HomeMy Public PortalAbout2018-044 Resolution Approving the Final Plat of Woods of MedinaMember Martin introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2018-44 RESOLUTION APPROVING THE FINAL PLAT OF WOODS OF MEDINA WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, 4412 JKP LLC (the "Applicant") has made an application for a subdivision of land (the "Property") legally described as: That part of the South 30 acres of the Northwest '/ of Section 1, Township 118 North, Range 23, West of the 5th Principal Meridian, lying West of the East 1760 feet, EXCEPT the West 534 feet of the South 217.5 feet thereof, and further EXCEPTING that part lying West of a line drawn parallel with and distant 40 feet East of the West line thereof. and The West 534 feet of the South 217.5 feet of the Northwest '/ of Section 1, Township 118 North, Range 23 West of the 5th Principal Meridian, except the West 40 feet thereof; and WHEREAS, in Resolution 2014-04, the City granted approval to the Applicant for a preliminary plat to allow the future platting of property as residential development with 16 residential units; and WHEREAS, the Applicant intends to sell the Property to another party who is anticipated to carry forward with the development of the Property subject to the conditions described herein; and WHEREAS, the Applicant or its successor in title, whichever carries through with development of the Property, is referred to herein as "the Developer"; and WHEREAS, the City Council reviewed the final plat at the July 17, 2018 meeting; and WHEREAS, the City Council has found that, subject to the terms and conditions contained herein, the final plat is substantially consistent with the approved preliminary plat and the requirements of the City's subdivision regulations. Resolution No. 2018-44 July 17, 2018 NOW, THEREFORE BE IT RESOLVED, by the City Council of Medina, Minnesota that final approval is hereby granted for the plat of Woods of Medina, subject to the following terms and conditions: 1. The Developer shall enter into a development agreement in the general form of that presented to and approved by the City Council at its July 17, 2018 meeting and dated July 12, 2018. Said agreement includes the requirements described below as well as other relevant requirements of City ordinance and policy, and the final version thereof shall be subject to final review and approval of the City Attorney. The Mayor and City Clerk are authorized to execute the plat and release for recording at Hennepin County only after the development agreement has been executed by both the City and the Developer. 2. All comments from the City Engineer in the letter dated July 11, 2018 shall be addressed. 3. Final homeowner association documents shall be reviewed and approved by the City Attorney. The documents shall address zoning, all required maintenance, private open space, storm ponds, wetlands, upland buffers, buffer yards, landscaping, common open space, irrigation, and point of sale requirements. 4. The Developer shall provide the City a letter of credit as required by City ordinances to ensure completion of the proposed subdivision improvements. 5. The Developer shall install the improvements within the property as shown on the plans dated July 3, 2018, except as modified herein. 6. The Property shall be subject to current City regulations related to lawn and landscaping irrigation. Irrigations systems with the subdivision shall not be connected to the City Water Supply System. The Applicant and Developer shall disclose this prohibition to any potential buyer. 7. The Developer shall provide upland buffer easements and install vegetative upland buffers adjacent to wetland as well as required signage consistent with the City wetland preservation ordinance. 8. The Developer shall provide tree replacement in the amount of 1,635 inches subject to the submission of revised information. 9. The Developer shall provide cash -in -lieu of parkland dedication in the amount of $96,160 subject to revised information. 10. The Developer shall meet all conditions of the Wetland Replacement Plan. 11. The Shawnee Road right-of-way vacation as approved through Resolution 2014-02 shall be effectuated immediately before recording the plat. Resolution No. 2018-44 2 July 17, 2018 12. All comments by the City Attorney related to title issues and recording procedures shall be followed. 13. This final plat shall be recorded within 180 days of the date of this resolution or this approval shall be considered void, unless a written request for a time extension is submitted by the Applicant within said 180 days and approved by the City Council for good cause. The Developer shall obtain necessary approvals and permits from the Elm Creek Watershed, Hennepin County, the Minnesota Pollution Control Agency, the Minnesota Department of Health, the Metropolitan Council, and other relevant agencies. 14. All fees incurred by the City regarding the processing and review of this application shall be paid by the Applicant, including the drafting and review of relevant agreements and documents and the review of construction plans.
