HomeMy Public PortalAboutOrd. 1581-- - ORDINANCE NO. 1581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CERTAIN PROVISIONS OF SUBSECTIONS 4 -6.5 AND 4 -7.9 OF THE LYNWOOD MUNICIPAL CODE FOR THE PURPOSES OF PROVIDING EXEMPTIONS FROM THE PAYMENT OF BUSINESS LICENSE FEES FOR CERTAIN ENTERTAINER / PERFORMERS AND RECREATION INSTRUCTORS WHEREAS, Lynwood Municipal Code (the "Code'') Section 4 -6 et seq requires that all persons carrying on any business, trade, profession or occupation within the City of Lynwood obtain a business license, except as expressly exempted, and WHEREAS, the City Council of the City of Lynwood (the "Council ") finds and concludes that the application of the licensing requirements of Section 4 -6 et seq. of the Code to certain classes of businesses does not serve the interest of the City because of the transitory, brief, or minimal impact nature of these activities; and WHEREAS, the Council has determined that it is in the public interest to exempt occasional entertainers /performers who are engaged by the City to provide entertainment at City - sponsored events from the business license requirements because of the limited nature of the commercial _—activity- involved - and-to enhance the City :s ability -to engage qualit) entertainment -for City- — ` sponsored events, and WHEREAS, the Council has determined that it is in the public interest to exempt special interest class instructors who are engaged by the City to conduct recreation classes from the business license requirements because of the limited nature of the commercial activity involved and to enhance the City's ability to engage and retain instructors who provide a variety of recreational opportunities which enrich the quality of life of the residents of Lynwood; and WHEREAS, the Council also wishes to make certain modifications to the City's business licensing requirements for ease of administration. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS FOLLOWS: Section 1. That Subsection 4 -6.5.e of Chapter 4 of the Code of the City of Lynwood is hereby repealed it its entirety Section 2. That a new Subsection 4 -6.5.e of Chapter 4 of Code of the City of Lynwood is hereby adopted to read as follows: 4 -6.5.e Specified performers and entertainers at City- sponsored events: Nothing in this chapter shall be construed to require payment of a business license fee by any performer or entertainer engaged by the City to provide entertainment at seasonal /occasional City - sponsored events, provided that such performers or entertainers have no fixed place of business in the City and are not otherwise engaged in the business of providing entertainment for profit- making purposes in the City Section 3. That a new Subsection 4 -6.5.f of Chapter 4 of Code of the City of Lynwood is hereby adopted to read as follows: 4 -6.51 Recreation Instructors: Nothing in this Chapter shall be deemed or construed to require the payment of any business license tax prescribed in this Chapter by any person engaged in the business of recreation instruction for programs or activities conducted or sponsored by the -City - - -- _ Section 4. That a new Subsection 4 -6.5.g of Chapter 4 of Code of the City of Lynwood is hereby adopted to read as follows: 4 -6.5.g Revocation Of E.vemption: At any time that it shall appear to the satisfaction of the granting authority that any of the conditions of this Chapter meriting exemption from license requirements do not exist as to any person to whom the exemption has been allowed, the granting authority may revoke the exemption and the license issued. Section 5. That Subsection 4 -7 9.e.1 of Chapter 4 of the Code of the City of Lynwood is hereby repealed it its entirety Section 6. That a new Subsection 4 -7 9.e.1 of Chapter 4 of Code of the City of Lynwood is hereby adopted to read as follows: 4- 7.9.e.1. ENTERTAINMENT: For each person conducting or operating an act of entertainment for profit - making purposes: (a) Per year To be established by resolution. (b) Semi - annually To be established by resolution. Section 7. If anv section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City — Council- hereby declares that it would have passed-each section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional. Section 8. This Ordinance shall take effect thirty (30) days after its final passage by the City Council. Section 9.
