COUNCIL MINUTES
SPECIAL MEETING - MAY 9, 2000
The Special Meeting of the Bal Harbour Village Council was held on Tuesday, May 9,
2000, in the Council Chambers, at Bal Harbour Village Hall. The meeting was called to
order at 4:10 p.m. by Mayor Hirsch'. Those present were:

Absent: Councilman Boggess
As a quorum was determined to be present, the meeting commenced.
g. Pledge of Allegiance: The Pledge of Allegiance was led by the
Village Council.
3. Attorney/Client Session: Mr. Richard Weiss advised that the
Village has noticed Executive Sessions on both the Bal Harbour Club litigation and AVA
litigation. However, there is only going to be one Executive Session on the Bal Harbour
Club litigation because the issues in the AVA litigation are basically the same. Cho AVA
motions, which get to the same place as the Bal Harbour Club motions, are r.chertuied for
the same time and place as the Bal Harbour Club motions. So, the Council doosn't need
to go over it twice. Mr. Weiss clarified that the AVA motions are the same: as ;he Bei
Harbour Club motions.
Mayor Hirschl stated the Council is about to have an Attomey/Client Session in accordance
with the Florida Statute 286.011 regarding the litigation of Bal Harbour Club Inc. versus
Village of Bal Harbour Case Number 99-27948CA11. Discussion will be confined to this
case only. The session is estimated to last one half hour and the following people will be
in attendance:

Village Attorney Richard J. Weiss
Village Attorney Stephen Helfman

These proceedings will be recorded by a Certified Court Reporter. At the conclusion of all

litigation discussed, a transcript will be made part of the public record. All individuals who
have not been named should leave the room at this time.
4. Adioura: There being no further business to come before the Council,
a motion was offered by Councilman Roth and seconded by Councilman Corson to adjourn. The
motion carried unanimously (4-0). with Councilman Boness absent. and the meeting adjourned
at 5:08 p.m.
