DESCRIBED AS PART LOT 6 OF EL MERCADO DEVELOPMENT SECTION 1, JEFFERSON

WHEREAS, Gerard Rockers, owner of the real estate hereinafter described , having submitted to
the City Council an Amended Preliminary PUD Plan of said real estate, Part of Lot
No. 6 of El Mercado Development-Section One , per plat of record in Plat Book 11

WHEREAS, it appears that the procedures set forth in the zoning code relating to Planned Unit
Developments have in all matters been complied with , as said property owner
submitted to the Planning and Zoning Commission and City Council an Amended
Preliminary PUD Plan for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Amended Preliminary PUD Plan submitted by Central Missouri
Professional Services, on file as Case No. P13006 in the Jefferson City P lanning Div ision , is
hereby approved for the land referenced above with the following condit ions:
1. Permitted uses of the property shall be limited to offices , post-secondary education
facilities, commercial laundry facilities , and private schools .
2. Signage shall be in accordance with requirements for properties zoned C-1.
SECTION 2. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P13006-216 El Mercado Plaza; Amended Preliminary PUD Plan. Request filed by
Gerard Rockers, property owner, on behalf of Lighthouse Preparatory Academy for an
amendment to a PUD plan to convert the building to a private school. The property is located at
the end of the El Mercado Plaza cul-de-sac and is described as Part of Lot 6 of El Mercado
Development Section One. (CMPS, Consultant)
Mr. Barron described the proposal and explained that the applicant is requesting approval of an
amended Preliminary PUD Plan in order to convert the subject property to a private school. He
stated that the plan calls for the addition of a gymnasium to the existing building. Mr. Barron
explained that an amendment to the PUD Plan to permit use of the property as a post-secondary
school was approved by the Planning and Zoning Commission on September 8, 2011. He stated
that an additional amendment to add a laundry facility was approved on December 8, 2011 but was
never implemented. Mr. Barron explained that a building addition consisting of a 7,800 square foot
gymnasium is proposed. He stated that in order to accommodate the gymnasium addition, a 2,300
square foot portion of the existing building would be removed.
Mr. Mike Bates, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding
this request. Mr. Bates distributed two (2) visuals depicting the site layout of the subject property.
He explained that there are 85 full time students in Grades 6-12. Mr. Bates stated that this is a
unique situation in that the Lighthouse Preparatory Academy has a combination of home schooled,
as well as, classroom experience. He explained that this building has been vacant for some time
since the proposed laundry business did not proceed.
Mr. Gerard Rockers, BRM 2002 LLC, 210 Kaylor Bridge Road, Centertown, Missouri, spoke
regarding this request and explained that traffic flow while dropping off and picking up students will
not be an issue. He stated that there are approximately 7 to 8 staff members and only 5 to 6
students that drive to school.

The owner, BRM, proposes to modify the use of the existing facility at the above
referenced location for use as a private school. With the change in use the owner also
proposes to construct a gymnasium addition and make renovations to the interior of the
building to allow for 8 classrooms, office and storage space. The gymnasium will be
utilized as a recess and recreation area.
Lighthouse Preparatory Academy is a private Christian school that utilizes a university-
type schedule and a teacher";l'arent integrated instruction approach. The school is
comprised of 6th through 12 grades. Currently Lighthouse Preparatory Academy has an
enrollment of 85 full time students, of which, approximately 40 are middle school
students and 45 are high school students.
The existing building is approximately 12,500 sf. To make room for the gymnasium
addition, 2,300 sf of the existing building will be removed. The proposed gymnasium
addition will be approximately 75' x 104' and an area of7,800 sf, making the total
building area 18,000 sf.
Currently the site is served by 30 parking spaces. Approximately 8 spaces will be
removed to allow for the construction of the gymnasium addition. 5 additional stalls will
be striped in the truck maneuvering lane, which will not be needed for this use. The total
number of parking stalls provided will be 27 stalls.
The schools parking calculation is as follows:
Middle School: 2 stalls per classroom 2 stalls x 8 classrooms = 16 stalls
High School: 1 per 4 students 45 high school students/4 = 11 stalls
The total parking stalls required for this site based on this calculation is 27 stalls.
Signing will be in accordance with the City's sign ordinance.

Zoning History
The original PUD plan for the property was approved by the Planning and Zoning Commission on April
14, 1994. An amendment to the PUD Plan to permit use of the property as a post-secondary school (as
well as the adjacent buildings at 210 El Mercado and 3515 Amazonas Drive) was approved by the
Planning and Zoning Commission on September 8, 2011. Another amendment to add laundry facility as
a permitted use was approved on December 8, 2011.

Staff Analysis
Parking: The parking requirement for a school is as follows:
Middle School-2 stalls per classroom
High School-1 stall per 4 students
The parking calculation on the application indicates that there will be 8 classrooms and approximately 45
high school age students. This results in a parking requirement of 27 spaces. The Amended PUD Plan
shows that 27 parking spaces will be provided on the site, which is sufficient to meet the parking
requirement for the proposed use.
Permitted Uses: Currently, the permitted use of the property is limited to offices, post secondary
education facilities, and commercial laundry facility. The applicant is proposing to add private school to
the list of permitted uses.
Building Design: A building addition consisting of a 7,800 sf gymnasium is proposed. To accommodate
the gymnasium addition, a 2,300 sf portion of the existing building would be removed. The total building
size would be approximately 18,000 sf after the addition.
Signs: Signage is proposed to conform with the current sign code.
Staff Recommendation
Staff recommend approval of the proposed Preliminruy PUD Plan amendment A private school would
be compatible with the commercial nature of the area.
Form of Motion
1. Motion for approval of the Preliminary PUD Plan amendment with the following conditions:
a. Permitted uses of the property shall be limited to offices, post secondary education
facilities, commercial laundry facilities, and private schools.
b. Signage shall be in accordance with requirements for properties zoned C-1.
