The MBTA requires that this service be placed below ground in order to avoid conflict with the catenary wires above. b) Public hearins and vote on a Proposed Loan Order authorizing the Town Treasurer with the approval of the Town Manager to borrow monies in the amount of$370,000 under Chapter 44 of the General Laws or any other enabling authority for the construction,reconstruction, and improvements of municipal outdoor recreational and athletic facilities at Casey Park,including the payment of all costs incidental or related thereto;which sum shall be in addition to.the amount of $259,200, which has previously been appropriated for park improvements and included in the tax levy. 10. Anthony Palomba, Councilor Al Large BE IT RESOLVED: that the Town Council of the City known as the Town Angeline B.Kounells, of Watertown hereby approves a grant of location to A T & T (Teleport District A Councilor Communications) to install and maintain approximately 30 feet of 2, 4 Cecilia Lenk, inch conduits from pole 118/11 to the Town Boundary with Belmont in District B Councilor order to provide service to properties on the opposite side of Belmont Vincent J.Piccirilll,Jr., Street. Donohue, APPROPRIATE MEASURES TO ENSURE PUBLIC HEALTH AND SAFETY Councilor At Large THROUGH THE REMOVAL OF SNOW AND ICE Susan G.Falkoff, Councilor At Large WHEREAS, a primary function of Town govermnent is to protect and insure the Anthony Palomba, preservation of public health and safety; and Councilor At Large Angeline S.Kounelis, WHEREAS, access to property by residents and public safety first responders is District A Councilor necessary at all times for protection and preservation of public health and safety; Cecilia Lenk, and District B Councilor Vincent J.Picciriui,Jr., WHEREAS, the safety of the Town's residents and first responders is of paramount District C Councilor importance to the Town of Watertown. Kenneth M.Woodland District D Councilor NOW THEREFORE BE IT RESOLVED that the Town Council of the City known as the Town of Watertown hereby authorizes the Town Manager to take all measures necessary to protect and preserve public health and safety through maintenance of access to public and private property, including the removal of snow and ice from ways,public and private, as deemed necessary and appropriate by the Town Manager and the Superintendent of Public Works in the exercise of appropriate discretion. In exercising such discretion, the Town Manager and the Superintendent of Public Works may impose such requirements, regulations, and procedures as are necessary to enable maintenance of access to public and private property through the proper removal of snow and ice so as to best protect the safety of the public and first responders, subject to the following provisions and restrictions: 1. The private way and accessed properties may not be under single ownership, including under a master deed as a condominium complex. 2. The private way may not provide access exclusively to non-residential properties. 3. The Town may provide snow and ice removal on any private way that provides access to a municipal facility. 4. The Town disclaims any liability for any damage to the private way itself, or to any vehicles parked on the private way resulting from snow and ice removal for the purposes of public safety, and maintains and asserts all immunities and protections as available pursuant to the Massachusetts Tort Claims Act,G.L. c. 258, and any other provision under law as available thereto. 5. Owners or abutters of private ways may choose to opt out of municipal snow and ice removal services pursuant to procedures developed by the Superintendent of Public Works. And be it resolved that this Resolution shall be effective immediately upon passage; And further be it resolved that the Town Council authorizes the Town Manager to petition the General Court for special legislation to authorize,validate, and confirm the action taken hereunder.
