Iglehart John G. Hart J. Phil Hoyle William S. LaPorte Richard F. Ward, Henry Lilienthal, Roy Cowart, H.S. Cole and Kathleen Kirton. Mayor Koch called the meeting to order. Mr. Iglehart moved that the minutes of the meeting held on October 10, 1969 be approved as written and the reading of these minutes be waived. Mr. LaPorte seconded the motion. Motion passed. Mr. LaPorte moved that the Financial Report for October, 1969 be approved as written and all expenses included in the report be approved. Mr. Hoyle seconded the motion, Motion passed. Mr. Cole, representing Oleander, Inc., requested approval for the issuance of a building permit for the Little Club to construct a utility building to house equipment used in the maintenance of the Par Three golf course. The building would be 40 feet by 32 feet and eight feet in height. The proposed location would be 20 feet West of the Oliver property and 20 feet North of the Phipps prop- erty. In discussion of the request, it was agreed that the build- ing would be attractively landscaped in order to conceal it from view as much as possible. Mr. Hart moved that the request be granted. Mr. LaPorte seconded the motion. Mr. Iglehart stated that he would abstain from voting on this matter since he knows both neighboring property owners and also is directly and financially interested in Oleander, Inc. Mr. Hoyle also abstained from voting. The motion carried with Mr. Hart, Mr. LaPorte and Mr. Koch in favor. A petition from Candelaria, Inc. was read requesting the abandonment of a portion of County Road right -of -way on the North end and to designate the remainder of County Road as a one -way road to the North. After discussion Mr. Hart moved that the request be passed on to the County Commission with the approval of the Town but that the access right -of -way from County Road to Highway AlA be 25 feet rather than the 20 feet as proposed in the petition. Mr. Hoyle seconded the motion. The motion was passed with Mr. Iglehart abstaining. Police reports for October were read. It was reported that the Town's trash truck had broken down last Fri- day and bids had been requested on a new truck for immediate replace- ment of the truck. A new truck had been included in the present bud- get and until one is secured a rental truck is in use to haul trash. Bids on a new truck were opened from the following: Adams Chevrolet, 1970 Chevrolet at $6406.35 less $1067.70 allowance for trade, net $5338.65. Jerry Earl Pontiac, 1969 GMC at $4990.00 less $550.00 trade, net $4440.00. Hauser Motor Co., 1969 Dodge at $4650.00 less $250.00 trade, net $4400.00. COMMISSION MEETING, November 14, 1969 Page 2 In comparing the bids with the specifications that had been listed on the bid requests it was pointed out that the Dodge did not meet the minimum specifications while the other two bids did meet or ex- ceed the specifications. Mr. Iglehart moved that the low bid meeting the specifications be accepted. Mir. LaPorte seconded the motion. Motion passed. Ordinance No. 69 -1, providing for the registration of felons, was read in full. Following discussion the ordinance was placed on first reading. Mr. Iglehart commented on garbage trucks blocking traffic and creating hazards as they back into driveways in the Town. The Police Chief was instructed to take care of the matter. Mr. Hart commented on the water situation in the Town and will look into the matter further. Mayor Koch reported that information should be received soon in regard to the fire contract. Mr. Lilienthal requested that he be authorized to represent the Town in the suit filed by the County Tax Assessor and County Tax Collector. He was so authorized by the Commission. There being no further business to come before the Commission, the meeting was adjourned. BE IT ORDAINED BY THE TOWN COMTSSION OF THE TOWN OF GULF STREAM, FLORIDA: Section 1. Definitions. For the purposes of this ordinance the term "Town" shall mean the Town of Gulf Stream, Florida. Section 2. Registration, fingerprinting and photo- graphing of persons convicted of felonies -- Required. Every person who, within the period of ten years immediately prior to his arrival in the Town of Gulf Stream, Florida, has been convicted in any federal court of any crime which is deemed, designated or specified to be a felony, accord- ing to the United States Criminal Code, or who, within the period of ten years immediately prior to his arrival in the Town, has been convicted of any crime in a court of any state of the United States, which crime is deemed, designated or specified to be a felony in the state in which such conviction occurred, or who, at any time within the period of ten years immediately prior to his arrival in the Town has been, follow- ing conviction for a felony, held in custody in any federal prison or in prison in any state of the United States, who comes into the Town from any point outside of the Town whether in transit through the Town or otherwise, shall report to the chief of police of the Town within seventy -two hours after his arrival within the Town and shall furnish to the chief of police, in a written statement, signed by such person, the true name of such person, and each other names or alias by which such person is or has been known, a full and complete description of himself, and the names of the crimes of which he shall have been convicted, together with the name of the place where each such crime was committed, the name under which he was convicted, and the date of the conviction therefor, the name if any, and the location of each prison, reformatory or other penal institution in which he shall have been confined as punishment therefor, together with the location or address of his residence, stopping place or living quarters in this Town and each one thereof, if more than one, or the address or location of his intended residence, stopping place or living quarters in this Town and each one thereof, with a description of the character of each such place, whether a hotel, apartment house, dwelling house or otherwise, giving the street number thereof, if any, or any description of the address or location thereof as will so identify the same as to make it possible of location, and the length of time for which he expects or intends to reside within the territorial boundaries of the Town. At any time of furnishing the informa- tion required herein, such person shall be photographed and fingerprinted by the chief of police, and such photograph and fingerprints shall be made a part of the permanent records of the police department of the Town. Section 3. Information as to change of address. In the event that any person required to register under this ordinance shall change his place of residence, stopping place or living quarters to any new or different place within the Town other than the place last reported to the chief of police in such report provided for in section 2 or 3 hereof, such person shall, within seventy -two hours after removing himself from the place of abode first given, notify the chief of police, in a written and signed statement of such change of address, and shall furnish in such written statement to the chief of police his new address. Section 4. Not required of pardoned or paroled persons. Nothing in the two preceding sections shall be deemed or construed to apply to any person who has or shall have re- ceived a pardon for each such crime whereof he shall have been convicted, or to any person who is or shall be on parole or pro- bation under the laws of any state wherein he was convicted or incarcerated or both, for any of the crimes hereinabove enumer- a tart book. Section 5. Access to and examination of registration No persons, except members of the police department and town commissioners of the Town shall have access to or be permitted to examine the registration book or affidavits herein- above mentioned. Section 6. Any person violatinq the provisions of this ordinance upon conviction thereof shall be fined in an amount not to exceed $100.00 for each offense, or imprisoned in the Town jail or worked at hard labor on the streets or other public works of the Town for a term of not more than one month, or punished by both such fine and imprisonment. Each day of violation shall constitute a separate offense. Section 7. This ordinance shall become effective immediately upon passage and proper posting according to the charter of the Town. Your Petitioner, CANDELARIA, INC., is the owner of certain properties lying both east and west of the right -of -way of County Road on its northern extremity. 2. The persons whose signatures appear on the attached list designated Exhibit "A" are the owners of property border- ing County Road from its inception at the intersection with Sea Road on the southern end to its termination with the intersection with Florida State Highway AlA on its northern end. 3. A Plat of the subject area indicating the location of County Road that is the subject of this Petition and the location of the various property owners who border the County Road is attached hereto and marked Exhibit "B" 4. A portion of the above described property, and County Road, are located within the corporate limits of the Town of Gulfstream. 5. Your Petitioner, CANDELARIA, INC., is desirous of having County Road deviated from its present location on the northern extremity in such a manner that it will inter- sect Florida State Road AlA approximately 362 feet south of the point wherein it now intersects State Road AlA. 6. Your Petitioner does hereby declare its willingness to dedicate a 20 foot right -of -way across the property now owned by it and lying between County Road and Florida State Road AlA for the purpose of providing the necessary access of County Road to Florida State Road AIA. The pro- posed right -of -way is indicated as a shaded area on the Plat designated as Exhibit "B ". On said Plat a 27 foot buffer zone has been allowed to protect the property owner directly to the south of the 20 foot right -of -way. 7. The property owners who border County Road both on the east and the west, and whose signatures appear in Exhibit "A ", are desirous of having County Road designated a "one -way" street, with traffic flowing from south to north only. It is noted by these property owners that County Road has but a 20 foot right -of -way, and two -way traffic on the said County Road is not only difficult but at times hazardous. NOW, THEREFORE, your Petitioner, CANDELARIA, INC., requests that the Town Councilors of the Town of Gulfstream further sub- mit this Petition to the County Commissioners for the County of Palm Beach and that the said Town Councilors request that the County Road right -of -way north of the north right -of -way line of the proposed 20 foot access right -of -way be abandoned; and that the said County Commissioners be requested to accept the pro- posed 20 foot access right -of -way in lieu thereof; and that the said County Commissioners be further requested to designate County Road to be a 'one -way" thoroughfare, with traffic flowing from the south to the north.
