HomeMy Public PortalAboutPRR 18-2674 Renee Basel From:Jonathan O'Boyle <jonathanroboyle@gmail.com> Sent:Friday, November 9, 2018 2:39 PM To:Trey Nazzaro; Renee Basel; OConnor, Joanne M.; Jonathan O'Boyle Subject:Public Records Request Underground Electric an Culver Smith Emails Good morning. This records request is being directed towards the custodian of records for the Town of Gulf Stream as required by statute. Counsel is being copied. I would like to make a request under Chapter 119 and the Florida Constitution. 1. I would like a certified copy of Emails from Town Engineer Brannon to William Ring dated March 31, 2014 at 4:20 pm with a subject line, "Hidden Harbour Drive - Gulf Stream - Underground Power." Specifically I would like certified copy of that entire chain of emails. 2. I would like a certified copy of all September 8, 2018 email exchanges between Culver Smith and Robert Sweetapple. 3. I would also like to inspect the surveys, plans, and (as built) plans for the underground electric project. Specifically I would like the portion that covers Hidden Harbour Estates and the next development to the North if the surveys are broken into sections. I do not need the entire survey for the Town but if that is the only record available I will take it. For clarification, I am looking for documents which show where the Underground electric project was planned on being built and where it was actually build. Thank you very much. Let me know when I can swing by to inspect and/or pick up the certified copies -- Jonathan O’Boyle, Esq., LLM. Dear Jonathan O’Boyle [e-mail to: jonathanroboyle@gmail.com]: The Town of Gulf Stream has received your public records request dated November 9, 2018. The original public records request can be found at the following link: http://www2.gulf-stream.org/weblink/0/doc/121232/Page1.aspx With respect to part one of your request, we respectfully request clarification as to the date, time and subject line of the e-mail record you seek. The Town’s contractor in possession of these records has a chain of e-mails with the subject lines “Underground Project – Gulf Stream” that is the date you are searching for but not the time. This record is being provided in its original electronic format. The Town notes that William Ring formerly worked for The O’Boyle Law Firm. Therefore, you are likely in possession of the specific e-mail record you seek in the format maintained by the Town and/or its agents. Furthermore, please be advised that the Town does not have the ability to certify electronic records. With respect to part two of your request, we respectfully request clarification as to the date of the e-mail(s) you seek. The Town’s contractor in possession of these records has indicated that there are no such records responsive to your request. The Town notes that Culver Smith previously represented The O’Boyle Law Firm, Jonathan R. O’Boyle and William F. Ring, Jr. Therefore, your attorney may be able to provide you with this record in the format maintained by the Town and/or its agents, and provide clarification as to the proper date of any such record. With respect to part three of your request, the Town posts many of its records online, which includes records related to the undergrounding project. Approximately 250 pages of records related to Phase 1 of the undergrounding project, including surveys, can be found by going to www.gulf-stream.org and clicking on “Find a Town Record”. From there, go to “Town Clerk,” then “Contracts & Agreements,” then on page three “Undergrounding Contracts & Agreements,” then “FPL (Phase One)”. One of the files is named “Survey” and contains six pages of records, including one that covers Hidden Harbour Estates on page four, and accompanying Legal Description of the Florida Power and Light Easement #1 on page two. If you would like certified copies of any of these records that are maintained both electronically and in hard copy format, please let us know. If you seek additional records, please do your best to identify what records you seek so we can best coordinate with Town staff and/or contractors to provide you with the records you seek. If we do not hear back from you within 30 days of this letter, we will consider this request closed. Sincerely, Reneé Rowan Basel As requested by Rita Taylor Town Clerk, Custodian of the Records
