Hughes VIA CERTIFIED MAIL Section 9 -050 of the Land Development Code of the City of Tybee Island requires the enforcement of the International Residential Code (IRC). The IRC requires final inspection of a newly constructed swimming pool. According to our records you own a swimming pool that was constructed but has not passed a final inspection. On October 6, 2010, a letter regarding the swimming pool at 1315 Fifth Avenue was mailed to your attention. However, a reinspection of the swimming pool on October 14, 2010, failed. Enclosed is a copy of that report. It would be a violation of the code for you, your family, or your guests to use the swimming pool. In addition, you would have considerable liability if an accident was to occur and the pool had not been inspected for code compliance. This is a very serious problem. Please take the time to make your property a safer place to live and play by contacting us immediately at (912) 786 -4573, extension 114, to schedule an inspection. Please refer to permit 09 -0023. There don't appear to be any BMPs in place." As you know, yesterday we went by to this site yesterday afternoon at 4:15pm, a little less than 2 hours after Chuck notified you. This was following our previously scheduled 3:30pm meeting at Tybee Traces and just before your next meeting at 4:30pm. The immediate concern was the erosion related issues. Attached you will find 2 pictures. One shows the tracking created on 6th Street from the use of 1316 6th Street for a construction exit. From the SAGIS web site the Owners appears to be EFIRD SCOTT MICHAEL & WILLIAM who I believe you have contact information on. The second shows the existing unpaved driveway on the west side of 6th St and slightly north of 1316. As you can see from the standing water in this unpaved driveway, there is tracking of sediment onto 5th Street on a continual basis, although this private drive creates less tracking on a daily basis than the swimming pool project. As you and I pulled off the road at 1316, the contractor doing the excavation pulled up and explained the road would be swept, the ruts filled on 1316 and sod placed to restore the damage. As he is through, that should provide the necessary corrective action across 1316 at this time and only prior to this weekend. As the excavation contractor advised he had completed his work, we did not pursue a conversation on future action with him. It is my understanding your department is contacting 1316 to assure they are aware of this situation. As there is only an excavation and the swimming pool construction is less than 1/2 completed, I recommend you contact the applicant to allow the City to evaluate the erosion control measures planned for the entire project. Their was silt fence across the northeast side of 1316 although I'm not sure how much good it is doing. Any future activity with vehicles accessing the site, even in part, over unpaved areas will require a construction exit. I recommend we evaluate this matter this morning to evaluate BMP deficiencies. Additionally, I recommend we look at the ponding water at the rear of these lots which may be newly created or worsened as a result of the swimming pool project. As swimming pools are installed higher than the surrounding areas, usually with filled shoulders and slopes, there is a strong possibility that drainage has been negatively impacted by the installation of the swimming pool. Chuck stated, "I have asked the contractors to stop any further work until soil cloth is install and sediment contained. ... I asked both of the contractors at this site (Backyard Living and Pool Solutions Plus) if they were told this at permitting, of land disturbing requirements or if they were aware these precautions where required and they said no!" Chuck further advised there was at least one unhappy neighbor that may be going further with complaints to i others. When I spoke to Ann Miller last night at the City Council meeting she made this the topic of our conversation. She most probably will pursue this matter further. This is only FYI as it will not be affecting my recommendations to you. I appreciate not only Chuck's continued cooperation but the notifications by Ann and other citizens. From the cod: § 12 -7 -19. Education and training requirements; required programs; instructor qualifications; expiration of certification (a) (1) Persons involved in land development design, review, permitting, construction, monitoring, or inspection or any land - disturbing activity shall meet the education and training certification requirements, dependent on his or her level of involvement with the process, as developed by the commission in accordance with this Code section and in consultation with the division and the Stakeholder Advisory Board created pursuant to Code Section 12 -7 -20. (2) ... (3) Persons or entities involved in projects not requiring a state general permit but otherwise requiring certified personnel on site may contract with certified persons to meet the requirements of this chapter. § 12 -7 -17. Exemptions This chapter shall not apply to the following activities: (1) ... (2) ... (3) Such minor land - disturbing activities as home gardens and individual home landscaping, repairs, maintenance work, fences, and other related activities which result in minor soil erosion; Without going further into the rules, the state rules we enforce as the LIA do not authorize us to require an erosion plan as a permit requirement but they do allow us to require they be presented during construction as proof of suitable design. I will leave the interpretation of the City's code to your department. Due to rains and water table and wetness of the ground the tree company has left these ruts on the property I think is 1316 6th Ave. Contractor said he would be repairing the ruts. The photo's speak for themselves as the wetness and conditions go. However no soil cloth installed nor any BMP's in place as required unless there has been a change with the land disturbance ordinance and I may not have gotten the memo on. Swimming pool requirements and placement. All swimming pools shall comply with the following requirements: (A) Application for a permit to construct a swimming pool must be submitted to the building official. The structural plans must be approved by the building official prior to the issuance of a permit and the beginning of construction and/or excavation. A drainage plan prepared by a registered professional engineer is required. The drainage plan will be reviewed by the City Engineer. (B) Swimming pools and supporting electrical and mechanical equipment may be located in either the side or rear yard and • ' • .. ' . _ .. shall be at least five feet from the property line. (C) Swimming pool construction must meet all requirements of the state Swimming Pool Code. (D) All swimming pools must be confined within a fenced area. The fence must be a minimum of four feet in height and all gates must be lockable, self closing, and self latching. Fencing material e,hall have no opening larger than six inches in diameter. Removal of any required equipment maintained and kept in good and working order. Once a swimming pool and its accessories have passed a final inspection it shall be a violation of this ordinance to remove or alter any of the equipment that is required by: the International Residential Code — Appendix G, the International Building Code — Section 3109, the National Electrical Code, and the Georgia State Amendments. Failure to maintain the safety related and/or electrical equipment in good and working order shall constitute a violation of this ordinance. (E) No swimming pools shall be placed across, on, or beneath any utility easements nor shall any utility easement be granted which bisects a swimming pool. (F) When a swimming pool, its deck, or other accessory to a swimming pool is proposed for construction on a site that has already been improved, the swimming pool plans and permit application will be reviewed by the City Engineer. (a) If there is an approved drainage plan for the site the City Engineer will review the plans for the swimming pool, deck and accessory structure to ensure that the proposed improvements will not materially affect the drainage of the site. If they will materially affect the drainage of the site the applicant will have to have a drainage plan prepared by a design professional before a permit for the swimming pool, deck or accessory will be issued. (b) If the site was improved without a drainage plan, the City Engineer will review the pool plans and permit application to ensure that the swimming pool, deck or accessory structure will not increase the amount of run -off leaving the site.
