AUTHORIZING THE EXECUTION OF A DEVELOPER'S
AGREEMENTl200 i1HLIK STREET, LLC
WHEREAS, 200 Milik Street, LLC ( "Milik Street ") is the owner of property located at
200 Milik Street in the Borough of Carteret, New Jersey and designated as Lot 10 in
Block 49.1 on the Tax Maps of the Borough of Carteret (tire "Property "); and
WHEREAS, the Planning Board of the Borough of Carteret (the "Board ") by resolution
adopted January 25, 2012, granted the Developer preliminary and final site plan approval
with related variance relief, to permit the construction of a warehouse distribution center,
with ancillary offices on the Property (the "Project "), and which Board approval was
subject to Borough of Carteret (the "Borough ") and Milik Street entering into a formal
developer's agreement with regard to the deferral of certain potential parking obligation
requirements engendered by the Project; and
WHEREAS, the Borough and Milik Street are desirous of entering into a formal
Developer's Agreement setting forth the Parties respective rights and responsibilities with
regard to the above referenced approval(s).
NOW THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of
Carteret, County of IvEddlesex, State of New Jersey as follows:
1. ' That the Law Director is hereby authorized to negotiate a formal
Developer's Agreement with Milk Street consistent with the Board
approval for the Project.
2. That the Law Director is hereby authorized to execute said Developer's
Agreement in a form acceptable to trim.
