A RESOLUTION OF THE VILLAGE COLINCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, CONFIRMING
A DECLARATION OF A STATE OF EMERGENCY DUE
TO HURRICANE DORIAN AND RELATED
EXPENDITURES; AND PROVIDING FOR AN EFT.ECTIVE
DATE.
WHEREAS, on August28,20l9, Hurricane Dorian was declared a major hurricane with
maximum sustained winds of 75 mph; and
WHEREAS, the National Hurricane Center forecasted that Hunicane Dorian would
continue to strengthen and make landfall in South Florida as a major hurricane; and
WHEREAS' Hurricane Dorian posed a severe threat to the entire State of Florida and
required timely precautions to be taken to protect communities, critical infrastructure, and
general welfare; and
WHEREAS, on August 28, 2019, Florida Governor Ron DeSantis issued Executive
Order No. 19-189 declaring a State of Emergency due to Hurricane Dorian, and on August 30,
2019, Miami-Dade County Mayor Carlos Gimenez issued a County-wide Declaration of a State
of Emergency; and
WHEREAS, on August 30, 2019, the Village Manager issued a Declaration of State of
Emergency due to Hurricane Dorian; and
WHEREAS, on September 2, 2019, the Viilage Manager terminated the State of
Emergency, as conditions causing the emergency no longer existed and the Village's agencies
and departments were able to manage the situation without extraordinary assistance; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW, THEREFORE, BE IT RESOLVED By THE VILLAGE COUNCIL OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That the above recitals are true and correct and
incorporated herein by this reference.
Section 2. Confirmation. That in accordance with Section 9-5 of the Village Code,
the Village Council hereby confirms the Village Manager's Declaration of State of Emergency
for the Village due to Hurricane Dorian and related expenditures as further provided in the
Village Manager's staff report supporting this Resolution.
Section 3. Effective Date. That this Resolution shall take effect immediately upon
adoption.
