HomeMy Public PortalAboutOrdinances-2024-510CITY OF TIFFIN ORDINANCE NO. 2024-510 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF TIFFIN, IOWA, CHAPTER 63, SECTION 63.04, SPEED REGULATIONS, FOR ROBERTS FERRY ROAD BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section I. Purpose: The purpose of this ordinance is to amend Section 63.04, Code of Ordinances, to include a special speed zone for Roberts Ferry Road southbound. Section II. Amendment: Section 63.04 of Chapter 63 is hereby amended. as .follows: CHAPTER 63 SPEED REGULATIONS 63.04 SPECIAL SPEED ZONES. In accordance with requirements of the Iowa Department of Transportation, or whenever the Council shall determine upon the basis of an engineering and traffic investigation that any speed limit listed in Section 63.02 is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of the City street system, the Council shall determine and adopt by ordinance such higher or lower speed limit as it deems reasonable and safe at such location. The following special speed zones have been established: (Code of Iowa, Sec. 321.290) 1 Special 10 MPH Speed Zones. A speed in excess of 10 miles per hour is unlawful on all alleys within the City. 2. Special 25 MPH Speed Zones. A speed in excess of 25 miles per hour is unlawful on any of the following designated streets or parts thereof. A. On Roberts Ferry Road. 3. Special 35 MPH Speed Zones. A speed in excess of 35 miles per hour is unlawful on any of the following designated streets or parts thereof. A. On Park Road, from Forevergreen Road southerly to 340th Street SW, except the designated School District zone along Park Road, which will have a speed zone of 25 miles per hour. B. On Roberts Ferry Road from the exit ramp of Interstate I-80 westbound, north to the existing posted 25 miles per hour speed limit sign which is 15 feet south of the south entrance to the Clear Creek Mobile Home Park. C. On North Park Road from Oakdale Boulevard to Forevergreen Road. gyp,:.,. Stied. d..,°. 4. Signs. The Public Works Department of the City of Tiffin will post speed limit signs consistent with the provisions of this section. 5. Highway 6 (Marengo Road). The speed limit on Highway 6 (Marengo Road) is set by the Iowa Department of Transportation. Section III. Repealer. All ordinances or parts of ordinance in conflict with the provisions of this Ordinance are hereby repealed. Section IV. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section V. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 19th day of March 2024, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Orris introduced Ordinance No. 2024-510, and moved that it be given its first reading. The motion was seconded by Councilperson Schnedler. Ayes: Olney, Schnedler, Limkemann, Havens, Orris Nays: None Five members of the Council being present and having voted "Aye", Mayor Tim. Kasparek declared the motion carried, and Ordinance No. 2024-510, was read the first time, discussed, and placed on record. On the 2nd day of April 2024, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2024-510, and moved that it be given its second reading. The motion was seconded by Councilperson Orris. Ayes: Olney, Schnedler, Limkemann, Havins, Orris Nays: None Five members of the Council being present and having voted "Aye", Mayor Tim Kasparek declared the motion carried, and. Ordinance No. 2024-510, was read the second time and discussed and placed on record. On the 2nd day of April 2024, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Orris introduced Ordinance No. 2024-510, and moved that it be given its third and last reading. The motion was seconded by Councilperson Olney. Ayes: Schnedler, Limkemann, Havens, Orris, Olney Nays: Five members of the Council being present and having voted "Aye", Mayor Tim Kasparek declared the motion carried, and the ordinance was passed and adopted. Whereupon the Mayor declared that Ordinance No. 2024-510 be adopted and signified his approval of same by fixing his signature thereto.
