A. APPROVAL OF MINUTES - Meeting of November 22, 1994
Commissioner Seibert moved to approve the Minutes as
written, seconded by Commissioner Larson and unanimously
carried.

Request: A tentative parcel map and
conditional use permit to allow a
residential condominium development
consisting of three detached
dwelling units in the Multiple
Residential (R -2) zone
Community Development Director Dawson stated that notices
were mailed to property owners within 300 feet of the
subject site. Director Dawson gave the background
information contained in the staff report dated December
13, 1994. Video of the site was shown.
Director Dawson stated the existing 1,580 square foot
dwelling was constructed in 1948. In March, 1994, a
converted attic space which had been converted into
living space without Building or Planning Department
approvals was determined by the Building Inspector to be
unhabitable space. The subject property will be
demolished for this development.
Director Dawson stated that staff placed 63 conditions
upon the recommended approval. Director Dawson indicated
changes to be made on conditions 13, 19 and 20.
There being no questions from the Commission, Chairman
Griffiths opened the public hearing and invited those in
favor of the project to speak.
Terence Kwok, 109 E. Floral Drive, Monterey Park, the
applicant, offered to answer any questions regarding the
project.
Chairman Griffiths invited those against the project to
speak.
Glen Mulkey, 5008 Sereno Drive, asked if the properties
would be one or two - story.
Chairman Griffiths answered two - story.
Mr. Mulkey stated his displeasure with two -story homes,
adding that there are already ten new two -story homes on
Sereno Drive.

Jen -Min Cheng, 5017 Sereno Drive, asked if three units
are allowed in the R -3 lot and how long construction will
occur.
Director Dawson answered that, due to the density
applicable to this property, three units are allowable
and construction may take six months.
Mr. Chenq asked how toxic materials are controlled and if
other traffic and safety topics have been addressed.
Director Dawson answered that demolition permits require
accounting for asbestos and other materials being
removed. Additionally, Building Department monitoring
and inspections occur throughout the construction
process. Director Dawson assured Mr. Cheng that any
future building complaint may be reported to staff.
Chairman Griffiths informed Mr. Cheng that specific
requirements are stated in the Building Codes which are
available for anyone's review.
Mary Burke, 5114 N. Sultana Avenue, asked that public
hearing notices be mailed farther than 300 feet radius.
Chairman Griffiths stated that 300 feet is the legal
requirement for residential applications and the City
would incur additional costs for lengthier mailings.
Ms. Burke stated that many drivers use Sereno Drive for
a shortcut and she was concerned regarding additional
building on Sereno Drive.
Mr. Mulkey asked how many bedrooms are in each unit and
the total square footage.
Director Dawson answered that each unit will have four
bedrooms and between 2,324 -2,370 total square feet.
Mr. Kwok stated in rebuttal that the project will improve
this lot and enhance the neighborhood. The driveway will
be 20 feet from the neighboring property.
There being no one else to speak for or against, Commis-
sioner Seibert moved to close the public hearing,
seconded by Commissioner Larson and unanimously carried.
Commissioner Larson could make the findings for approval.

Commissioner Muto stated this is a large lot which meets
all the requirements and he could make the findings.
Commissioner Seibert concurred.
Chairman Griffiths concurred.
Commissioner Seibert moved to approve Tentative Parcel
Map #24047 and Conditional Use Permit 94 -1213, with the
above mentioned corrections of conditions 13, 19 and 20,
seconded by Commissioner Larson and unanimously carried.
Chairman Griffiths stated that there is a 10 -day period
in which anyone may appeal the decision of the Planning
Commission to the City Council.

Community Development Director Dawson stated that notices
were mailed to property owners within 300 feet of the
subject site. Associate Planner Turner gave the
background information contained in the staff report
