HomeMy Public PortalAbout2019-44 Authorizing the Manager to engage information technology professionals to assist with a data security eventRESOLUTION NO. 2019.44 A RESOTUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING THE VILLAGE, MANAGER TO ENGAGE INFORMATION TECHNOLOGY PROFESSIONALS TO ASSIST THE VILLAGE WITH A DATA SECURITY EVENT; PROVIDING FOR AUTHORIZATION AND LIMITATIONS ON EXPENDITURES; PROVIDING FOR IMPLEMENTATION AND EFFECTIVE DATE. \ryHEREAS, the Village of Key Biscayne (the "Village") has experienced a data security event affecting information technology ("IT") systems utilized by the Village in some of its day- to-day operations; and \ilHEREAS, the event has affected the Village's ability to provide certain services for the health, safety and welfare of the Village residents; and WHEREAS, the Village requires the assistance of specialized professionals to analyze and take all steps necessary to return its IT systems to a fully functional status; and WHEREAS' the Village maintains a specialized cyber security insurance policy with AXA XL through Preferred Governmental Insurance Trust (PGIT) (the "Policy"), which covers all costs associated with the recovery, repair and reestablishment of the Village's IT systems operation; and WHEREAS, the Village Council finds that this Resolution is in the best interest and welfare of the residents of the Village. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOIWS: Section 1. Recitals. Each of the above-stated recitals are hereby adopted, confirmed, and incorporated herein. Section 2. Authorization and Expenditures. The Village Council authorizes the Village Manager to engage all professional service and advisory firms she reasonably deems necessary to assist the Village with the recent data security event, including, but not limited to firms specializing in the legal, forensic and data recovery aspects of cyber data security events. Except as limited in Section 3 below, the Village Manager is authorized to incur all expenditures necessary or appropriate to expeditiously and without delay return the IT system(s) to a fully functional status. Section 3. Limitation. The expenditure authority granted above is limited to amounts not to exceed $30,000 in total; however, the Village Manager may (in her judgment) incur additional expenses necessary to expeditiously and fully resolve the current data security event, so long as the expenditures are covered by and do not exceed insurance limits available under the Policy. Section 4. Implementation. The Village Council hereby authorizes the Village Manager to take all steps necessary to implement this Resolution. Section 5.Effective Date.
