HomeMy Public PortalAboutResolutions-2024-021RESOLUTION NO. 2024-021 A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING FOR ADDITIONAL LANGUAGE TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF TIFFIN, IOWA AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES AS IT PERTAINS TO SPECIAL QUALIFICATION PAY FOR CONSTRUCTION INSPECTOR CERTIFICATIONS Whereas, the City Council of the City of Tiffin, Iowa ("City") entered into a contract agreement with the American Federation of State, County and Municipal Employees Council 61 ("AFSCME") acting on behalf of the City employees; and, Whereas, AFSCME has requested a language change to the current agreement as it pertains to the special qualifications pay section to add certain amounts for construction inspector certifications; and, Whereas, the City of Tiffin has reviewed and considered the request and the attached change, Now, therefore be it resolved by the City Council of the City of Tiffin, Iowa to approve the Memorandum of Understanding for additional language to the Collective Bargaining Agreement Between the City of Tiffin and American Federation of State, County and Municipal Employees as it pertains special qualifications pay for construction inspector certifications and to authorize the Mayor to sign and City Clerk to attest said agreement, which is attached hereto and made a part of this resolution. On the 2nd day of April, 2024, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Limkemann introduced RESOLUTION NO. 2024-021, A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING FOR ADDITIONAL LANGUAGE TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF TIFFIN, IOWA AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES AS IT PERTAINS TO SPECIAL QUALIFICATION PAY FOR CONSTRUCTION INSPECTOR CERTIFICATIONS and made a motion for approval. Motion seconded by Councilperson Orris. Ayes: Orris, Olney, Schnedler, Limkemann, Havens. Nays: None. Absent: None. Whereupon five Council members were present and voted approval and Mayor Kasparek declared that the RESOLUTION NO. 2024-021, A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING FOR ADDITIONAL LANGUAGE TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF TIFFIN, IOWA AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES AS IT PERTAINS TO SPECIAL QUALIFICATION PAY FOR CONSTRUCTION INSPECTOR CERTIFICATIONS to be adopted and signified his approval of the same by affixing his signature thereto. Should an employee resign or be terminated for just cause within the three years of receiving a certification or license, the employee will reimburse the City for the training expenses incurred per the following schedule: a. One year or less following the completion of the training or the certification or license - 100% b. More than one year .but less than two years - 66.67% c. More than two years but less than three years - 33.33% ARTICLE XIX MISCELLANEOUS AND SIGNATURES 19.1 - Savings Clause If any provision of this Agreement or any application of this Agreement to any employee or group of employees is held to be contrary to law, then such provision or application shall not be deemed valid and subsisting. All other provisions and applications shall continue in full force and effect. 19.2 - Notices Wherever any notice is required to be given by either of the parties to this Agreement to the other, pursuant to the provisions of this Agreement, either party shall be so by letter, postage pre -paid, United States. Employees shall be responsible for providing and maintaining their current address to the City. 19.3 - Duration of Agreement This Agreement shall be effective as of July 1, 2023, and shall continue in effect until June 30, 2028. 19.4 - Finality The parties acknowledge that during the negotiations which resulted in this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject not removed by applicable law from the ORIGINAL 19
