS TUNAS DRIVE ARCADIA, CALIFORNIA 91007 TAI -SHING TU 945 PALO ALTO DRIVE ARCADIA, CALIFORNIA 91007 Planning Commission Minutes Date of Hearing: November 8, 1994 Request: Page 2 • A conditional use permit to allow a bridal shop within an existing com- mercial unit in the City Center (CC) District of the Downtown Specific Plan Community Development Director Dawson stated that notices were mailed to property owners within 500 feet of the subject site. Director Dawson gave the background information contained in the staff report dated November 8, 1994 and video was shown. Director Dawson stated that bridal shop uses and the relationship to conditional use permit applications was studied by the Planning Commission at their last two meetings. The Commission decided that bridal shop uses would no longer require a regular conditional use permit in the near future; an administrative review and approval process could be employed instead. The Planning Commissioners received six letters in opposition to this application which were submitted on November 8, 1994. The Planning Commissioners were provided another copy of a petition received on June 28, 1994 from seven bridal shop business owners who requested a moratorium against new bridal shops. Director Dawson stated the applicant's building is 6,600 square feet. The applicant will only use the east 3,060 square foot portion of the building for a bridal shop /photography studio. The location has adequate off - street parking. The resolution sets forth certain conditions and staff recommends approval of the request, based upon the required findings. Director Dawson explained the three required findings to the audience. There being no questions from the Commission, Chairman Griffiths opened the public hearing and invited those in favor of the project to speak. Tai -Shing Tu, 945 Palo Alto Drive, Arcadia, (applicant) felt that bridal shops being located in close proximity to each other make it convenient for customers to shop. He did not feel there are too many bridal shops in Temple City. David Lo, 509 -C E. Live Oak Street, San Gabriel, stated this new business will deliver "one stop bridal servic- es". Mr. Lo stated that potential customers consider Temple City to be a good bridal shop town. Chairman Griffiths invited those against the project to speak. Luke Yu, Luke and Sylvia Wedding, 9087 Las Tunas Drive, stated that he does not agree with a previous campaign statement to "stop all the bridal shops ", however, his business is already established. He provides a one -stop business of bridal dresses, photography and other related services. Mr. Yu stated that Lucy Bridal and Photography as well as Sheraton Wedding Wear /Photo Studio have pur- chased their buildings and cannot withstand more competi- tion. Mr. Yu asked that any future new bridal shop business be approved only if situated 500 -1,000 feet from any existing bridal shop. Commissioner Larson asked if Luke and Sylvia Wedding performs facials in their shop? Mr. Yu answered yes, they do facials, make -up and hairstyling. They hold a cosmetology license. Shing -Shing Chang, B.N.K. Wedding Group, 9908 Las Tunas Drive #C, is a cosmetologist and provides the bride's skin care for photography and the wedding day. In the orient, the shops perform all the bridal services in one building. Stacey Huang, Sheraton Wedding Wear /Photo Studio, 9508 Las Tunas Drive, stated the applicant's location is a couple doors from her business. There now would be four bridal shops within 500 square feet. This is too much competition of the same business type next to each other. There being no one else to speak for or against, Commis- sioner Seibert moved to close the public hearing, seconded by Commissioner Evans and unanimously carried. Commissioner Seibert informed the audience and applicant that the Planning Commission may not control commerce and business. This application meets all the conditions for approval of a conditional use permit and he could make the findings. Commissioner Larson concurred. Chairman Griffiths stated this application meets all conditions for approval. Commissioner Seibert moved to approve C.U.P. 94 -1212, seconded by Commissioner Evans and unanimously carried. Chairman Griffiths stated that there is a 10 -day period in which anyone may appeal the decision of the Planning Commission to the City Council. B. PUBLIC HEARING: MODIFICATION OF CONDITIONAL USE PERMIT 90 -1033 ZONE VARIANCE 94 -1216 Site: 5237 FARAGO AVENUE Property Owner /: Applicant BRIAN LEE 5237 FARAGO AVENUE TEMPLE CITY, CALIFORNIA 91780 Request: A modification of conditional use permit to allow a fence in the front yard area which exceeds three feet in height and a variance to allow the enclosing of an existing patio resulting in a floor area ratio which exceeds .50 in the Medium Density Residential (R -2) Zone Community Development Director Dawson stated that notices were mailed to property owners within 300 feet of the subject site. Director Dawson gave the background information contained in the staff report dated November 8, 1994 and video was shown. Director Dawson stated the site consists of 1,857 square feet. A conditional use permit was required upon the original construction of four residential condominiums in 1990. The floor area ratio of the dwelling is currently 49.6 %. The request is for the existing covered patio to be converted to a den, resulting in a floor area ratio of 50.5 %, thus requiring a variance. There being no questions from the Commission, Chairman Griffiths opened the public hearing. No one came forward to speak for or against. Commissioner Seibert moved to close the public hearing, seconded by Commissioner Larson and unanimously carried. Commissioner Muto could not make the findings for approval. Commissioner Evans concurred. Commissioner Seibert concurred. Commissioner Larson concurred. Chairman Griffiths stated that the common open space should not be consumed and he could not make the findings for approval. Commissioner Muto moved to deny Zone Variance 94 -1216 and Modification of C.U.P. 90 -1033, seconded by Commissioner Evans and unanimously carried. Chairman Griffiths stated that there is a 10 -day period in which anyone may appeal the decision of the Planning Commission to the City Council. 8. COMMUNICATIONS: NONE 9. MATTERS FROM CITY OFFICIALS: A. RULES OF ORDER FOR COMMISSIONERS The Planning Commission received a draft copy of "Rules of Order and Procedures ", prepared by the City attorney, for information only. B.
