Rollcall: Mayor Philip Vandernail; Mayor Pro-Tem Eileen Waldow; Trustees; Andy Miller, Brian Cerkvenik, Katie Soles, Parnell Quinn and Ryan Barwick 2. Approval of Agenda: Trustee Soles moved, and Trustee Miller seconded the motion to approve the amended agenda, moving the Executive Session after discussion and possible action. Motion carried: 7-0. 3. Consent Agenda: a) Resolution 2021-04-02 Sanitary Sewer Maintenance and Repair b) Resolution 2021-04-03 Fraser Well Rehabilitation c) Resolution 2021-04-04 Kona Ice Facility Usage Permit and Indemnification Agreement Trustee Miller moved, and Trustee Waldow seconded the motion to approve the consent agenda. Motion carried: 7-0. 4. Discussion And Possible Action Regarding: a) Resolution 2021-04-01 Authorizing Nine Month Extension for Riverview Condominiums Trustee Soles moved, and Trustee Barwick seconded the motion to approve Resolution 2021-04-01 Authorizing Nine Month Extension for Riverview Condominiums. Motion carried: 6-0, Trustee Miller recused himself. c) Ordinance 482 Designate the Municipal Court to Hear All Alleged Violations of The Alcohol Beverage Code Page 2 of 3 Trustee Miller moved, and Trustee Cerkvenik seconded the motion to approve Ordinance 482 Designate the Municipal Court to Hear All Alleged Violations of The Alcohol Beverage Code. Motion carried: 5-2, Nay Quinn and Barwick d) Ordinance 483 Wildlife Protection and Enforcement Trustee Soles moved, and Trustee Miller seconded the motion to approve Ordinance 483 Wildlife Protection and Enforcement. Motion carried: 7-0 4. Executive Session: For a conference with the Town Attorney for the purpose of receiving legal advice on specific legal questions under C.R.S. Section 24-6-402(4)(b), and for the purpose of determining positions relative to matters that may be subject to negotiations, developing strategy for negotiations, and/or instructing negotiators, under C.R.S. Section 24-6- 402(4)(e), Regarding Project P and Project N Strategy Update. Including Interim Town Manager Wesley LaVanchy, Town Clerk Antoinette McVeigh, Finance Manager Beth Williams, Plant Superintendent Joe Fuqua, Water Attorney Gene Riordan Trustee Quinn moved, and Trustee Soles seconded the motion to open the Executive Session at 7:35 p.m. Motion carried: 7-0. Trustee Miller moved, and Trustee Waldow seconded the motion to close the Executive Session at 8:45 p.m. Motion carried: 7-0. Attorney's Opinion Required by C.R.S. 24-6-402(2)(d.5)(II)(B). As the attorney representing the Town of Fraser, I am of the opinion that the entire executive session, which was not recorded, constituted a privileged attorney-client communication. qv/at__ Gene Riordan, Water Attorney Resolution 2021-04-05 Public Contract for Services with Merrick & Company Trustee Barwick moved, and Trustee Quinn seconded the motion to approve Resolution 2021-04-05 Public Contract for Services with Merrick & Company. Motion carried: 7-0 6. Open Forum: a) Mark, Will the Board vote on the Trustee appointment tonight?, The vote will take place on April 21. What is going on with the Conservation Easement discussions? The Town is in discussion with attorneys. 7. Updates: a) Fraser Valley Parkway/CR 521, Wes the Grand County Board of Commissioners are moving forward with the cultural assessment that is required before requesting to extended the 404-wetland permit. Page 3 of 3 b) Entertainment District-Antoinette due to the requirements of an entertainment district the downtown area is not suitable at this time. 8. Adjourn: Trustee Soles moved, and Trustee Miller seconded the motion to adjourn. Motion carried: 7-0. Meeting adjourned at 9:05 p.m. Antoinette McVeigh, Town Cle k
