Administer Oaths The Town Clerk administered the Oath to Mark Marsh, Matt Jackman, Carlos Linares and E. Smith. Minutes of ARPB Regular Meeting & Public Hearing Held 9-27-18 @ 8:30 A.M. C. Applications for Development Approval 1. An application submitted by Mark Marsh, Architect, as Agent for East Bluff Trust, the owner of property located at 3377 North Ocean Boulevard, Gulf Stream, Florida, which is legally described as Gulf Stream Ocean Tracts, N 55 ft. of Lt 5, S 45 ft. of Lt 6 & WLY 45 ft. of N 45 ft. of S 90 ft. of Tract 6 as in OR 2060 P1170. Mark Marsh, Architect and Agent for this application described the property as a unique property with,a little bit of a protrusion on the north side and then goes into the normal, standard beachfront lot. f" The current owner asked if the house could ,be renovated or if it needed to be torn down. After doing aesparch, it'was determined the materials that were used were not h�u'rricaRq or,storm�,impact and there were structural issues. The FEMA�.Standard'for THIS house is 14' and FEMA now has a standard of 17.5'2', It was decided to demolish everything on site except for the front prep wakl an� the motor court,urea is being preserved, renovated and restored. Al s tbacks on the p operty have been maintained with an entryway on the',o7rth�side of the property. There is an open trellised, -terraced area -,which can be seen through to the lawn garden. The pl4n is to be open to`the natural elements of the beach. The style of the douse is Contemporary Anglo C4ribbean with a cleaner approach to that style. The roof is a grey slate tile and the Tischler windows are going to have' graphite finish with muttons. The walls are going to be as '`d ant grey. The trellis will be Ipe wood which will fade to a grey/taupe color and the columns will be made of limestone. The pool -has a spill: ove`into a spa. Matt Backman, Landscape`�xchitect,"`displayed the concrete that has a bit of an exposed shell' -,in a 'Light beige color. He said the four large sea grape trees on the property,are going to be repurposed and went into detail about the different species of plants and trees that will be used. He pointed out a water feature near the front porch that is approx. 18" deep with a,,dark material so that it looks deeper than it really is. They are proposing a new site wall that links up to the existing wall on the northern boundary creating a spillover to provide some sound mitigation with a BBQ area in the northeast corner of the property. A "Secret Garden" will be created by re -pruning some trees, adding a small amount of gravel, offset by coral pavers. An outdoor shower and tub in this area, lined with thatch palms, is also being proposed. Vice Chairman Murphy asked about the sea plum on the bottom elevation and inquired as to what the height would be after the pruning was done. Mr. Jackman said it is now 14 ft. tall and it will remain at that height but will fill in. F Minutes of ARPB Regular Meeting & Public Hearing Held 9-27-18 @ 8:30 A.M. Chairman Smith asked if there were any comments from the neighbors. Rita Taylor, Town Clerk, answered that there had been no comments. He asked if notices had been sent and she replied in the affirmative. Mr. Roach asked about the view from the road stating that the pictures reminded him of Egyptian pyramids. He questioned if the roofs were going to be higher than the foliage, to which Mr. Marsh stated the Australian Pines would block the roofs. / 1, Samples of materials to be used were displaffye,and approved. a. An application submitted by Carlos Linares, Architect, as Agent for Kevin and Michelle Clark, the owners of property located at 3400 Polo Drive, Gulf Stream, Florida, which is legally described as Lot 10 & N 50' of Lot 11 in Polo Cove Subdivision. Carlos Linares, Architect and Agent for this application, made it clear that his clients already own a home in Gulf Stream which they plan to sell and then relocate to this property. The proposed home is a Gulf Stream Bermuda -style as shown on a color rendering that was distributed with a grey, charcoal roof and grey shutters. 3 Minutes of ARPB Regular Meeting & Public Hearing Held 9-27-18 @ 8:30 A.M. The home is a two-story house, including a three -car garage (side - loading), five bedrooms with a guest bedroom on the first floor and additional bedrooms and master on the second floor. Mr. Linares stated that all setbacks have been met and he pointed out that the second story is 49.5% the size of the first story, with the eave height on the first floor being 9.9 feet and the second floor being 21 feet. He said that the windows on the rear elevation are 36% of the rear wall and then called attention to the colonial shutters and c9lumns on the front, as well as canvas awnings on front and rear. Apool with a spa is being proposed with symmetrical wet shelves on either side of the spa and a spillover due to the grading. Ms. Smith, Landscape Architect, said the cu.xrent"-,.owners did not want to keep the present landscaping that hides-,the"vater;,xas they want the view. They are going to keep most of the ,landscaping on the sides of the property, which also helps buffer the views of the".,,, neighbors. Chairman Smith noted the front elevation is very visible fxo/m the road and asked if they were going to screen it better from Pol.dlor if the owners want it that way. Ms. Smith explained that the house they currently live in is very'"prjvate and there is a fine line between making it overdone. They don"t.want to hide the house, but do want some privacy. She explained that`the'`trees can be,kept narrow or grow full all determined by pruning. t Town Manager, Greg Dunham, remin4ed them'Apt,to plant in the right-of- way. The Swale was then',discusse4 and Ms./Smith, the Landscape Architect, said there was'not a no iceable(swale, but they could put one in with a matter of grading. Chairm�L Smith -offered that the pavers on the rendering look very nice and upiform, but #e pavers on the sheet that was handed out looked very busy. Mr. Linares said that the sheet was a bit distorted and that the intent_,was to loop like'the rendering. Mrs. Smith asked for abetter explanation of the breezeway and materials on the wall. Mr. Linares explained that the wall material was a board and batten texture that)is going to match the shutters. Town Manager Dunham,%'asked Mr. Linares to speak to the pitch of the breezeway reminding"that the Code shows anything less than 5/12 pitch as prohibited. Mr. Linares responded that they are proposing a 7" wall pitch that will pitch away from the house and the roof will only be visible from the inside windows. Mr. Linares asked if that would be prohibited even if it wasn't visible? Mr. Dunham replied there are no exceptions for that in the Code. Mr. Roach asked where the water would drain and Mr. Linares said the water will drain off to the other roof. 4 Minutes of ARPB Regular Meeting & Public Hearing Held 9-27-18 @ 8:30 A.M. Town Manager Dunham stated that the Design Manual for the Gulf Stream Bermuda -style requires a flat white through and through, smooth, uncoated tile or a grey slate tile. Mr. Linares said it is the same grey slate they have been using on all their homes but the Board was concerned as it looked brown on the rendering. Mr. Linares explained the color was not printing a correct grey and although it is called charcoal it is definitely a slate color. Vice Chairman Murphy asked if there had been any comments from the neighbors and Ms. Taylor responded in the negative. Chairman Smith then pointed out that a neighbor was present and'asked if_ she would like to speak. Penny McCool stated that the house is,7,�574 sq. ft. and the Code requires 7,410 sq. ft. She then que`st`ioned why. Mr., Linares stated that the Code allows this, as a special exception, if',it is outdoor living. She then asked if the ottdoor structure was in,that 7,574 sq. ft., to which he replied in the affirmative. Mr. Roach reminded that the Code doesn' l�all`ow" you, but it gives you the opportunity to "ask for",,permission.`,�ie went on to tell Mr. Linares that he had watched a 16t of, his building W4,thin this district and he had never seen less than two',exception requests. IJ�e,went on to say that, "You're dealing with a 7,410 sq. ft..house and -n -you're asking for another 166 sq. f� alas 30 ft.. from the wate"lwhich is something that is endemic to yotirrbuilding and it -is something that I tend to object to within this district because everything is getting bigger and bigger and higher and highen*,. Mr. Linares said they'were looking at what they are allowed to propose�eand s ted that they had studied the Code and were coming in under the regtnts needed to propose the exception. Mr. Roach questioned if`ithin 7,410 sq. ft., could there be 166 sq. ft. off of something else? Mrd' inares replied that maybe some of a bedroom could have been sacrificed�butxhe felt that the Code is promoting more outdoor living areas, 'thus the,`reason for the exception. At approximately 9:40 AM, Chairman Smith excused himself from the meeting and Vice Chairman Murphy continued the meeting. He asked Mrs. McCool if her concerns were addressed and responded to. She stated that she still didn',t believe they needed the exceptions. Vice Chairman Murphy agreed and went on to say he believed the exceptions were introduced to assist people with pre-existing buildings in addressing the challenges encountered in conforming to the Code. Mr. Dockerty observed if the house was 166 sq. ft. smaller you could get rid of that exception. Acting Chairman Murphy then asked Staff Attorney, Trey Nazzaro, if the Board had the ability to make the recommendation that the special exemption be removed. 5 Minutes of ARPB Regular Meeting & Public Hearing Held 9-27-18 Q 8:30 A.M. Mr. Nazzaro replied in the affirmative referencing Section 66-164 saying that it doesn't meet standards therein, or suggest they re -submit or modify the application and defer it to a time certain. He added the special exceptions could be recommended for denial and passed on to the Commission. Mrs. Smith asked if the board and batten is allowed in this style of house in the Code. Ms. Taylor answered that it,isn't specifically addressed, but it is not prohibited. Mr. Roach made a motion for the architect,o consuft,with his clients to eliminate the special exception of thef extra::166 sq. ft. over the allowable square footage and re -submit ,the appl Oation at the November 15, 2018 ARPB meeting.
