A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, APPROVING
TENTATIVE PLAT REVIEW FOR THE CONSTRUCTION
AND OPERATION OF A WAREHOUSE/DISTRIBUTION
CENTER ON THE PROPERTY LOCATED AT 12700 NW
LE JEUNE ROAD IDENTIFIED BY FOLIO 08-2129-000-
0032, IN THE B-3 ZONING DISTRICT; PROVIDING FOR
APPROVAL; PROVIDING FOR INCORPORATION OF
RECITALS; PROVIDING FOR SCRIVENER'S ERRORS;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, GPT NW 42nd Avenue Owner III LLC c/ o Gramercy Property Trust
("Applicant") presented a request for site plan and development agreement approval to
the City Commission of the City of Opa-Locka ("City Commission") on June 24, 2020 to
develop the B-3 zoned property identified by folio 08-2129-000-0032 ("Property") with a
warehouse/distribution/commercial facility in accordance with the Commercial and
Corridor Mixed Use Overlay requirements of the City Land Development Regulations;
and
WHEREAS, the City Commission approved the site plan and development
agreement requests and the applicant now seeks to obtain Tentative Plat approval in the
accordance with the requirements of the City of Opa-Locka ("City") and the
requirements of Miami -Dade County Code, Chapter 28 "Subdivisions" -Plats and
Platting; and
WHEREAS, to develop the Property, the Applicant also needs to obtain
approvals for the construction of the warehouse distribution center in accordance with
Miami -Dade County platting regulations. The applicant desires to begin the Platting
process by requesting tentative plat approval for the Property, located at 12700 LeJeune
Road, in accordance with the Miami -Dade Code of Ordinances; and
WHEREAS, the Applicant's Tentative Plat request was presented to the Planning
& Zoning Board ("Board") on September 8, 2020 and the Board recommended approval
of this Plat request by a 5-0 vote; and
WHEREAS, the City Land Development Regulations, Ordinance 15-31, Section
2249G provides that all recommendations and findings of fact by the Planning &
Zoning Board shall be placed on the next available regular City Commission meeting
agenda in compliance with notice requirements.

WHEREAS, the City desires to approve the Tentative Plat attached hereto as
Exhibit "A" to this Resolution.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA:
SECTION 1. RECITALS.
The above recitals are true and correct and are incorporated into this Resolution
by reference.
SECTION 2. APPROVAL/DENIAL. Approval of Tentative Plat.
The City Commission of the City of Opa-Locka hereby approves the request,
attached hereto as Exhibit "A" for Tentative Plat approval for Construction and
Operation of a Warehouse/ Distribution Center on the property located at 12700
NW Le Jeune Road and identified by folio 08-2129-000-0032 in the B-3 Zoning
District.
SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by
filing a corrected or re -codified copy of same with the City Clerk.
SECTION 4. EFFECTIVE DATE.
This Resolution shall, upon adoption, become effective as specified by the City of
Opa-locka Code of Ordinances and the City of Opa-locka Charter and is subject
to approval by the Governor of the State of Florida or Governor's designee.

The applicant/owner, GPT NW 42nd Avenue Owner LLC c/o Gramercy Property Trust
presented requests to the City Commission on June 24, 2020 for Site Plan Review and for
Resolution -Tentative Plat Approval —10-28-20
Development Agreement approvals for the construction of warehouses and distribution
center uses on this property identified by folio 08-2129-000-0032. The City Commission
approved the Site Plan and the Development Agreement. To develop this property the
applicant also needs to obtain plat approvals for the construction of this warehouse
distribution center in accordance with the requirements of Miami -Dade County platting

• Applicant's intent
The applicant has received City Commission approval to construct a 505,454 square foot warehouse
distribution center at the southwest corner of NW 42nd Avenue/Le Jeune Road and State Road 924/Gratigny
Parkway by Resolution 20-9774 and Resolution 20-9775. This property currently serves as an auto action and
is surrounded by commercial uses to the east of the property and industrial uses to the north.
The City of Opa-locka's Comprehensive Plan, Future Land Use Plan map provides that the property
has a land use designation of "Commercial" with a "Corridor Mixed Use Overlay", which allows for an
industrial/commercial mixed -use, including warehouse/distribution facilities. This property would potentially
provide a boost to the local economy by promoting job creation and economic development in an area centrally
located off a half line section line road and a major highway, State Road 924/Gratigny Parkway.

Dear Mr. Gay:
On behalf of Express Permit Solutions located at 10801 NW 14 Street, Suite 103 in Miami,
Florida, GPT NW 42 Avenue Owner LLC (the "Applicant") has retained our company to obtain
neighborhood petition signatures as part of the development agreement and site plan application
process for the property located at 12700 NW LeJeune Road in Opa-Locka, Florida and identified
by folio number 08-2129-000-0032 (the "Property"; depicted in Exhibit "A"). A copy of the
neighborhood petition form is enclosed as Exhibit "B".
As part of the signature collection process, we were asked to obtain signatures from
adjacent property owners. Nine properties were initially identified. However, only eight adjacent
property owners' signatures were necessary because the Applicant owns the parcel across the street
from the Property located at 12691 NW 42 Avenue. Enclosed as Exhibit "C" is an aerial
photograph of the Property and the surrounding area. The eight properties we addressed are
identified and labeled in red. The Property is outlined in yellow.
In total, we were able to obtain signatures supporting the development request from three
property owners. These signatures correspond to the properties labeled as "A", "B", and "C" in
Exhibit C. The property owner of Property "D" stated that she would prefer to wait for the results
of any environmental inspections to be performed and approved before signing off on the petition.
We attempted to visit the owner of Property "E" on three occasions, November 15, 18, and 20.
The owner was not available on these occasions and the lessee was not willing to provide further
contact information.
Properties "F" and "G" are under the same ownership. We visited the properties on
November 15 and 18 and were not able to meet with the owner. On November 20, we were able
to speak with the owner who requested a brief description of the proposed project. On November
30, we followed up with the property owner on his request and he stated he wanted more time to
think about the petition. On December 1, the owner requested additional information in writing.

We provided the owner with the information he requested and attempted to schedule a follow up
with him the next day. On December 2, we visited the property and were not able to meet the
owner. On December 17, we made one final attempt to meet the owner at the property. The owner
did not answer the door and has not replied to any recent emails. owner. On December 17, we

Property "H" was visited on November 15, 18, 20, and 30 as well as December 2 and 17.
We attempted to gain entry using the intercom at the front gate and the number provided at the
gate. However, the owner did not answer on the intercom and the phone appears to have been
disconnected. We left our contact information with the construction workers present and have not
been able to make contact with the owner.
Based on the above and attached, the Applicant is submitting the three obtained signatures

The Planning & Zoning Board of the City of Opa-locka, Miami -Dade County, met in a special
virtual session on Tuesday, September 8, 2020 at 7:00 p.m. The following members of the
Planning & Zoning Meeting were present: Board Member Germane Barnes, Board Member
Claudienne Hibbert-Smith, Board Member Dawn Mangham, & Board Member Rose Tydus &
Chairman Elio Guerrero.
Also in Attendance were Planning & Community Development Director, Gregory Gay,
Zoning Official, Gerald Lee, City Planner, Corion Delaine, Administrative Assistant, Kinshannta
Hall, and Attorney Burnadette Norris -Weeks.

II INVOCATION AND PLEDGE: Prayer was led by Board Member Tydus and the Pledge of
Allegiance was stated after the Prayer.
III APPROVAL OF MINUTES: Discussion of Minutes from May 5, 2020 Meeting
Chairman Elio Guerrero asked if a motion could be made to have the minutes approved from
May 5, 2020 meeting.
Board Member Germane Barnes made a motion to approve the minutes. Board Member Dawn

Mr. Gay: Items one, two, and three are companion items. As it relates to this project this
application does not meet the minimum lot size requirements as it relates to projects that will be
presented within the I-2 zoning district. They are adjacent to a City right away which is not
presently being utilized. The applicant didn't want to wait on the City. They wanted to move
forward with the application and they have representation who is Ben Fernandez. They will be
doing a presentation for all three items.
On Behalf of the applicant "Ben Fernandez" whose address is 200 South Biscayne Blvd
representing Velocity Car Carriers Corp. came before the Planning & Zoning Board to present
the project via zoom with a power point presentation.
Ben Fernandez: This business has been in business for 20 years now. They are an experienced
car carrier. They have seven trucks and would need about three spaces which will be occupied
by trailers. They are excited about coming to Opa-locka. We have requested a variance and we
think we meet that criteria. It is in an Industrial zoning. We believe the use is compatible for the
area. My client has purchased the property and my client fully intends to vacate the street in the
future and would like to incorporate that half of that street into their property which will take
some time a longer process. Most businesses are already operating in the area with similar
businesses. This will be a benefit for adjacent properties. This will allow a new business to
establish in the City. If you look at the overall the land is there it's just that part of it that is a
right away that hasn't been used. We have the support of "Kauffs Towing" who gave us a
petition which is in your package and we reached out to the other neighbors but they didn't
respond in time. I think we have a site plan that is compliant with all of the other industrial
zoning district regulations. I'm willing to answer any questions at this time.
Chairman Guerrero: The proposed use is just the lot size? How short are they?
Mr. Gay: The property is 15,000 ft. and it is 5,000 short.
Chairman Guerrero: Any questions board members for the applicant?

Mr. Delaine: Gives presentation regarding item number 1 in detail from the power point
presentation. The lot size does not meet requirements. Staff does not recommend approval of this
variance request. Staff is in full support if the property acquire the adjacent lot which will allow
for this trucking facility.
Board Member Barnes: I have a question. The power point slide that says staff does not
recommend approval without modification. I want clarity on that language.
Mr. Gay: A minimum size is 20,000 requirement size in I-2. Based on the info presented by the
code. With that being said there is a need for the closure adjacent right of way and actions to take
place. They have stated and will move forward to have that street vacation to process. Based on
the code it is a denial.

Board Member Tydus: Can a time limit be given as far as the vacating process goes?
Mr. Gay: That is an issue that would be addressed a part of the developer agreement. In essence
if you want to look at this as an opportunity to move forward it would be within the application
of the developer agreement.

Mr. Gay: As a result of the denial of the variance on Item 1. We are not in a position to even
here the other two items.
Ben Fernandez: We would ask at least take action on it so that the board have the opportunity to
see all three applications.
Attorney Norris -Weeks: I agree. Keep this moving forward based on the state of the law of
Florida and land use issues.
Mr. Gay: With that being said Staff will go forth with our presentation for Item 2 and Item 3.

Mr. Delaine: As mentioned before due to the size staff have their concerns. The site plan shows
the exact size in you all packages. Based on the lot size staff does not recommend approval of
the site plan.

Board Member Tydus: I didn't see any addresses on the buildings. There should be addresses
on the buildings unless I didn't see it.
Mr. Gay: The property is vacant at the time. They are proposing to add a building to the site.
This is one of the things the applicants wants to do. You would have to rely on intuition to have
a better understanding to what will occur on this item to have it approved.

209775 for site plan and development agreement approval. As a part of the development
of the property Miami -Dade County requires that the property goes through a platting
process and that begins with a tentative plat. This is the first step of this process. They are
getting the approval of the City to be able to go before Miami -Dade County to begin the
process of platting. You've already approved it before. It is a warehouse project and Staff
recommends approval.

Mr. Gay: As Staff we looked at this as an opportunity to do a design handbook as a tool to assist
developers, engineers, and people who are looking to modify their existing home to give them a

document to guide them the visual appeal of what Opa-locka should look like. Mr. Delaine put
together this document and he will give a brief presentation.
Mr. Delaine: In each board member packet is included a draft of the booklet to review. This is
to give developers an idea who may want to bring a new project and Staff recommends approval.
Board Member Barnes: It's simply for developers for Moorish styles not for every case of
development?
Mr. Gay: This is a document for anyone who is looking to do a Moorish style design. This is
just a step. This is not something that will be mandated throughout the entire City.
Board Member Tydus: I would like to make a statement. This is nothing new but for the past
40 years I've been against it. I shared in the past the dark side of the Moorish architect. We
should be more of the observance of our demographic. For all future structures of our present
time and minority community. I'm not in support of anything Moorish again.
