THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. ;!fJA AN ORDINANCE CHANGING THE ZONING CLASSI- FICATION OF CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF BEL AIRE, KANSAS AND AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF BEL AIRE, KANSAS. WHEREAS, application was made for a zone change for property located wi thin the corporate limi ts of the City of Bel Aire, Kansas, as described herein. WHEREAS, notice of a January 13, 1992 Bel Aire Planning Commission public hearing on said application was published in the official city newspaper on December 19, 1991 and mailed on December 19, 1991 to all owners of record of lands, within the corporate limits of the City of Bel Aire, located within 200 feet of the proposed zoning change and, outside the corporate limits of the City of Bel Aire, located within 1000 feet of the proposed zoning change. WHEREAS, the Bel Aire Planning Commission conducted a public hearing on said application on January 13, 1992 and thereafter, based upon the public hearing and a discussion of the factors to consider in rezoning, voted to approve said zone change. WHEREAS, more than 14 days has elapsed since said public hearing and no protest petition has been filed with the Bel Aire City Clerk. WHEREAS, the Governing Body of the City of Bel Aire, Kansas hereby finds and determines that said zone change should be approved. 1 NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: Section 1. Zone Change The official zoning classification of the property hereinafter described is hereby changed from the zoning classification of "R-1" Suburban Residential to the zoning classification of "LC" Light Commercial. Said property is legally described as follows: In the Northwest Quarter of Section 30, Township 26 South, Range 2 East of the 6th P.M., the West 275 feet of said Northwest Quarter lying South of and adjacent to the Bel Aire East Addition to Sedgwick County, Kansas and lying North of and adjacent to Danbury Street as dedicated on Film 218, Page 71, except the West 50.00 feet. Said tract of land containing 3.4 acres more or less. Section 2. Zoning Map Amendment The official zoning map of the city of Bel Aire, Kansas is hereby amended in accordance with Section 1 of this ordinance. Section 3. Effective Date This Ordinance shall take effect and be in force from and after its publication in the official city newspaper.
