ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM,
FLORIDA ON THURSDAY, JULY 26, 2018 AT 8:30 A.M.,IN THE WILLIAM F. KOCH,
JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM,
FLORIDA.
I. Call to Order.

III. Minutes of the Regular Meeting and Public Hearing of 6-28-18.
Mr. Roach moved and Vice Chairman Murphy seconded the motion to
approve the Minutes of the meeting of June 28, 2018 as submitted and all
voted AYE at the roll call.
IV. Additions, withdrawals, deferrals, arrangement of agenda items.
There were no changes to the agenda.
V. Announcements.

Mr. Roach said he will not be available for the September
meeting and Mrs. Smith said she would not be available for the December
meeting. Chairman Smith suggested that since the December meeting is so
close to Christmas, there is a possibility that that date may be changed
and that the November meeting falls on Thanksgiving and that will be
changed, most likely to the Thursday before Thanksgiving.
VI. PUBLIC HEARING.
A. Declaration of Ex -Parte Communication
There was no Ex -Parte Communication declared.
B. Administer Oaths
The Town Clerk administered the Oath to Richard Jones, Dave
Bodker, Rustem Kupi, Fredy Polania and Sebastian Martinez-Villalba.
C. Applications for Development Approval
1. An application submitted by Seaside Builders, LLC,

as Agent for William Souder the owner of
property located at 520 Middle Road, Gulf Stream,
Florida, which is legally described as Plat of Gulf Stream
Cove Lot 19 and Lot 20 less tract described in metes and
Bounds in OR1062 P302.
Richard Jones, Architect and Agent for this application
explained that this is a Georgian style of architecture and that the
interior will be completely redone. He said that all doors and windows
are being replaced with the exception of the three at the front
entrance, the roof will be a grey flat cement tile and a loggia is to be
added with a bar-b-que and outdoor entertaining area.
Dave Bodker, Landscape Architect, explained that the drawings represent
a complete redesign of the landscaping and that they are planting trees
between the windows on the front and changing the driveway. He explained
in detail the other changes which include screening the property from
the streets and the neighboring property with landscaping material and a
number of different species of trees. Mr. Bodker said they will be
placing a spa inside the existing pool and totally redoing the pool deck
with a shell rock material that has a small amount of gray to blend with
the grey, square pavers in the driveway and gray roof.
In answer to a question from Chairman Smith Mr. Jones said the new roof
over the loggia would not be higher than the existing roof on the house.
The Town Clerk advised that there has been no comment from the
neighbors.
a. LEVEL II ARCHITECTURAL SITE PLAN REVIEW to permit the
addition of 1,165 sq. ft. to the existing Georgian style
single story, single family dwelling and addition of a spa
in the existing swimming pool.
Vice Chairman Murphy moved to approve a Level 2
Architectural/Site Plan to permit the addition of 1,165 sq. ft. to the
existing Georgian Style single story, single family dwelling and
addition of a spa to the existing swimming pool. The motion was seconded
by Mr. Roach and all voted AYE at the roll call.
2. An application submitted by Rustem Kupi, Architect, as
agent for Michael Cannizzaro, owner of property located at
3112 Gulf Stream Road, Gulf Stream, Florida 33483, legally
described as Lot 20, Gulf Stream Properties.
Mr. Kupi explained that this is a small lot and the house
will be a 4,639 sq. ft. Bermuda/British Colonial two story home with
attached garage, swimming pool and pool cabana that meets all code
requirements. He said the roof will be white flat cement tile and
presented two choices for the color of the shutters, taffeta
green and Orioles (orange), the owners choice.
The Board members said the orange color was very bright and they felt
that when this is on a long shutter it will look even brighter. No
approval of shutter color was given and the Board asked that a board

the size of a shutter be brought back with the orange paint in place
for their consideration and Mr. Kupi said he would be glad to do so.
Mr. Bodker presented his drawings and called attention to a 2'
retaining wall along the front, framing two parking spaces, and a 4'
privacy wall in the front yard with a 4' black aluminum picket
fence around the other 3 sides of the property. He added that all walls
and fences will be screened with landscape material. A sample of the
driveway and pool deck materials were circulated and approved.
a. DEMOLITION PERMIT to demolish existing buildings.
Vice Chairman Murphy moved to recommend approval to
demolish the existing building and Mrs. Smith seconded the motion with
all voting AYE.
b. LAND CLEARING PERMIT to clear lot to prepare for
construction.
Vice Chairman Murphy then moved to recommend approval
of clearing the lot to prepare for construction. Mrs. Smith seconded
the motion and all voted AYE.
C. SPECIAL EXCEPTION to permit 162 sq. ft. over maximum
permitted FAR.
A motion was made by Vice Chairman Murphy to
recommend approval of a special exception to permit the construction of
an additional 162 sq. ft. which exceeds the maximum permitted Floor Area
Ratio that was seconded by Mrs. Smith with all voting AYE.
d. LEVEL III ARCHITECTURAL/SITE PLAN REVIEW to permit
construction of 4,639 sq. ft. two-story, single family
Bermuda/British Colonial architectural style home with
attached garage, pool and pool cabana.
Vice Chairman Murphy then moved to recommend approval
of a Level 3 Architectural/Site Plan based on a finding that the
proposed construction of a Bermuda/British Colonial style, two-story,
single family dwelling with attached garage consisting of 4,639 sq. ft.
with a swimming pool and pool cabana meet the minimum intent of the
Design Manual and applicable review standards with the following
conditions: 1)Prior to the issuance of a Certificate of Occupancy, the
owner of the property shall prepare and record a deed restriction which
shall provide that all roof projection areas shall remain unenclosed as
per approval of the Special Exception for as long as the structure is
in existence or exceeds the maximum FAR. 2) Any minor modifications in
the existing landscaping shall be submitted to the Town Manager for
review and approval and any major modifications shall be brought back
to the ARPB for review and approval, prior to commencement of
landscaping. 3) Prior to shutters being installed, a full scale example
showing each color, shall be presented and available to the Board. 4)
The fence on the south side shall be moved back to a distance of 7.5
ft. from the edge of the pavement on Middle Road. The motion was
seconded by Mrs. Smith and all voted AYE at the roll call.
3. An application submitted by Dave Bodker Landscape
Architecture/Planning, Inc. as agent for Douglas Bowring,
owner of property located at 998 Pelican Lane, Gulf

Stream, Florida 33483, legally described as the north
79.40 ft. of the east 133 ft. of Lot 25, Model Land
Company's Subdivision in Sec. 9, Township 46 South, Range
43 East.
Dave Bodker, Landscape Architect, explained that this
property is located on the corner of Andrews Avenue and Pelican Lane and
the south property line is the boundry line between Gulf Stream and
Delray Beach. He said the owners want to install a swimming pool and
Deck, a white wooden picket fence on two sides of the property and
Aluminum rail along the other two sides with all of the fencing to be
screened with landscape material. He added they will be adding two
driveways on to the property and all new landscaping on the property.

installation of a pool, hardscape and all new
landscaping with fencing on the property.
Mr. Roach moved to approve a Level 2
Architectural/Site Plan to permit the installation of a pool, hardscape,
fencing and all new landscaping on the property and Mrs. Smith seconded
the motion with all voting AYE.
D. Items Related to Previous Approvals.
1. An application submitted by Fredy Polania, Randall Stofft
Architects, as agent for Scott & Beata Galloway, owners of
property located at 1535 N. Ocean Blvd., Gulf Stream,
Florida 33483, legally described as a Portion of the N.
100' of the S. 168' of Govt. Lot 1 of Section 10, Township
46 South, Range 43 East, Palm Beach County, Florida lying
east of the easterly right-of-way line of Ocean Blvd.
Mr. Polania reminded that the original poject at this
address had been approved and that it had included an enclosed stairway
to the second floor over the garage. He said that at the time they were
applying for the building permit the owner decided that the enclosed
staircase was too claustrophobic and they redesigned the entrance to an
open staircase. He then presented a drawing showing the enclosed
stairway and the open stairway with the hip and enclosure removed and an
awning added over the door.
Town Manager Dunham added that the original drawings for the second
floor addition over the garage showed this area was to be finished as
a guest suite and now is being shown as a storage area.
Mr. Polania said the owners have decided they need more storage space
and will use it for their art, etc. and it will not be air conditioned.
Vice Chairman Murphy suggested that, since this will only be a storage
area, perhaps it can be accessed thru a drop down stair in the garage.
Mr. Polania said they wanted to keep the garage area open for the cars.
The Town Clerk asked to have the south elevation displayed.

Mrs. Delafield asked if it's the front door that is being impeded with
the stairwell and Mr. Polania said yes, but there is no other place to
construct the stairs. He displayed a site plan to demonstrate this.
Chairman Smith asked if there was any Public Comment on this matter and
Sebastian Martinez-Villalba came forward and introduced himself,
advising that he is representing Leslie Alexander. He said they feel
they did not have proper notice as Mr. Alexander only received notice
two days previously even though it was postmarked July 17, 2018, 9 days
ago, but there is a 10 day requirement for notification. He said if this
is not postponed, his preference is that it be denied in that it does
not meet the quality of the neighborhood.
a. A REVISION OF A LEVEL II ARCHITECTURAL/SITE PLAN to
permit the previously approved enclosed stairway to
access the new second story addition over the garage
to be changed to an open, unenclosed stairway on the
south side of the garage.
Vice Chairman Murphy moved to deny the revised Level 2
Architectural/Site Plan based on a finding that the proposed
construction of an open, visible staircase does not meet the goal of
maintaining the consistency of neighborhood quality and character. The
motion was seconded by Mrs. Smith and all voted AYE at roll call.
