A RE SOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KE Y BISCAYNE, FLORIDA, APPROVING A
MEMORA NDUM OF UNDERSTANDING BETWEEN THE
VILLAGE OF KE Y BISCAYN E AND THE KE Y BISCAYNE
PROFESSIONAL FIRE FIGHTER'S ASSOCIATION,
LOCAL 3638 RELATING TO CANCER BENEFITS;
PROVIDING FOR AUTHORIZATION; AND PROVIDING
FOR AN EFFECTIVE DATE.
W HERE AS, the Village of Key Biscayne ("Village") desires to approve the
Memorandum of Understanding ("MOU") attached hereto as Exhibit "A" between the Village
and the Key Biscayne Professional Firefighter's Association, Local 3638 (hereinafter, "Local
3638") relating to cancer benefits; and
W HERE AS, the Village Council desires to authorize the Village Manager to execute the
MOU; and
W HERE AS, the Village Council finds that this MOU is in the best interest and welfare
of the residents of the Village.
NOW, THERE FORE , BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. That each of the above-stated recitals are hereby adopted,
confirmed, and incorporated herein.
Section 2. Approval. That the Village Council approves the MOU in substantially
the form attached hereto as Exhibit "A."
Section 3. Authorization. That the Village Council hereby authorizes the Village
Manager to execute the MOU, in substantially the form attached hereto as Exhibit "A," subject
to the approval of the Village Attorney as to form, content, and legal sufficiency, and to take any
action which is reasonably necessary to implement the intent and purpose of the MOU.

WHEREAS, SB 426 was passed by the Florida Legislature, referred to as the "Florida
Firefighter Cancer Treatment Legislation" ("Act"), creating Florida Statute section 112.1816; and
WHEREAS, the purpose of that legislation was to grant certain benefits to firefighters upon
receiving a diagnosis of cancer, recognizing that the identified cancers were related to work
performed by firefighters in the line of duty for the Village; and
WHEREAS, the Village recognizes that there were firefighters who were undergoing
treatment for one or more of the twenty-one (21) cancers covered by the Act upon the effective
date of the Act, March 1, 2019; and
WHEREAS, it is the intent of the Village to assure that these firefighters receive the
protections and benefits of the Act in addition to the benefit provided below.
IT IS THEREFORE RESOLVED as follows:
1. The firefighters being treated for cancers covered by the Act as of the Act's effective
date of July 1, 2019 shall be provided all benefits under the Act;
2. In addition, such firefighters shall be reimbursed for any leave used related to such
treatment/disability, retroactive to March 1, 2019, pursuant to Article 18, On the Job
Injury, of the 2017-2020 collective bargaining agreement between the Village of Key
Biscayne and IAFF Local 3638.
