RESOLUTION 2018-25
RESOLUTION GRANTING LOT LINE REARRANGEMENT APPROVAL
BETWEEN 1425 COUNTY ROAD 24 AND
PROPERTY IMMEDIATELY TO THE SOUTH
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, John H. Reiser Residuary Trust (the "Applicant") owns property located at
1425 County Road 24 ("Parcel 1"), which is approximately 10 acres in area and is legally
described as:
The Southeast Quarter of the Northwest Quarter of the Southwest Quarter
of Section 23, Township 118 North, Range 23 West of the 5th Principal Meridian. ; and
WHEREAS, the estate of Philip W. Reiser (the "Estate") owns property immediately to
the north ("Parcel 2"), which is 10 acres in area and is legally described as:
The Northeast Quarter of the Northwest Quarter of the Southwest Quarter of Section
23, Township 118 North, Range 23 West of the 5th Principal Meridian. ;and
WHEREAS, the Applicant and the Estate (collectively, the "Owners") have requested
approval of a lot line rearrangement to shift the common property line between Parcel 1 and
Parcel 2 to the north; and
WHEREAS, the City Council reviewed the requested lot line rearrangement at the April
17, 2018 meeting and reviewed testimony of interested parties; and
WHEREAS, following such review the City Council made the following findings:
1) The proposed lot line rearrangement is not in conflict with the general and specific plans
of the City and is not premature.
2) The lots resulting from the lot line rearrangement exceed minimum lot standards, are
suitable for the type of use contemplated, and are otherwise not in conflict with the
findings noted in Subd. 10 of Section 820.21 of the City Code.

NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota
hereby grants approval of a lot line rearrangement resulting in Parcel 1 and Parcel 2 being legally
described as in Exhibit A, attached hereto, subject to the following terms and conditions:
1) A deed transferring the two acres from Parcel 2 to Parcel 1 shall be recorded in
conjunction with effectuating the lot line rearrangement and the Owners shall abide by
the recommendations of the City Attorney related to recording procedures and title
documentation.
2) The Owners shall file necessary documents with Hennepin County to effectuate the lot
line rearrangement within 180 days or the approval granted herein shall become null and
void, unless an extension is granted by the City Council.
3) The Applicant shall pay to the City a fee in the amount sufficient to pay for all costs
associated with the review of the lot line rearrangement.

and upon vote being taken thereon, the following voted in favor thereof:
Anderson, Cousineau, Martin, Mitchell, Pederson
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.

Parcel 1
The Southeast Quarter of the Northwest Quarter of the Southwest Quarter of Section
23, Township 118 North, Range 23 West of the 5th Principal Meridian
Also, The South 130.00 feet of the Northeast Quarter of the Northwest Quarter of the
Southwest Quarter of said Section 23.
Parcel 2
That part of the Northeast Quarter of the Northwest Quarter of the Southwest Quarter of
Section 23, Township 118 North, Range 23 West of the 5th Principal Meridian lying
North of the South 130.00 feet thereof.
