TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: NONE 5. CONSENT CALENDAR: A. APPROVAL OF MINUTES - Meeting of May 28, 1996 Vice - Chairman Griffiths moved to approve the minutes as written, seconded by Commissioner Larson and unanimously carried. 6. UNFINISHED BUSINESS: NONE 7. NEW BUSINESS: A. PUBLIC HEARING: TENTATIVE TRACT MAP 52205 ADMINISTRATIVE,C.U.P. 96 -1271 Site: 5341 -5347 WELLAND AVENUE Owner/ Applicant: SHU -CHURN KANG WAN -HUEI KANG CHANG HSIU -MEI 365 SHARON ROAD ARCADIA, CA 91007 Planning Commission Minutes Page 2 Date of Hearing: June 25, 1996 Request: A tentative tract map and administrative conditional use permit to allow the construction of an eight unit detached residential condominium project in the Medium Density (R -2) zone. Community Development Director Dawson stated that notices were mailed within a 300 foot radius of the subject site and gave the background information contained in the staff report dated June 25, 1996. Director Dawson stated that in 1990 the City Council considered an application for a nine unit detached condominium project at the subject property and discussed possible negative impacts associated with nine units. The City Council ultimately denied the project for nine units until an environmental impact report was prepared. The current proposal has been changed from the previous proposal and involves eight detached condominium units. Staff now recommends approval of the project with 60 conditions. The lot area is 38,009 square feet and the project is less than the allowable density for the R -2 zone. It will also fit in with many of the surrounding properties. Director Dawson stated that the Fire Department has recommended that 34 feet of unobstructed fire lane be constructed. This requirement could be an obstacle to this development, however, the Fire Department is concerned about access and possible vehicle parking in the fire lane. Staff has addressed these concerns in Conditions #40 and #14 dealing with the C.C. &R.'s. They will include a provision that the City of Temple City, L.A. County Sheriff's Department and L.A. County Fire Department have authorization to fully enforce the "No Parking" prohibition in the designated fire lane, including issuing citations and towing of vehicles parked in said fire lane. There being no questions from the Commission, Chairman Seibert opened the public hearing and invited those in favor of this project to speak. Alex Chang, 8730 Huntington Dr., San Gabriel, stated that the developers and applicant agree with all conditions. Chairman Seibert asked if anyone wished to speak in opposition to this application. • " " " Planning Commission Minutes Page 3 Date of Hearing: June 25, 1996 Don Slingloff, 1214 S. 5th, Monrovia, owns 5420, 54181/2, 5418 and 5416 Welland Avenue, and asked if balconies are planned for the outside of the dwellings. Director Dawson answered that no balconies are in the plans. There are architectural treatments and popouts, but no balconies or porches. Mr. Slinqloff stated that in Monrovia there are many dwellings with balconies and people can look into other neighbors' properties. Mae Rosenkranz, 5351 N. Welland Avenue, lives north of the subject property and asked if an environmental analysis was done on this property. Director Dawson stated that a previous proposal in 1990 was considered to have possible impacts; however, this project is for eight units rather than nine and no significant environmental impacts are found to exist. Ms. Rosenkranz asked if a block wall would be installed on the side property line and stated the new lots will be a nice improvement. Director Dawson answered that the developer is required to install a 6 foot block wall on the side property lines and a survey will be conducted to determine the exact property line. Commissioner Larson moved to close the public hearing, seconded by Vice - Chairman Griffiths and unanimously carried. Commissioner Muto stated this project fits into the neighborhood. Commissioner Larson felt that the fire lane should be 40 feet wide but could make the findings for approval of the project. Vice - Chairman Griffiths concurred. Chairman Seibert concurred. Commissioner Muto moved to approve the Negative Declaration, Tentative Tract Map 52205 and Administrative C.U.P. 96 -1271, seconded by Vice - Chairman Griffiths and unanimously carried. Planning Commission Minutes Page 4 Date of Hearing: June 25, 1996 Chairman Seibert stated that this project must be approved by the City Council and be renoticed 10 days in advance of that hearing. B. SUBDIVISION MAP EXTENSIONS Community Development Director Dawson stated that two State Assembly Bills have mandated automatic extensions for approved and unexpired subdivision maps. This has resulted in a window period between September 13, 1995 and May 15, 1996 for which extensions have not been covered by these Bills. The Planning Commission must consider granting a retroactive one -year extension for any map which may have expired during the above referenced window period. Staff provided a list of all approved tentative parcel and tract maps, showing the original date of approval, extensions and projected expiration dates. In order to create equity and simplicity, staff recommended that Temple City grant a one -year retroactive extension for any approved subdivision map which may have expired between the above dates and to ratify the one -year extension approved by Senate Bill No. 771., Director Dawson stated that two approved tentative subdivision maps have actually expired; these two parcel maps are for flag lot subdivisions and would be _ retroactively extended to give the applicants more time to record the map. Commissioner Muto made a motion to ratify the one -year extension granted by Assembly Bill No. 771 and for the City to grant a retroactive one -year extension for any subdivision map which may have expired between September 13, 1995 and May 15, 1995, seconded by Vice - Chairman Griffiths and unanimously carried. 8. COMMUNICATIONS: NONE 9. MATTERS FROM CITY OFFICIALS: A. Director Dawson informed the Commission that there are no public hearing items scheduled for the next regularly scheduled meeting of July 9, 1996; therefore, that meeting may be cancelled for lack of a quorum.
