HomeMy Public PortalAboutInformation Technology Services Agreement 2018TOWN OF GULF STREAM PALM BEACH COUNTY, FLORIDA Information Technology Services Agreement This contract between Calvin, Giordano & Associates. Inc. ("Contractor") and the "Down of Gulf Stream ("Town") is for services as described in the Town's Invitation to Negotiate Infonnation Technology Services, ITN No. 18-100, dated October 12, 2018 ("ITN") and is summarized as a contract for ongoing preventative and remedial assistance to repair and optimize Town software and hardware, including basic installation, maintenance and per -incident repairs, and to manage and assist with municipal related IT services. This contract is issued pursuant to the ITN and is subject to the terms and conditions contained in the ITN, which are deemed incorporated into and part of this contract. 1. Contract Duration. The duration of this contract is twelve (12) months, beginning December 1, 2018 and ending November 30, 2019, to be renewed by mutual agreement of the parties and in accordance with Florida Statutes § 287.057 (13), However, the Town shall not enter into any renewals that would result in the total contract price under this ITN, inclusive of renewals, exceeding the Category Two threshold as defined in Florida Statues § 287.017. 2. Scope of Work. Contractor shall perform all requested Infonnation Technology Services ("IT services"). All work shall be performed in accordance with applicable Federal, State, and Local laws and regulations. Contractor shall provide the requested IT services as per signed Management Control Agreement as defined in the CJIS Security Manual V5.6, and any updates thereto. When applicable, Contractor further agrees to have Contractor's employees fingerprinted and attend security training required by CJ IS V5.6 policy, and Contractor will abide by security addendum Appendix H, and any updates thereto. Contractor shall perform all work in accordance with CJIS and FDLE policies and procedures. 3. Fees. IT Services shall be billed in 1/10 hr increments on an as -needed basis at the following rates: Professional Fee Schedule After Hours Fee Schedule Director Data Technology $165 / hr. Network Administrator $225 / hr. Network Administrator $155 / hr. IT Support Specialist $125 / hr. IT Support Specialist $ 85 /hr. 4. Response Time. Contractor shall be responsible for timely responses to Town needs, including providing on-site services to the Town and its Police Department when requested. Contractor shall promptly solve issues depending on severity. Issues are described as low, normal, high, and urgent as follows: - LOW o No hindrance to Town business o Workaround is available o Immediate solution not needed by Town o Requires resolution within 10 days - NORMAL o Interruption to Town business o Workaround likely available o Immediate solution not needed by Town o Requires resolution within 3 days - HIGH o Current or imminent interruption to critical processes affecting individual Town users o No workaround available o Immediate resolution is needed by Town o Requires resolution within 24 hours - URGENT o Interruption to critical Town business affecting several Town users, security, or Police Department o No workaround available o Immediate resolution is needed by Town o Requires either a remote or onsite response within a 2 hour window and resolution within 24 hours 7 Town reserves the right to tenninate this contract at any time if, it its sole discretion, Contractor is unable to timely resolve or respond to a high or urgent priority issue or comply with any CJIS or FDLE polices. 5. Insurance Contractor shall maintain insurance covering work for the Town during the duration of the contract. 6. Public Records Contractor shall comply with Chapter 119, Florida Statutes, specifically those outlined in Florida Statute 119.0701 (b). I acknowledge that access to criminal history record information and related data is therefore limited to the purpose(s) for which a government agency has entered into the contract incorporating this Security Addendum. I understand that misuse of the system by, among other things: accessing it without authorization; accessing it by exceeding authorization; accessing it for an improper purpose; using, disseminating or re -disseminating information received as a result of this contract for a purpose other than that envisioned by the contract, may subject me to administrative and criminal penalties. I understand that accessing the system for an appropriate purpose and then using, disseminating or re -disseminating the information received for another purpose other than execution of the contract also constitutes misuse. I further understand that the occurrence of misuse does not depend upon whether or not I receive additional compensation for such authorized activity. Such exposure for misuse includes, but is not limited to, suspension or loss of employment and prosecution for state and federal crimes. (2) Standards for the selection, supervision, and termination of personnel access to Criminal Justice Information (CJI). (3) Policy governing operation of justice systems, computers, access devices, circuits, hubs, routers, firewalls, and any other components, including encryption, that comprise and support a telecommunications network and related criminal justice systems to include but not limited to criminal history record/criminal justice information, insofar as the equipment is used to process or transmit criminal justice systems information guaranteeing the priority, integrity, and availability of service needed by the criminal justice community. (4) Restriction of unauthorized personnel from access or use of equipment accessing the State network. (5) Compliance with all rules and regulations of the (Criminal Justice Agency) Policies and CJIS Security Policy in the operation of all information received.
