WHEREAS, the City known as the Town of Watertown is in need of a location for
Anthony Palumbo, parking and open space purposes to serve the needs of its citizens; and
Councilor At Large
Angeline B.Kounclis, WHEREAS,the property at 10 Winter Street has been determined to provide a
District A Councilor suitable site for parking and open space.

known as the Town of Watertown take by eminent domain, for parking and open

or less, as shown on a plan entitled"10 Winter Street Watertown, Massachusetts
Record Owner: McDermott-Watertown Nominee Trust," dated August 24, 2016,
said plan recorded herewith, and which is described in a deed recorded with the
Middlesex South District Registry of Deeds in Book 53348,Page 127, and an
Order of Taking of the Town Council, recorded herewith, and, further,to authorize
the Town Manager to record said Order of Taking, and; further,to appropriate the
sum of Seven Hundred Ninety-Six Thousand and 001100 Dollars ($796,000) from
utilization of free cash for said acquisition by eminent domain,and award said sum
as damages for the foregoing taking.

District A Councilor qualified, and acting as such on behalf of the City known as the Town of Watertown (the

A parcel of land known as 10 Winter Street, in Watertown, Massachusetts,
shown on a plan of land entitled"10 Winter Street Watertown,Massachusetts Record
Owner: McDermott-Watertown Nominee Trust,"dated August 24,2016,prepared by
McKenzie Engineering Group, Inc., recorded herewith,which parcel contains 3,782
square feet,more or less, and being that property described in a deed recorded with the
Middlesex South District Registry of Deeds in Book 53348, Page 127 (the"Property").
Said Property is owned or supposed to be owned by the following, hereinafter
collectively referred to as Owner.
Owner: Thomas J. Me Dermott and Marylouise Pallotta McDermott, Trustees of
the McDermott-Watertown Nominee Trust, a/d/t dated August 4, 2009
Mailing Address: 76 Lovell Road, Watertown, MA 02472
Property Address: 10 Winter Street,Watertown, Massachusetts
Interest Taken: Fee simple title
Title Reference: Middlesex South District Registry of Deeds,Book 53348,Page

If in any instance the name of the Owner is not correctly stated, it is understood
that in such instance the land referred to is owned by an owner or owners unknown to
its, and the fee interest in said Property belonging to an owner or owners unknown to us
is hereby taken.
The damages sustained by the supposed Owner listed above by reason of this
taking of the Property is valued and awarded in accordance with Massachusetts General
Laws Chapter 79, as amended. The amount awarded as damages to the Owner is set
forth in the attached Schedule A, and incorporated herein.
Any and all trees and structures located within the boundaries of the above-
described Property are included in this taking, Easements held by private utility
companies are not taken; and no betterments are to be assessed.
