CALL TO ORDER: Pursuant to the Agenda posted March 31, 1994, Mayor Manning called the meeting of the City Council to order at 7:30 p.m. on Tuesday, April 5, 1994. 2. ROLL CALL: PRESENT: Councilmember- McGowan, Wilson, Budds and Manning ABSENT: Councilmember- Breazeal ALSO PRESENT: City Manager Ovrom, City Attorney Martin, Public Services Director Hart, Community Development Director Dawson, Community Services Director Chadwick, Economic Development Director Sims, Assistant to the City Manager Kravitz, Financial Services Director Maldonado and Administrative Assistant Carroll Mayor Pro Tem Budds moved to excuse Councilmember Breazeal for cause, seconded by Councilmember McGowan and unanimously carried. 3. The invocation was given by Reverend Michael McKinney, 5221 El Monte Avenue, Temple City. 4. The Pledge of Allegiance to the Flag was led by Community Services Commissioner Harry Crump. Mayor Pro Tem Budds presented a city pin to Reverend McKinney. Al Lehine, Lions Club of Temple City, presented a $300 donation to the City Council in support of the City's Easter Egg Hunt. Captain Mirabella introduced Temple Station Reserve Deputy of the Year, Sergeant John Pespisa. Sergeant Pespisa presented a certificate of appreciation to the City Council for their support of the "Driving Under the Influence" Checkpoint Program and the Reserve Program. Mayor Manning presented a proclamation to John Clough, Independent Order to Foresters, proclaiming April 17 -24, 1994 as Prevention of Child Abuse Week. Mayor Manning presented a proclamation to the Temple City High School Key Club proclaiming April 19, 1994 National Youth Service Day. Mayor Manning presented a proclamation to Administrative Assistant Robert Carroll proclaiming April 1994 as Earthquake Preparedness Month. Administrative Assistant Carroll invited everyone to attend a Home Preparedness Seminar on April 23, 1994, 10 am. to 2 p.m. at Memoli Hall. City Council Minutes April 5, 1994 Page 2 Mayor Manning presented a proclamation to City employees Bonnie Pettis and Bob Branson proclaiming May 2 -8, 1994 as Public Service Recognition Week. Mayor Manning presented a certificate of recognition to Lawrence Bigelow honoring him as the Outstanding Older American for 1994. 5. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Howard Spiegel, 1119 West Merced Avenue, West Covina, said a tree at 4832 Glickman Avenue is causing problems with the sewer line and is beginning to crack the sidewalk. He said City staff determined the tree should not be removed. The opinion of a tree contractor was that the tree would eventually need to be removed. He requested the Council approve the removal of the tree. Mayor Manning said the Council would research the request. Marianne Milch, Chamber of Commerce, said a dinner was held honoring 125 Sheriff Department volunteers. In 1993 46,600 hours were volunteered by uniformed reserves, posse, Sierra Madre Rescue Team and ham radio operators. The next Chamber of Commerce Mixer will be on April 27 at the Alternative Learning Center on Pentland Avenue. The ten Miss Temple City contestants will be introduced. 6. CONSENT CALENDAR: Mayor Manning removed Item 6.G. Mayor Pro Tem Budds moved to approve the remainder of the Consent Calendar as presented, seconded by Councilmember Wilson and unanimously carried. A. APPROVAL OF MINUTES - 1) Regular meeting of March 15, 1994 2) Special meeting of March 15, 1994 3) Special meeting of February 28, 1994 Approved the Minutes from the regular meeting of March 15, 1994, special meeting of March 15, 1994 and special meeting of February 28, 1994, as submitted. B. ACCEPTANCE OF WORK ANNUAL PREVENTIVE ROAD MAINTENANCE PROJECT (NO. 94 -2) GRAHAM CONTRACTORS, INC. - Accepted work performed by Graham Contractor, Inc. and authorized City Clerk to file the applicable notice of completion; approved final payment to Graham Contractors, Inc. in the amount of $16,770.26; and authorized release of the 10 percent retention following the 35 -day lien period. C. ACCEPTANCE OF ROAD IIVIPROVEMENTS FOR 6045 GOLDEN WEST AVENUE (PARCEL MAP NO. 21570) - Accepted road improvements as approved by the Los Angeles County Public Works Department and released the security deposit (Letter of Credit No. FES203084) in the amount of $13,950. D. REVISED 20TH YEAR CDBG ALLOCATION AND EXCHANGE AGREEMENTS WITH PARTICIPATING CITIES FOR FISCAL YEAR 1994 -95 - Approved and authorized the Mayor to sign exchange agreements; approved revised cost summary; and approved reimbursable contract and authorized Mayor to sign agreement. 1 1 1 1 1 City Council Minutes April 5, 1994 Page 3 E. ACCEPTANCE OF PROPOSAL FOR CODE REVIEW SERVICES BY BOOK PUBLISHING COMPANY - Accepted Proposal for Code Review Services in the amount of $1,800 and authorized the Mayor to sign acceptance of proposal. F. TEMPORARY BANNER PERMIT: AMERICAN YOUTH SOCCER ORGANIZATION - Approved banner permit, subject to the required Certificate of Insurance. H. PLANNING COMMISSION ACTIONS - MEETING OF MARCH 22, 1994 Received and filed. I. LEGISLATIVE REPORT - Approved the legislative report. J. RESOLUTION NO. 94 -3320: APPROVAL OF PAYMENT OF BILLS - Adopted Resolution No. 94 -3320 allowing claims and demands in the amount of $329,485.41. G. APPROVAL OF AGREEMENT RE: FEDERAL AND COUNTY TRANSPORTATION FUNDS - Background information was not provided. No action was taken. 7. UNFINISHED BUSINESS: NONE 8. NEW BUSINESS: A. PUBLIC HEARING: COMPLIANCE WITH THE CONGESTION MANAGEMENT PROGRAM Community Development Director Dawson presented the background information as outlined in the staff report dated April 5, 1994. Mayor Manning declared the public hearing open and invited those wishing to speak on this matter to come forward at this time. As there was no one else wishing to speak on this matter, Mayor Pro Tem Budds moved to close the public hearing, seconded by Councilmember Wilson and unanimously carried. Councilmember Wilson moved to adopt Resolution No. 94 -3321, A RESOLUTION OF THE CITY OF TEMPLE CITY, CALIFORNIA, FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089, seconded by Mayor Pro Tem Budds and unanimously carried. B. LEAF BLOWERS - CITY WIDE Community Development Director Dawson presented the background information as outlined in the staff report dated April 5, 1994. City Council Minutes April 5, 1994 Page 4 Mayor Pro Tem Budds noted the code enforcement officer works Monday through Friday. Most yard work is done after work and on weekends. Enforcement would become the responsibility of the Sheriff's Department. He did not feel one piece of equipment should be singled out and asked how many noise and dust complaints are received. Mayor Manning asked what are normal construction hours. Director Dawson said approximately one or two complaints are received a week. Normal construction hours are between 7 a.m. to 10 p.m. Mayor Pro Tem Budds moved to receive and file the report, seconded by Councilmember McGowan and unanimously carried. 9. COMMUNICATIONS: NONE 10. RECESS TO CRA: At 8:20 p.m., the City Council met as the Temple City Community Redevelopment Agency; approved the Minutes of the regular meeting of March 15, 1994, special meeting of March 15, 1994 and special meeting of February 28, 1994; re- authorized the Executive Director to execute and record a Quitclaim Deed transferring ownership to the successor in interest; and adopted Resolution No. CRA 94 -539 allowing claims and demands in the amount of $3,763.24. Minutes of the Agency are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL: 11. ACTION ON REQUEST BY CRA: NONE 12. ADDITIONAL ORAL COMMUNICATIONS FROM THE AUDIENCE: NONE 13. MATTERS FROM CITY OFFICIALS: A. Mayor Pro Tem Budds complimented City Attorney Martin on his assistance given to the Live Oak Park Subcommittee and the Downtown Anchor Project. B. Councilmember McGowan said she received a letter from Margaret Clark of Rosemead asking for the Council's support at the League Election for Treasurer. The Council concurred with supporting Margaret Clark for League Treasurer. Mayor Manning asked if the Council wished to continue supporting Nel Soto for the League AQMD Board. ADJOURNMENT: At 8:25 p.m., it was moved, seconded and unanimously carried to adjourn in memory of Mayor Manning's Grandmother Dorothy Akers and City Manager Ovrom's Grandmother Edith Parker.
