Reneé-thank you for your email below and the attachment. I am looking, specifically, for all applications and plans made
by Mr. Martin or Mr. Weitsma, his agent for the referenced property in Hidden Harbour.
I believe that Mr. Martin purchased the property in February 2015. I am assuming that his applications began around
that time; and that he submitted the plans either before or after his acquisition. That said, I am only looking for the
plans, communications, agendas, expert reports and anything else that should be in the file relative to this property. In
this connection, I or one of my people will come in and review the file.
Can you let me know when you can have the file out and ready for inspection? If you need anything further, I would
appreciate it if you could make a telephonic inquiry, as I'm not sure that a "pen-pal" relationship will do much more than
what I said in my original request and above.

Thank you for your $250 facilitation fee pursuant to the Settlement Agree ment dated December 12,
2018. Once the facilitation fee is received in the mail, and you provide clarification as requested
below, the Town will process your public records request.
With respect to your request for records “regarding improvements installed or requested to be
installed” please provide additional information regarding the improvements to which you refer.
This could include a time range, or any additional information regarding the improvements that will
help the Town respond to your public records request.
Upon receipt of your facilitation fee and clarification, the Town will endeavor to further respond.

In your clarification, you state that the records you seek are the plans, communications, agendas,
expert reports and “anything else” that should be in “the file” relative to applications and plans made
for the property located at 12 Hidden Harbour Drive, owned by Marcia Martin and William Martin,
Jr. The Town’s records that consist of the Town’s “file” on this property are located in the Land File
and the Architectural Review File, both of which are publicly available on the Town’s website. Go
to www.gulf-stream.org, then click on “I want to” and then “Find a Town Record”. From there, for
the Land File, click on Building Department, then Land File, then Address, then Hidden Harbour Dr.,
then 12; or for the Architectural Review File, click on Architectural Review, then Properties by
Address, then Hidden Harbour Dr., then 12 Hidden Harbour Dr. – Martin. In both the Land File and
Architectural Review File are various subfolders that are the Town’s file on this property, which
consists of approximately 750 pages of various documents, including plans, communications and (if
applicable) expert reports. You have specifically indicated that you also seek agendas relative to the
property. The property went through a Level III Architectural/Site Plan Review and the agendas of
the ARPB and Town Commission relative to that approval are attached. If you would also like the
meeting minutes relating to each of the attached agendas, please let us know. Please be advised that
the production of records above was billed at the rate of $30.58 per hour for 15 minutes, for a total of
$7.65.
If the Town does not hear back from you within 30 days of this letter, we will confirm our final
determination of the costs associated with responding to this public records request and refund
the remainder of your Facilitation Fee in accordance with the Settlement Agreement. If this
response and more than 750 pages of records concludes your request, please let us know and we
will promptly refund the remainder of your Facilitation Fee.

Renee – thank you for your email.
Please confirm that all response documents can be found by following the “treasure map” attached. Incidentally,
following the map is not responsive to the request. That said, I will not discuss that further at this time; except to
remind you that I wanted to come in and look at the documents, which you are apparently refusing me to do so.
Further to your letter, please explain your charge, as I’m not grasping it. Also, please explain the rate.
Lastly, you say the Agendas are attached. They are not.
Renee, why is it that I get the impression that the Town is playing with me?
I await your prompt response. In that connection, if you have any questions, it would be much more efficient to call and
discuss, after which you could follow up with a letter.

The Town of Gulf Stream received your public record request on February 6, 2019 and subsequent
clarification on February 7, 2019. Your request can be found at the following link:

On February 19, 2019, after providing you with 700+ pages of records, we asked for clarification as
to what additional documents you were seeking and noted that if the Town did not hear back from
you within 30 days, we would confirm our final determination of costs associated with responding to
this public records request and refund the remainder of your Facilitation Fee, in accordance with the
Settlement Agreement.
In accordance with the previously mentioned Settlement Agreement, determination of the costs
associated with this request are .25 hours of administrative support at $30.58 per hour, the labor
cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d).
(.25 hours @ $30.58 = 7.65) = 7.65
You provided the Town with the $250.00 Facilitation Fee, thus the Town is providing you with a
refund of $242.35.
