HomeMy Public PortalAboutRES-CC-2000-05Resolution #05-2000 A RESOLUTION APPROVING THE INTERLOCAL AGREEMENT FOR THE COORDINATION OF NORTH CORRIDOR PLANNING BY AND BETWEEN GRAND COUNTY AND THE CITY OF MOAB WHEREAS, the Interlocal Cooperation Act, Title 11-13-1 et seq , Utah Code Annotated, 1953, as amended allows government entities to enter mto agreements that benefit the mhabitants of said governmental entities, and WHEREAS, Grand County and the City of Moab have found that it is to the mutual benefit of the citizens and inhabitants of Grand County and the City of Moab for Grand County and the City of Moab to coordmate planning efforts for the North Comdor, and WHEREAS, the Interlocal Agreement for the Coordmation of North Comdor Planning by and between Grand County and the City of Moab has been presented to this meetmg of the Moab City Council NOW, THEREFORE, we, the Governing Body of the City of Moab do hereby resolve to approve the Interlocal Agreement for the Coordination ofNorth Comdor Planning m substantially the form presented to the meetmg of the Moab City Council, and direct the appropriate parties to execute and deliver stud Agreement This resolution shall take effect immediately upon passage Passed and adopted by action of the Govemmg Body of the City of Moab m open session this 28111day of March, 2000 CITY OF MOAB By < gf,a,/t?zelkfflairX- Karla R Hancock Mayor Attest Rachel Ellison City Recorder North Comdor Planning Interlocal Ayeement Resolution tease I of I INTERLOCAL AGREEMENT,_ FOR THE COORDINATION OF NORTH CORRIDOR PLANNING BY AND BETWEEN: GRAND COUNTY AND THE CITY OF MOAB Pursuant to the Interlocal Cooperation Act, Title 11-13-1 et seq , Utah Code Annotated, 1953, as amended, and for the mutual benefit of the citizens and inhabitants of Grand County, State of Utah, a body politic and corporate [hereinafter referred to as "COUNTY, and of the citizens and inhabitants of the City of Moab, State of Utah, a body politic and corporate [hereinafter referred to as "City'[, the COUNTY and the CITY hereby agree as follows A. General Purposes. The general purposes for this Agreement are to 1 Recognize the possibility of eventual annexation of all properties in the Study Area to the City of Moab, 2 Fund joint planning for the North Highway 191 Comdor from the Arches National Park entrance to the City of Moab, 3 Protect pnvate property nghts and avoid unreasonable developer delays, 4 Ensure that the same land uses are allowed and the same development standards apply, regardless of the lunsdiction in which development occurs, 5 Protect the overall public health, safety, and general welfare through improved govemmental coordination, 6 Promote the economic provision of public facilities and services, and 7 Guarantee consistent construction standards for all public improvements B. Specific Goals Specific joint planning goals to be accomplished pursuant to this Agreement, include 1 Agreement on a Future Land Use Plan for the Study Area, 2 Development of a uniform set of zoning standards, including design standards, to be adopted by both jurisdictions C. Interim Development The Parties agree that dunng the term of this Agreement, each party shall 1 Continue to process development applications in accordance with the adopted standards and procedures of the junsdictional govemment, with reasonable referral to and opportunity for comment by the other govemmental party, 2 Require all new pnvate development to satisfy the Moab City Design Standards and Public Improvement Specifications, September 1999, for public improvements, 3 Provide City of Moab water and sewer service commitments to developments in the North Comdor Study Area, as appropnate, pursuant to negotiation of a pre -annexation agreement between the City and the developer and subject to assumption of all associated costs by the benefiting developer, and 4 Avoid processing delays for applicants D Applicability — North Corridor Study Area This Agreement shall be binding on each signatory with respect to development in the North Corridor Study Area and shall apply to properties that are either located entirely within, or are partially located within said Study Area Page 1 Interlocal City of Moabrand County Agreement [March 2000] E. Definitions For purposes of this Agreement 1 Development means the physical extension and/ or construction of urban land uses Development activities include subdivision of land, change in the intensity of use of land, construction, reconstruction, demolition or partial demolition or alteration of buildings, roads, utilities, and other facilities, and the installation of culinary water or septic systems 2 Developer means any public or pnvate person, partnership, association or agency that prepares raw land for the construction of buildings or causes to be built physical building space for use pnmanly by others, dunng which preparation the land or the creation of the building space is in itself a business and is not incidental to another business or activity 3 Public improvements mean all construction work, such as street grading, street paving, storm sewers, curb and/or gutter work, sanitary sewers or water mains performed by the property owner, developer or contractor F. Funding of the North Corridor Plan. The parties agree to 1 Jointly fund the North Comdor planning effort on an equal (50/50) basis up to a maximum cost of $14,000, 2 The City of Moab shall pay its $7,000 share to the County within five (5) business days of the signing of this agreement by both parties, and 3 If the planning effort ultimately proves to cost less than $14,000, then the parties shall evenly divide the remainder G Management of the North Corridor Planning Project The parties agree that the County Administrator/ City Manager Jointly responsible for the management of the North Comdor planning effort and associated contracts EFFECTIVENESS AND DURATION OF AGREEMENT This Agreement shall become effective immediately upon its approval by the County Council and the Moab City Council, as evidenced by its execution by appropnate County and City officials, and upon approval by the County and City Attomeys This Agreement shall remain in effect for six months, and thereafter, the Agreement shall remain in effect until 30 days after either party gives a notice of termination SEVERABILITY If one (1) or more provisions of this Agreement shall be invalid, illegal or unenforceable in any respect, the remaining provisions contained herein shall not in any way be affected or impaired thereby PARAGRAPH CAPTIONS The captions of the paragraphs are set forth only for the convenience and reference of the parties and are not intended in any way to define, limit or descnbe the scope or intent of this Agreement Page 2 Interlace!
