CALL TO ORDER PLANNING COMMISSION MINUTES NOVEMBER 26, 2002 Pursuant to the Agenda posted November 22, 2002, Chairman Seibert called the meeting of the Planning Commission to order at 7:30 p.m. on Tuesday, November 26, 2002. 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ROLL CALL Present: Commissioners: Griffiths, Arrighi, Le Berthon and Seibert Absent: Commissioner: Capra Also Present: City Attorney Martin, Community Development Director Dawson, and Senior Planner Williams " Commissioner Arrighi moved to excuse Commissioner Capra for cause seconded by Commissioner Griffiths and unanimously carried. 4. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK 5. CONSENT CALENDAR A. APPROVAL OF MINUTES NOVEMBER 12, 2002 RECOMMENDATION: APPROVE AS SUBMITTED Commissioner Griffiths moved to approve the consent calendar seconded by Commissioner Arrighi and unanimously carried. 6. UNFINISHED BUSINESS: " Planning Commission November 26, 2002 Page 2 A. CONTINUED PUBLIC HEARING: REVISION OF THE DOWNTOWN SPECIFIC PLAN. WHILE THE BOUNDARIES OF THE EXISTING DOWNTOWN SPECIFIC PLAN AREA ARE NOT PROPOSED TO BE MODIFIED, THE SUB - AREAS, REFERRED TO AS COMMERCIAL DISTRICTS ARE PROPOSED TO BE FURTHER REFINED ALONG WITH APPLICABLE DEVELOPMENT CRITERIA AND MAINTENANCE STANDARDS. SPECIFICALLY, THE FOLLOWING ITEMS WILL BE CONSIDERED: 1. Re- designating three (3) commercial districts into six (6) commercial districts. 2. Revising the list of permitted uses, conditionally permitted uses and prohibited uses in each of the newly designated commercial districts. 3. Revising development criteria and standards for each of the proposed six (6) districts within the Downtown Specific Plan area. 4. Modifying and revising sign criteria for the Downtown Specific Plan area by district. 5. Establishing new maintenance criteria to identify and rectify various deteriorating building conditions within the Downtown Specific Plan area. 6. Miscellaneous amendments to the Downtown Specific Plan relative to conducting plan reviews for new construction, signage, remodels, facade improvements, etc. SITE: DOWNTOWN SPECIFIC PLAN AREA (Las Tunas Drive/Temple City Blvd Commercial Corridor) RECOMMENDATION: 1) HEAR STAFF REPORT 2) CONTINUE PUBLIC HEARING AND RECEIVE PUBLIC INPUT 3) DISCUSS VARIOUS COMPONENTS OF THE PLAN 4) ADOPT RESOLUTION N: \Word \Department \CDD \MINS \PC MINUTES 2002 \PC MINUTES NOVEMBER 26, 2002.doc " " Planning Commission November 26, 2002 Page 3 Director Dawson  read the Staff Report dated November 26, 2002. Chairman Seibert  asked if there were any questions Chairman Seibert - Opened the Public Hearing and asked if anyone wanted to speak about this matter. As no one came forward, the Chairman asked if there was a motion to close the Public Hearing. Commissioner Arrighi moved to close, seconded by Vice - Chairman Le Berthon and unanimously carried. Chairman Seibert  Closed the Public Hearing and began discussion. Commissioner Arrighi  Stated that the City has to take some action, however, he is not sure if what is being proposed will work. Can the City effectively say what use is the right use for any particular parcel? He is concerned that the approach may not result in a business friendly atmosphere. Stated that he personally does not see the Land Use Matrix as being business friendly and he could abstain from voting. Vice- Chairman Le Berthon  Asked if the Land Use Matrix were enacted, how long would it be viable. Commissioner Griffiths  Stated that it would be viable until it was changed. Vice - Chairman Le Berthon  Asked if someone would want to open a business where it is not permitted, would it be impossible to obtain a variance. City Attorney Martin  Stated, that they could not obtain a use variance Director Dawson  Stated that a business could apply to amend the Specific Plan. For example if someone wanted to open a pet shop and it was not allowed in that district, they could ask to have the Specific Plan amended. Vice - Chairman Le Berthon  Stated it seems that the Land Use Matrix does allow for some guidelines to shape the future of the City and there is usefulness there. Stated he could vote in favor of this revision. Commissioner Griffiths  Stated that this revision is an improvement over the existing document. Further stated that it does more than the previous version. Stated that there is someplace on Las Tunas for almost every type of business. Further stated that the problem with this is that it does not address the heart of the issue. It does not provide an implementation mechanism. The package is fine as it is being presented 41) and the Staff did an excellent job of further refining the existing document, however there is a definite need for stronger direction and more definitive action. Stated that he has no objection to approving the material, but it is not the total answer. Stated that he does not have any problem with the specifics of the revised document, but feels that more drastic measures need to be taken. Stated that at this time the Planning Commission must either recommend in favor or against the revised document. Commissioner Griffiths — Stated that he is in favor of approving the packet but wonders if there is a way for the Planning Commission to make a stronger statement about the importance of strengthening our business community. Chairman Seibert — Stated that the City Council sees what the Planning Commission sees but there are always political considerations. Commissioner Griffiths — made a motion to approve the Negative Declaration and adopt a Resolution recommending adoption of the Downtown Specific Plan revision, seconded by Vice - Chairman Le Berthon and unanimously carried. Chairman Seihedt — Stated that, hearing no objection the motion carries. Director Dawson — Stated that this matter is going to be heard by the City Council on December 3, 2002. 7. NEW BUSINESS: A. PUBLIC HEARING: A CONDITIONAL USE PERMIT TO ALLOW THE INSTALLATION OF SIX PANEL ANTENNAS ONTO AN EXISTING LIGHT STANDARD IN CONJUNCTION WITH AN ALREADY EXISTING WIRELESS FACILITY. THE PROPOSED PANEL ANTENNAS WOULD BE CO- LOCATING ON AN EXISTING LIGHT STANDARD THAT ALREADY CONTAINS ANTENNAS FROM ANOTHER WIRELESS CARRIER. THE LIGHT STANDARD IS LOCATED ON THE ATHLETIC FIELD AT TEMPLE CITY HIGH SCHOOL. THE HIGH SCHOOL IS DESIGNATED INSTITUTIONAL (I) ON THE CITY'S GENERAL PLAN. Senior Planner Williams  narrated the video of the subject site. Chairman Seihert  Asked if there were any questions of Staff and opened the Public Hearing. L emuel Hawkins, 5440 Trabuco Road, Irvine  Stated that he was the representative for Cingular Wireless, Inc. Spoke in favor of the project and was ready to answer any questions. Chairman Seihert  asked if anyone else wanted to speak in favor or opposition to the project. Commissioner Arrighi made a motion to close the Public Hearing, seconded by Vice - Chairman Le Berthon. Commissioner Griffiths  Stated that he had no objections to the request and could vote to approve the application. Vice - Chairman I e Berthon  Stated that he concurred. Commissioner Arrighi  Stated that he concurred. Chairman Seihert  Stated that he concurred. Chairman Seibert — Stated that there is a 15 -day appeal /review period. 8. COMMUNICATIONS: None 9. MATTERS FROM CITY OFFICIALS: Report to the Planning Commission of City Council action regarding a Zoning Code Amendment which would eliminate estate type fencing, clarify fence and wall height regulations in the front yard area and prohibit security gates for any residential project which has or will have guest parking. S;ity Attorney Martin — Stated that the Planning Commission has 40 days to comment on the City Council's action Commissioner Arrighi made a motion to not comment, seconded by Commissioner Griffiths and unanimously carried. 10.
