HomeMy Public PortalAboutr 12-057No. 12 Date of Adoption Mbrc1 22 2M RESOLUTION AUTHORIZING A PROFESSIONAL ENGINEERING SERVICES CONTRACT WITH T &M ASSOCIATES — REMEDIAL I POST EXCAVATION ACTIVITIES AT CIVIC CENTER PARK WHEREAS, the Borough of Carteret is in need of specialized engineering services with regard to the remedial/post excavation activities at Civic Center Park; and WHEREAS, the Borough's Consulting Engineers, T &M Associates, possess the requisite skill and expertise to provide said services; and WHEREAS, T &M Associates has submitted a proposal to provide said engineering services at a total cost not to exceed $26,950.00; and WHEREAS, the Mayor and Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that fiords are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from T &M Associates for engineering services related to tine remedial/post excavation activities at Civic Center Park at a total cost not to exceed $26,950.00 at the rate set forth in T & M's existing contract with the Borough is hereby approved. 2. Annexed hereto is a copy of said proposal. 3. This action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. Director of Engineering Borough of Carteret 61 Cooke Avenue Carteret, New Jersey 07008 Re: RAR, Deed Notice, and LSRP Services Remedial/Post Excavation Activities Civic Center Park Dear Mr. DuPont: As you know, past environmental investigations at Civic Center Park delineated contaminants within a former ball fields. Investigations revealed an isolated area of a PCB contamination with a concentration above the New Jersey Department of Environmental Protection Residential Direct Contact Soil Remediation Standards (RDCSRS). The area of elevated concentration was within the southern portion of the former playing fields. As previously discussed this area was excavated and remediated to remove the contamination. In addition, the presence of historic fill throughout the site required the filing of a draft Deed of Environmental Restriction (DER) with the NJDEP. Promulgation of the Site Remediation Reform Act (SRRA) requires the Borough to retain a Licensed Site Remediation Profession (LSRP) to proceed with remediation as outlined in correspondence from the Department dated 614!2011, and detailed in email correspondence dated 10/20/2008 from the previous Green Acres case manager. T &M proposes the following scope of services to address these requirements: Scope of Services Task No. 1: Receptor Evaluation and Baseline Ecological Evaluation A Receptor Evaluation (RE) is required for all sites undergoing multiphase remediation. The RE inventories land use and sensitive receptors within the vicinity of the site. The RE will include a Baseline Ecological Evaluation (BEE), which must be prepared according to the guidelines presented in'NJAC 7:26E, the "Technical Requirements for Site Remediation" (specifically 7:26E- 3.11). This will require a site visit and evaluation of potential pathways for the historic fill to migrate off site. Thereafter, a BEE will be written to fulfill the NJDEP's requirements found in the TRSR. While this deadline has passed, the DEP is currents in a compliance assistance mode and has been foregoing enforcement action in most cases Task No. 2: Deed Notice As required by the NJDEP, the draft Deed Notice will be supplemented to include a formal metes and bounds description of the historic fill area; a restricted area base map of the engineering controls; and descriptions of the specific layers of the engineering controls. This task is also inclusive of a metes and bounds description and basemap required for the deed restriction submission. This task does not include a property boundary survey, which is not required. Task No, 3: Supplemental Ground Water Remedial Investigation The April 9, 2010 revision to N.J.A.C. 7:27E, the Technical Requirements For Site Remediation (TRSR) requires a ground water investigation for sites where historic fill is located within the seasonal high water table. One temporary monitoring well will be installed by hollow stem auger methods within the historic fill in the assumed down gradient direction. One sample and quality control blank will be collected and analyzed for Target Analyte List/Target Compound List, pH, Ammonia, Nitrate, Total Dissolved Solids, and conductivity. The temporary well location will be located using GPS survey equipment and plotted on a base map. If ground water is contaminated, NJDEP will establish a Classification Exception Area for the site. Task No. 4: Supplemental Remedial Investigation/Remedial Action Report As required, we will incorporate all RJR data; summarize all site investigations (maps and data summaries); and all pre- and post remedial data figures and tables into one comprehensive report. Task No. 5: Project ManagemenVLSRP Services SRRA established multiple forms and submission requirements that must be certified by an LSRP and the Borough.. This task also includes project management over the course of the project. Fees` NJDEP and Deed Notice filing fees will be the responsibility of the Borough of Carteret. `l ASSOCIATES Le: Borough of Carteret CART -01383 Attn: Mr. John DuPont, P.E. November 15, 2011 Revised December 12, 2011 Page 3 Re: Baseline Ecological Evaluation, RAP, &Deed Notice Remedial/Post Excavation Activities Borough of Carteret, Middlesex County, NJ Schedule We will schedule work immediately upon receipt of written authorization and anticipate completing the required tasks within 60 days, weather permitting. Limitations Should contaminants not indicative of historic fill be detected during the remedial investigation, additional ground water investigation may be required. Our scope of services does not address additional investigation effort. Carteret Borough will be responsible for NJDEP fees. Our estimated drilling cost is based on the following assumptions/conditious: I . All drilling locations will be readily accessible to rubber tired truck mounted equipment. 3. Drilling is to be performed in soils by Direct Push or Hollow Stem Auger (HSA) drilling methods. False starts due to encountering rubble /debris or obstructions or voids shall be charged in accordance with indicated drilling rates. 4. All drilling and sampling may be performed at no higher level of personnel safety than Level D. If Level C needs to be incorporated, a charge of $75.00 per crew hour will be assessed. 5. T &M assumes a source of potable water is available at the jobsite. We have not addressed any costs associated with obtaining water from the local water company or M.U.A. 6. No loss of productivity due to delays caused by others. Standby time will be assessed in accordance with indicated drilling rates. 7. Investigative derived wastes (IDW), (drill cuttings and fluids) will be discharged or stockpiled at each drilling location. Should IDW need to be relocated on -site, the removal of such will be charged @ $250.00 per hour. Additionally, if 55- gallon drums are required to contain IDW, ECDI will supply the drums and labor to fill each drum @ $60.00 per drum. 8. (Name) or owner will be responsible for locating drilling locations and ensuring that drilling will not encounter buried tip 'vale utilities and piping. ECDI will contact New Jersey One Call System for public utility markouts. 9. Estimated costs are based on labor rates and costs of materials in effect for a period of 90 days from the date of this proposal. Payment term are net 45 days from the date of our invoice.
