Contractors who perform renovation, repairs, and painting jobs in pre -1978 housing and child- occupied facilities must, before beginning work, provide owners, tenants, and child -care facilities with a copy of EPA's lead hazard information pamphlet Renovate Right: Important Lead Hazard information for Families, Child Care Providers, and Schools. Contractors must document compliance with this requirement. After April 22, 2010, federal law will require you to be certified and to use lead -safe work practices. Projects must be done by a Certified Lead Renovation Firm AND a Certified Renovator When disturbing lead -based painted or coated surfaces or components more than 6 ft2 per interior room or 20 ft2 of exterior surfaces AND all window replacements and partial demolitions of any size. * * * * * * * * * * * * * * * * * * * ** Asbestos /Environmental Notification to Georgia EPD for Projects Involving Demolition, Wrecking, or Renovation The undersigned hereby acknowledges that the issuance of this permit does not in any way grant permission to the owner, owner's representative, or permit holder to proceed with demolition, wrecking, or renovation of a structure prior to the filing of any required ten (10) day "Project Notification for Asbestos Renovation Encapsulation or Demolition" form in accordance with the Georgia Asbestos Rules. The Georgia Environmental Protection Division administers the rules. In most cases, the rules require both the owner and the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the building. Further guidance for regulatory compliance and contact telephone numbers are provided by the brochures entitled Asbestos & Renovation and Asbestos and Demolition. Other environmental issues such as asbestos removal techniques, lead abatement, ground contamination, or unusual site conditions may have EPD regulations that could affect the project. * * * * * * * * * * * * * * * * * * * ** BMPs While BMP deficiencies are not necessarily the fault of the owner or his agent, BMPs are their responsibility. Two areas of deficiencies are in the most basic and common BMPs; Co — Construction Exit and Sd1 — Sediment Barrier. Staff of the Coastal Management Program reviewed the above referenced application pursuant to Section 404 of the Clean Water Act and/or Section 10 of the River and Harbors Act of 1899 for consistency with the Georgia Coastal Management Program (GCMP). The Program concurs with the applicant's consistency certification. This ensures that the proposed project has been designed to comply with the applicable enforceable policies of the GCMP. Please find enclosed a fully executed Revocable License relative to the modification and maintenance of a private, single - family residence recreational dock facility. This license serves as authorization to utilize State owned tidal water bottoms for your dock facility as per the location, dimensions, and configuration depicted in your application for such license. Your modified project will consist of adding a new 6' x 60' walkway, 3' x 20' ramp, and new 9.5' x 60' floating dock to the existing 6' x 247' walkway and 20' x 20' covered and screened fixed deck. The dock will be constructed 135' from the extended property line to the left and approximately 170' from the extended property line to the right of the structure. The entire project extends approximately 35' into the waterway at a point where the waterway is approximately 282' wide at mean low water. The height of any covered area cannot exceed 12' from the lowest part of the decking on the facility. No construction materials or debris may be placed, disposed of or stored in jurisdictional areas. Any incidental impacts associated with this project must be rectified by fully restoring areas to their pre - construction topographic and vegetative states. Any change in the use, location, dimensions, or configuration of the approved facility, without prior notification and approval from this office, could result in the revocation of this license and in required removal of the facility. This dock facility must be constructedprecisely to the approved location, dimensions, and confizuration as depicted in the drawings provided. The facility, for which these authorizations are issued, shall not be used at any time for business or commercial purposes. Prohibited uses include, but are not limited to, liveaboards, leasing of the permitted dock space; docking a commercial fishing vessel of any type; and utilization of the clock facility in any tour boat or charter fishing boat activities. The use of this facility for other than private, single- family, recreational purposes will result in the immediate revocation of the license and in required removal of the entire facility from state -owned property, and possible criminal and civil penalties as provided by law. Off - street parking facilities shall be provided and maintained on site for all buildings, structures or premises being used in whole or in part for residential purposes, or for any other use permitted in residential districts. (1) Residential dwelling units. For every dwelling unit, there shall be provided at least two off - street parking spaces. A caretaker's cottage is a separate dwelling unit and shall be provided at least two off - street parking spaces. (2) Nursing homes, hospitals. One parking space for each five patient beds, plus one space for each staff doctor, plus one space for each employee on the largest shift. (3) Theaters, auditoriums, gymnasiums and other places of assembly. One parking space for each four seats provided in the main auditorium or for each 50 square feet of floor area available for the accommodation of movable seats in the largest assembly room or area. (4) Public and private elementary and secondary schools (except assembly halls, auditoriums and gymnasium used in conjunction therewith). One parking space for each 200 square feet of gross floor area devoted to such use. (5) Private docks. At least two off - street parking spaces must be provided for any private dock proposed for construction on a lot that has not been otherwise improved. In the event that a private dock is proposed on a lot that has not been improved, the parking must be off- street (not on city right -of -way) and pervious. j,,( +Ss - pv- Ubba o - S- 2.3-14. Control of access to structures used for residential purposes including but not limited to single family, duplex, triplex, two family, multifamily, townhomes, apartments, time shares, and condominiums whether owner occupied or held for rental. In order to promote the safety of motorists and pedestrians, the following regulations shall apply to all newly constructed driveways: (1) A driveway opening which connects a lot with a public street shall not be greater than 25 feet in width at the property line. Driveways that serve duplex lots shall not have a width greater than 15 feet per unit measured at the property line. This section is not intended to prevent the installation of flared driveway ends. These flared ends, when constructed in accordance with adopted standards and specifications, shall not count towards the width of the driveway. (2) There shall be no more than two driveway openings on any lot of any width. The total of the widths at the property line of two driveway openings shall not be greater than 25 feet. (3) No driveway opening shall be constructed within 25 feet of an intersection, measuring from the nearest improved portion of the right -of -way. However, in any instance where there is not adequate space available and other access is not feasible, staff may permit a reduction in the distance to an intersection from a driveway in order to permit safe access to the property provided the speed limit on abutting or adjacent roads is 30 miles per hour or less. (4) No curb on any city street or right -of -way shall be cut or otherwise altered without prior written approval of the designated city official. (5) All newly constructed and replacements of more than 50 percent of existing driveways serving residential uses shall be constructed of materials designed to allow retention of the first one -inch of stormwater. Commercial off - street parking. Off- street parking facilities shall be provided and maintained for all structures or premises being occupied or used in whole or in part for commercial activity as follows: (1) One parking space per each 200 square feet of retail or commercial gross leasable floor area. This subsection is intended to supplement and expressly not repeal existing provisions of Tybee's Code of Ordinances relating to permits required for construction, relating to building permits, regarding wetlands protection, regarding beach dune or vegetation disturbance. All those individuals engaged in the construction or repairs of docks, walkways, marinas or marine facilities, or any other structure on or over coastal marshlands as defined in O.C.G.A. § 12 -5- 282(3) shall, prior to the commencement of any such construction, preparation or work provide to the City of Tybee Island evidence of liability insurance and /or bonds and /or letters of credit specifically covering environmental and other damages. Such applicant shall also provide for coverage and /or bonds and /or letters of credit in the nature of a performance bond requiring the completion of the work if it is not performed in accordance with the anticipated completion schedule filed with the city and shall further include the cost of removal of any equipment, debris or materials of any nature not removed by the dockbuilder. When a bond or letter of credit is used for the purposes described herein such bond or letter of credit shall be issued to the benefit of either the City of Tybee Island or the owner of the property depending upon the circumstances and the building official of the city shall be authorized to determine to whom the bond or letter of credit should be payable. The amount of insurance, bond, or letter of credit shall be based on the nature, scope and cost of the anticipated work and shall take into consideration the potential consequences of spills, removal of equipment, debris or materials and other risk and shall be in such amount as is set by the building official of the city or his designee. Including but not limited to fuel spills, fires, submersions of equipment and building supplies, etc., all dockbuilders shall be required to report any accidents, casualties or events which occur in connection with activities provided for in this subsection and which are likely to cause damage or which may cause damage to property, persons, the environment or coastal marshlands and in no event shall the responsible party wait more than two hours after the occurrence of such event, casualty or occurrence.
