Dear Mr. Addison,
On October 12, 2018 the Town of Gulf Stream adopted Ordinance No. 18/5 and Resolution 18-
14, which includes guidelines for backflow testing. Together, this legislation authorized the
creation of the Town's Cross Connection Control Program manual. The Ordinance states that the
Town is responsible for testing all backflow prevention devices in Gulf Stream with the device
owner responsible for the cost of testing. This allows the Town to have more control in ensuring
the devices are timely and properly tested.
The Town proposes testing all devices in Gulf Stream by September 30, 2019. This will result in
all testable backflow prevention devices being tested during Fiscal Year 2018-19. In accordance
with the manual, the Town will keep the records of all tests, so this will serve as a baseline for all
future testing. The Town will test devices in accordance with the Manual starting on October 1
and running through September 30 each year.
Enclosed, please find a copy of Ordinance 18/5 and Resolution 18-14, which incorporates a copy
of the Town's Cross Connection Control Program Manual. Upon your approval, the Town will
begin obtaining bids for Town -wide testing of backflow prevention devices and commence testing
the devices by coordinating the scheduling with the contractor with the lowest bid.

AN ORDINANCE OF THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, PALM
BEACH COUNTY, FLORIDA, AMENDING THE
TOWN CODE OF ORDINANCES AT CHAPTER
34, UTILITIES; ARTICLE I1, WATER SERVICE;
BY ADDING A NEW SECTION 34-40
BACKFLOW AND CROSS CONNECTION
CONTROL POLICY; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF
ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE
DATE.
BE 1T ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS
Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby amended at
Chapter 34, Utilities; Article 11, Water Service; to read as follows:
Sec. 34-40 Backflow and Cross Connection Control Policy
(a) Cross Connection Control Program. in accordance with F.S. §§ 403.850--403.864,
known as the "Florida Safe Drinking Water Act," Florida Administrative Code Section
62-555.360 (2), and Appendix D of the Standard Plumbing Code, the town manager shall
establish and maintain a backflow prevention manual, which shall be titled "Cross
Connection Control Program." The Cross Connection Control Program shall be adopted
and amended as necessary by resolution of the town commission.
(b) Backflow Prevention Devices. Backflow prevention devices are hereby required at
premises likely to have cross connections as described in the Cross Connection Control
Program, which shall identify categories of consumers and the minimum backflow
protection required by the Town.
1) Backflow prevention devices shall be installed upon any premises where the nature
and extent of the activities on the premises, or the materials used in connection
with the activities or materials stored on the premises present an immediate and
dangerous hazard to health should a cross connection occur, even though such
cross connection does not exist at the time the backflow prevention device is to be
installed. Decisions regarding replacement of backflow prevention devices shall
be made by the Town in accordance with the guidelines set forth in the Cross
Connection Control Program.
2) The type of backflow prevention device to be installed shall depend on the degree
of hazard which exists or may occur. Backflow prevention devices, such as a
double check -valve assembly, atmospheric vacuum breaker, pressure vacuum
breaker or reduced pressure backflow preventer shall meet or exceed the standards
and specialized installation methods as described in the Cross Connection Control
Program. Backflow prevention devices shall be installed on the consumer's side
of the water meter at the location designated by the Town. The device shall be
located so as to be readily accessible for maintenance and testing, and where no
part of the device will be submerged.
(c) Cross Connection Control Program Expenses.
1) Installation. Backflow prevention devices shall be installed by a certified backflow
prevention device technician or licensed plumber at the consumer's expense. All
installations will be completed in accordance with plans and specifications
approved by the Town.
2) Inspections. Backflow prevention devices shall be inspected and tested as outlined
in the Cross Connection Control Program by the Town or its duly authorized
agents at the consumer's expense. Fees for inspection and testing shall be adopted
and amended as necessary by resolution of the town commission.
3) Repair or Replacement. Backflow prevention devices shall be repaired or replaced
by a certified backflow prevention device technician or licensed plumber at the
consumer's expense. All repairs and replacements will be completed in
accordance with plans and specifications approved by the Town.
(d) Enforcement Procedures.
1) The town manager shall inform the consumer of any failure to comply with the
conditions of this section. The town manager will allow an additional 15 days for
the correction. In the event the consumer fails to comply with the necessary
correction within this timeframe, the town manager may terminate the consumer's
water service until corrective action is taken or until the necessary backflow
prevention device is installed. In the event that the consumer informs the town
manager of extenuating circumstances as to why the correction has not been made,
a time extension may be granted by the town manager not to exceed an additional
30 days.
2) Delivery of water to any consumer may be terminated by the town manager if any
backflow prevention device required by this section has been removed, tampered
with or bypassed. Water service shall not be resumed until conditions at the
consumer's premises have been corrected to the satisfaction of the town manager.
Section 2. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such invalidity
shall not affect the other provisions or applications of this Ordinance which can be given effect
without the invalid provisions or applications, and to this end the provisions of this Ordinance are
hereby declared severable.
Section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict
with this or any part of this Ordinance are hereby repealed.
Section 4. Codification.
This Ordinance shall be codified and made a part of the official Code of Ordinances of the
Town of Gulf Stream.
Section 5. Effective Date.

RESOLUTION NO. 18-14
A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY,
FLORIDA, ADOPTING A CROSS CONNECTION CONTROL
PROGRAM TO BE APPLICABLE TO WATER CONNECTIONS
TO PROPERTIES WITHIN THE TOWN OF GULF STREAM.
WHEREAS, the creation of a manual titled "Cross Connection Control Program" was authorized
by the Town in Ordinance No. 18/5 on October 12, 2018: and
WHEREAS, the Cross Connection Control Program is intended to carry out Florida Statutes
Sections 403.850-403.864, known as the "Florida Safe Drinking Water Act," Florida
Administrative Code Section 62-555.360 (2), and Appendix D of the Standard Plumbing Code;
and
WHEREAS, Florida Administrative Code Rule 62-555.360 requires all community water systems
to establish and implement a routine cross -connection control program to detect cross -connections
and prevent backflow of contaminants into the public water system. Such program shall provide
that upon detection of a prohibited cross -connection, community water systems shall either
eliminate the cross -connection by requiring installation of an appropriate backflow prevention
device acceptable to the Florida Department of Environmental Protection ("Department") or
discontinue service until the contaminant source is eliminated; and
WHEREAS, the Cross Connection Control Program is to be adopted by resolution of the Town
Commission and to be amended from time to time by resolution.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Cross Connection Control Program manual, dated October 12, 2018, is hereby
adopted. Said manual is attached hereto in full and is incorporated as part of this resolution.
Section 2. The Cross Connection Control Program manual may be revised from time to time by
resolution of the Town Commission.
Section 3. This Resolution shall become effective immediately upon its passage and adoption.
