AN ORDINANCE AMENDING THE MUNICIPAL CODE OF TIFFIN, IOWA,
CHAPTER 92, SECTION 92.03(3) BILLING FOR WATER SERVICE, LATE
PAYMENT AND SECTION 92.04(4)(A) SERVICE DISCONTINUED, FEES
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section 1. Purpose: The purpose of this ordinance is to amend Section
92.03(3) and Section 92.04(4)(a) of Chapter 92 of the Municipal Code of Tiffin,
Iowa, to increase the late payment fee and the non-payment fee.
Section 2. Amendment. Sections 92.03(3) and 92.04(4)(a) of Chapter 92
is hereby amended as follows:
CHAPTER 92
WATER RATES
92.03 BILLING FOR WATER SERVICE. Water service shall be billed as
part of a combined service account, payable in accordance with the following:
(Code of Iowa, Sec. 384.84)
1. Bills Issued. The Utility Department shall prepare and issue bills for
combined service accounts on or before the first day of each month.
2. Bills Payable. Bills for combined service accounts shall be due and
payable at the office of the Utility Department by the 20th day of the following
month.
3. Late Payment. A late fee of.five ten percent shall be added to each
delinquent bill for payment after the due date.
92.04 SERVICE DISCONTINUED. Water service to delinquent customers
shall be discontinued or disconnected in accordance with the following:
(Code of Iowa, Sec. 384.84)
1. Notice. The Utility Department shall notify each delinquent customer
that service will be discontinued or disconnected if payment of the combined
service account, including late payment charges, is not received by the date
specified in the notice of delinquency. Such notice shall be sent by ordinary mail
to the customer in whose name the delinquent charges were incurred and shall
inform the customer of the nature of the delinquency and afford the customer
the opportunity for a hearing prior to the discontinuance or disconnection.
2. Notice to Landlords. If the customer is a tenant, and if the owner or
landlord of the property or premises has made a written request for notice, the
notice of delinquency shall also be given to the owner or landlord. If the customer
is a tenant and requests a change of name for service under the account, such
request shall be sent to the owner or landlord of the property if the owner or
landlord has made a written request for notice of any change of name for service
under the account to the rental property.
3. Hearing. If a hearing is requested by noon of the day preceding the shut
off, the Mayor shall conduct an informal hearing and shall make a determination
as to whether the discontinuance or disconnection is justified. The customer has
the right to appeal the Mayor's decision to the Council, and if the Council finds
that discontinuance or disconnection is justified, then such discontinuance or
disconnection shall be made, unless payment has been received.
4. Fees.
A. A fee of $2,5,.9-0 $35.00 shall be charged before service is restored to a
delinquent customer. No fee shall be charged for the usual or customary trips in
the regular changes in occupancies of property.
Section 3. Repealer. All ordinances or parts of ordinances in conflict
with the provisions of this Ordinance are hereby repealed.
Section 4. Severability Clause. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication
shall not affect the validity of the ordinance as a whole or any section,
provision or part thereof not adjudged invalid or unconstitutional.
Section 5. When Effective. This ordinance shall be in effect after its final
passage, approval, and posting as provided by law.
On the 5th day of March, 2024, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Olney introduced Ordinance No. 2024-508, and
moved that it be given its first reading. The motion was seconded by
Councilperson Havens.
Ayes: Havens, Olney, Orris, Schnedler, Limkemann.
Nays: None.
Five members of the Council being present and having voted "Aye", Mayor Tim
Kasparek declared the motion carried, and Ordinance No. 2024-508, was read
the first time, discussed, and placed on record.
On the 19th day of March, 2024, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Orris introduced Ordinance No. 2024-508, and
moved that it be given its second reading. The motion was seconded by
Councilperson Schnedler.
Ayes: Schnedler, Limkemann, Havens, Orris, Olney
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Tim
Kasparek declared the motion carried, and Ordinance No. 2024-508, was read
the second time and discussed and placed on record.
On the 2nd day of April, 2024, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Haven introduced Ordinance No. 2024-508, and
moved that it be given its third and last reading. The motion was seconded by
Councilperson Orris .
Ayes: Havens, Orris, Olney, Schnedler, Limkemann
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Tim
Kasparek declared the motion carried, and the ordinance was passed and
adopted.
Whereupon the Mayor declared that Ordinance No. 2024-508 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the
Council on the 2nd day of April, 2024 and approved by the Mayor on the 3rd day
of April, 2024.
