AN ORDINANCE AMENDING CHAPTER 13, MOAB CITY CODE 1965, AS AMENDED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOAB, UTAH:
THAT Section 13-28 of the Ordinances of Moab City, 1965, as amended
be, and the same is, hereby amended by repealing the last sentence of said
section as follows:
"Sec. 13-28 "Transient Merchant" defined.
For the purposes of this article, a transient merchant is
hereby defined to be any person or agent, servant or employee of any person
who shall exhibit, sell or offer for sale, at wholesale or retail, any goods,
wares, merchandise or foodstuffs in or from any hotel, rooming house, dwelling
house, boarding house, store, storeroom, stall, tent, building, structure, stand,
railroad car, motor vehicle, or other place in the city, and who shall not occupy
such place for the purpose of conducting a permanent business therein: The per-
son so engaged shall not be relieved from the provisions of this chapter by reason
of association temporarily with any local dealer, trader, merchant or auctioneer
or by conducting such temporary or transient business in connection with or as
a part of or in the name of any local dealer, trader, merchant or auctioneer."
Said Secton shall now read as follows:
"Sec. 13-28 "Transient Merchant" defined.

wares, merchandise or foodstuffs in or from any hotel, rooming house, dwelling
house, boardinghouse, store, storeroom, stall, tent, building, structure, stand,
railroad car, motor vehicle, or other place in the city, and who shall not oc-
cupy such place for the purpose of conducting a permananent business therein.
THAT Section 13-30 of the Ordinances of Moab City, 1965, as amended,
ralating to Article III, "Transient Merchants" be, and the same is hereby
amended by the addition of the following:
"Sec. 13-30. Same - - Issuance and fee to be determined by City
Council
The issuance of the license and the amount of the license fee
for each transient merchant shall be determined by the city council at a
regular city council meeting following application for the license, according
to their discretion, and according to the type of business for which licensing
is requested."
Passed by the unanimous vote of all members present of the City Council
of the City of Moab, Utah this 17th day of August, 1976.
