Sherbondv Village Auditorium 215 Perviz Avenue Opa-locka, FL 33054 1. CALL TO ORDER: Mayor Matthew Pigatt called the virtual Special Commission Meeting to order at 6:30 p.m. on Thursday, May 21, 2020. Pursuant to Executive Order No. 20-69, issued by the office of the Governor Ron DeSantis on March 20, 2020, municipalities may conduct meetings of their governing boards without having a quorum of its members present physically or at any specific location, and utilizing communications media technology such as telephonic or video conferencing, as provided by Section 120.54(5)(b)2, Florida Statutes. An opportunity was given to the public to email the City Clerk prior to the Commission Meeting with any questions/comments/concerns on items we will hear on this evening's Special Commission Meeting agenda. This meeting is being streamed live at https://www.youtube.com/user/CityofOpalocka. Since this is a virtual meeting as authorized by the Governor of the state of Florida, again, members of the public wishing to address the commission have been offered the opportunity to do so. Public comments will be included as part of the public record for this virtual meeting and will be considered by the City commission prior to any action taken. 2. ROLL CALL: The members of the City Commission appearing remotely were: Mayor Matthew Pigatt, Vice Mayor Chris Davis, Commissioner Sherelean Bass, and Commissioner Joseph L. Kelley. Also appearing remotely were: City Manager John E. Pate, City Attorney Burnadette Norris -Weeks, and City Clerk Joanna Flores. Commissioner Alvin Burke was not present. 3. INVOCATION: The invocation was delivered by Commissioner Joseph L. Kelley. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was recited in unison. 5. PUBLIC INPUT: 1 Virtual Special Commission Meeting May 21, 2020 City Clerk Flores reported that there was no public input for this meeting. 6. RESOLUTION: 1. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE AND ISSUE ORDER NO. 20-06, ATTACHED HERETO AS EXHIBIT "A", TO RE -OPEN THE BUSINESSES PERMITTED THEREIN WITHIN THE CITY OF OPA-LOCKA, FLORIDA, WITH OPERATIONAL CONDITIONS, AND CONTINUE THE CLOSURE OF OTHER BUSINESSES DUE TO NOVEL CORONAVIRUS DISEASE 2019 (COVID- 19); PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. Sponsored by City Manager The above resolution was read by City Attorney Norris -Weeks. It was moved by Vice Mayor Davis, seconded by Commissioner Kelley for discussion. Mayor Pigatt asked the manager to provide clarity on the item. City Manager Pate said the order came from Miami -Dade County and cities are reviewing it to see what businesses can reopen. He is bringing it to the commission to see if they want to approve it at his time. He asked Mr. Gay to come forward and provide additional information on the item. Planning and Community Development Director Gregory Gay said he along with his staff provided an assessment to the commission of what other municipalities were doing. He said he is open to answering questions the commission may have. Commissioner Kelley asked the manager if the order will mirror the county. City Manager Pate said it is the same, however, the capacity will be reduced from fifty percent (50%) to twenty five percent (25%). Commissioner Kelley asked how the curfew will work if certain businesses will reopen. City Attorney Norris -Weeks said it might create issues if the businesses are open later than the 10:00 p.m. curfew. Commissioner Kelley said he hopes that no issues arise because of this. Mayor Pigatt said he is not in favor of implementing the emergency order because the City is already having challenges with enforcement. 2 Virtual Special Commission Meeting May 21, 2020 City Manager Pate said he also agreed that the item should be deferred so it can be further reviewed by everyone. Mayor Pigatt asked that the item be deferred until next week. Commissioner Kelley agreed and stated that he would like to receive the information in advance so there is time to review it and not on the day of the meeting. Commissioner Bass said she is concerned that the community is suffering and this is a huge decision to make on behalf of the welfare of the residents. Mayor Pigatt asked the manager how long he wants to defer the item. City Manager Pate said it can be deferred indefinitely until the City can come to a resolution. This item was deferred by the sponsor. 6. ADJOURNMENT: There being no further business to come before the Commission, it was moved by Commissioner Kelley, seconded by Commissioner Burke to adjourn the virtual meeting at 7:14 p.m. MAYOR ATTEST: Virtual Special Commission Meeting May 21, 2020
