The Town Clerk administered the Oath to Daniel Mahoney, Scott
Bowling and Kenneth Herzog.
C. Items Related to Previous Approvals
1. A REVISION of the Landscaping previously approved for 960
Indigo Pt., legally described as Lot 70 and that part of
Lot 69, Place Au Soleil.
Scott Bowling, owner of Master Gardeners Nursery &
Landscaping, Inc. stated that the first drawing that was submitted was

a preliminary drawing and that the owners, during the construction of
the house, had decided on a number of changes to the plan.
The Town Manager explained that what has been referred to as a
preliminary plan is actually the plan that was approved by the ARPB and
the Town Commission and there is NO preliminary plan. He asked that the
copy of the approved plan from the Town Files be displayed along with a
copy of the REVISED PLAN and that each change that is being requested
be individually pointed out. Nearly all of the!tree varieties were
changed and a number of additional trees added.
At the request of Mr. Dunham, Mr. Bowling:reported that the very tall
ficus hedge was shown to be removed on th6.,original approved plan. He
said it has been decided to keep this.R�t'all hedge as it screens the
second floor of the new home and it, would e several years before a new
hedge would reach this height. Hedded that the existing ficus is a
variety that does not attract th�-white-fly and they have.trimmed and
fertilized the entire hedge on both` idesEy.,Mr. Bowling sai the
understood the neighbor had concerns with tie and to the rdots from the
hedge in his drain field but the neigAor ha`s the same type of hedge
planted on his side of th.e\property line'and there is usually a root
barrier installed along ;the ,,side of the dra<n fields to prevent
intrusion.

Mrs. Smith asked if""'the pavers on the property(wll be the same as were
approved on the/original,.design:,Mr. Bowling assured they are the same

Chairman..Smith commented that,�he finds the changes and the plants to be
beautiful but when plans are approved.by both boards it is expected
that ;Vhen the matezial a�gtually gees installed it will somewhat
resemble..what was approved:. He observed that it appears that what is
being considered today star`tedyfrom scratch and asked Mr. Bowling if he
had considered this at,.all.
Mr. Bowling apologized 4nd said it was his fault, that there was a
timing problem with delivery of the material.
Chairman Smith then asked if there had been any communication from the
neighbors to which the Town Clerk replied that the neighbor next door,
who is still up north, has asked that her comments be read into the
record at this hearing. A copy of Mrs. Glovsky's comments is attached
and made a part of this record. In summary, Mrs. Glovsky is requesting
that the large ficus hedge be removed as was shown on the original plan
and as has been recommended by the septic tank contractor.
It was noted that if the tall hedge were to be removed, the second
story would be exposed. Mr. Nazzaro reminded that there is a section in
the Code that requires second stories to be screened to protect the

privacy of the neighbors.
Town Manager Dunham advised that the revised plan had been sent back to
the civil engineer to re-evaluate the water retention and a revised
drawing and a letter from the engineer is on file that shows this plan
does meet the retention requirements.
Mrs. Smith moved to approve the revised landscape plan with the
conditions that any minor modifications to the/landscape plan shall be
submitted to the Town Manager for review and/pproval and any major
modifications shall be brought back to th ARPB forreview prior to
commencement of any landscaping. Mrs. DelL l�dtiseconded the motion and
all voted AYE at the roll call. �a

This is to advise and give permission to Rita Taylor, Town Clerk of Gulfstream, to read our statement and results at
the review hearing on Thursday, September 27, 2018, for the revised landscape plan of Ken Herzog.
The Herzog property have ficus trees that have compromised our septic system. We have submitted a letter from the
Raider Rooter company detailing the inspection as well as videos and pictures taken with their camera equipment. We
now will be replacing our septic system because of age and because of ficus root issues.
We need the ficus removed as was included in the original landscaping plan. Going forward we have no problems
with their landscape plan as regards to choice of trees, bushes, etc as long as the ficus between our properties are
removed.
We look forward to the Herzog property finally reaching completion and having them as neighbors.
