HomeMy Public PortalAboutM 2011-10-18 - CCLYNWOOD CITY COUNCIL REGULAR MEETING October 18, 2011 The City Council of the City of Lynwood met in a regular meeting in the Council Chambers, 11330 Bullis Road on the above date at 5:05 p.m. Mayor Castro presiding. Council Members Flores, Rodriguez, Santillan -Beas, Morton and Castro were present. Also present were City Manager Haley, City Attorney Galante, City Clerk Quinonez and City Treasurer Alatorre. City Clerk Quinonez announced that the Agenda had been duly posted in accordance with the Brown Act. Item #6. PRESENTATIONS /PROCLAMATIONS Sheriff Captain James Hellmold — Update on Law Enforcement Issues Lieutenant Chavez reported that there was a theft of a water meter in front of a residence. He stated that community members reported the license number of the suspects and police now have the suspects in custody. He encouraged community involvement to deter and help stop crime. He also reported that people in one home on the 3600 block of Virginia Street were accosted at gun point last week and all suspects are currently in custody. He stated that the Department is also working with the City Code Enforcement Officers. He reported that Reserve Forces Bureau will conduct anti - cruising and prostitution sweeps, free of charge to the City. He reported that for the last two weeks the Department has sent patrols to Ham Park and Lynwood Park. He advised community members to stay alert, try to walk in pairs and to not use both ear buds in order to avoid being a target for crime. Lastly, Lieutenant Chavez announced that Captain Hellmold was promoted to Commander and he introduced the new Captain, Joseph Gooden. Captain Gooden thanked the Council for their support and stated that he was eager to see the City's partnership with the Sheriffs Department grow. City Council Members Reporting on Meetings Attended (Gov. Code Section 53232.3(D)) Mayor Pro Tern Morton stated that there have been 30 cases of West Nile Virus and two people have died. He stated that he attended the celebration at the grand opening of the new Martin Luther King Jr. Hospital and he commended Supervisor Mark Ridley- Thomas for a great job in starting the hospital up again. He stated that the League of California Cities has decided to form committees to produce report cards on State Officials to rate whether they are voting for the community or for special interests. He stated that he is on that committee and very proud to be on it. Item #7. COUNCIL RECESS TO: LYNWOOD REDEVELOPMENT AGENCY 5:16 p.m. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) Rabai Parrott commented on Item #17 — LYNWOOD AFRICAN AMERICAN ADVISORY COUNCIL — REQUEST FOR USE OF BATEMAN HALL. She asked for the Council's support of the Lynwood African American Advisory Council's request. Harry Gibbens commented on Item #12 — AMENDMENT TO THE CAPITAL IMPROVEMENT PROGRAM FOR FY 2011 -12. He stated that he did not understand Exhibit B and asked for clarification. Mayor Castro asked the City Manager to make sure Mr. Gibbens received an explanation from staff. Natalia Reynoso stated that she was a senior at Marco Antonio Firebaugh High School and asked for the Council's financial support to help her join the USA Softball Team in Germany. She provided an information packet to the City Clerk. The City Clerk read a letter from Lorene Reed regarding Item #17 — LYNWOOD AFRICAN AMERICAN ADVISORY COUNCIL — REQUEST FOR USE OF BATEMAN HALL. Ms. Reed asked the Council not to support the request. The City Clerk read a letter from Jeanne Mims regarding Item #17 — LYNWOOD AFRICAN AMERICAN ADVISORY COUNCIL — REQUEST FOR USE OF BATEMAN HALL. Ms. Mims asked the Council not to support the request. Mayor Castro stated that the Lynwood African American Advisory Council is the group that has been working within the school district. PUBLIC ORAL COMMUNICATIONS Paulette Bradley asked Council for their support of Item #17 — LYNWOOD AFRICAN AMERICAN ADVISORY COUNCIL — REQUEST FOR USE OF BATEMAN HALL Lorena Genovez asked the Council for their help with two parking tickets she has gotten outside of her daughters school. She also asked that the City request that the schools provide space for parents to pick up their children safely. Mayor Castro clarified that the City does not have jurisdiction over the schools and if parents conduct a petition, they should address it to the school district. She also asked a parking enforcement officer to work with Ms. Genovez in regards to the citation process. Tracy Kellog made a comment in response to the letters read by the City Clerk and in support of the Lynwood African American Advisory Council. She stated that the Lynwood African American Advisory Council has done a lot of work for students in the City. Dorothy Pruitt stated that the Lynwood African American Advisory Council was looking for community partnership in order to help Lynwood kids. Bianca Hildreth asked the Council for their support in letting police officers know that they also have to abide by traffic laws. She stated that she was almost killed by a police officer who ran a stop sign. CONSENT CALENDAR It was moved by Council Member Rodriguez, seconded by Mayor Castro, to approve the consent calendar and receive and file staff reports. Mayor Pro Tern Morton pulled Item #8 — MINUTES OF PREVIOUS MEETINGS: Regular Meeting — October 4, 2011 Mayor Pro Tern Morton stated that his council oral statement on the minutes of October 4, 2011 had two errors. He asked that the words "pick up" be inserted in the first sentence and that the words "the bands" be changed to "divans ". It was moved by Mayor Pro Tern Morton, seconded by Council Member Flores, to make the two corrections to the October 4, 2011 minutes. APPROVAL OF THE WARRANT REGISTER RESOLUTION NO. 2011.228 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ALLOWING AND APPROVING THE DEMANDS AND WARRANTS THEREFORE Item #10. APPROVAL OF THE WARRANT REGISTER FOR COMMUNITY DEVELOPMENT DEPARTMENT (FORMERLY LRA) RESOLUTION NO. 2011.229 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ALLOWING AND APPROVING THE DEMANDS AND WARRANTS THEREFORE Item #11. City Attorney Fred Galante pulled Item #11 — ADOPTION OF SPECIFICATIONS AND WORKING DETAILS FOR THE TRAFFIC SIGNAL IMPROVEMENT PROJECT, PROJECT NO. 4011.67.988 RELOCATION OF THE TRAFFIC SIGNAL AT MARTIN LUTHER KING JR. BLVD. AND FERNWOOD AVENUE City Attorney Fred Galante stated that the resolution included in the agenda packet had a misprint. He stated that the streets are listed as Martin Luther King and Fernwood but instead it should read as Martin Luther King and Alameda. He stated that the rest of the agenda item is accurate. Mayor Castro said that the change would be noted and the item would be passed by the consent calendar vote. RESOLUTION NO. 2011.230 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, ADOPTING THE CONTRACT DOCUMENTS AND WORKING DETAILS FOR THE TRAFFIC SIGNAL IMPROVEMENT PROJECT, PROJECT NO. 4011.67.988; RELOCATION OF THE TRAFFIC SIGNAL AT MARTIN LUTHER KING JR. BLVD. AND FERNWOOD AVENUE AND AUTHORIZING THE DEPARTMENT OF PUBLIC WORKS TO SOLICIT BIDS THROUGH THE INFORMAL BID PROCESS Item #12. Council Member Santillan pulled item #12 — AMENDMENT TO THE CAPITAL IMPROVEMENT PROGRAM FOR FY 2011 -12 Council Member Santillan asked Public Works Director Dan Ojeda what the cost listed in the agenda item included and when the project would go out to bid. Mr. Ojeda responded that it was a total project cost including design, construction, and inspection and he was not sure when the bid would go out but would respond by green memo. It was moved Council Member Santillan, seconded by Council Member Flores, to approve the item. RESOLUTION NO. 2011.231 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING THE BUDGET FOR THE CAPITAL IMPROVEMENT PROGRAM FOR FY 2011 -12 AYES: COUNCIL MEMBERS FLORES, RODRIGUEZ, SANTILLAN -BEAS, MORTON AND CASTRO NOES: NONE ABSTAIN: NONE ABSENT: NONE Item #13. CONSTRUCTION CONTRACT AWARD FOR FOUR POCKET PARKS CONSTRUCTION PROJECT; PROJECT NO. 4011.67.867 RESOLUTION NO. 2011.232 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AWARDING A CONTRACT TO ARC - ACCUCON CONSTRUCTION INC. AS THE LOWEST RESPONSIBLE BIDDER IN THE AMOUNT OF $495,533.06 FOR THE FOUR POCKET PARK CONSTRUCTION PROJECT; PROJECT NUMBER 4011.67.867 AND AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT AGREEMENT Item #14. APPROVAL OF AN AGREEMENT TO CONTINUE PROVIDING CONSULTING SERVICES REGARDING PROJECT RELATED SOIL CONTAMINATION FOR THE LYNWOOD REDEVELOPMENT AGENCY RESOLUTION NO. 2011.233 ENTITLED: A JOINT RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY OF THE CITY OF LYNWOOD AND THE CITY OF LYNWOOD APPROVING THE AGREEMENT BETWEEN COX, CASTLE, NICHOLSON, LLP AND THE LYNWOOD REDEVELOPMENT AGENCY FOR CONSULTING SERVICES REGARDING PROJECT RELATED TO SOIL CONTAMINATION NOT TO EXCEED $240,000 Item #15. CONSIDERATION AND APPROVAL OF THE CITY OF LYNWOOD TRANSFERRING BACK PROPERTY TO THE LYNWOOD REDEVELOPMENT AGENCY RESOLUTION NO. 2011.234 ENTITLED: A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AND THE LYNWOOD REDEVELOPMENT AGENCY APPROVING QUIT CLAIMS TRANSFERRING BACK PROPERTIES FROM THE CITY OF LYNWOOD TO THE LYNWOOD REDEVELOPMENT AGENCY NEW /OLD BUSINESS Item #16. REVIEW OF FY 12 FIRST QUARTER BUDGET, ADJUSTMENTS TO THE FY 11 AND FY 12 BUDGETS Assistant City Manager Robert Torrez introduced the item regarding the review of the FY 12 first quarter budget and adjustments to the FY 11 and FY 12 budgets. Mayor Castro requested that staff go after State funds for shovel ready projects. It was moved by Council Member Flores, seconded by Council Member Rodriguez, to approve staff recommendation. AYES: COUNCIL MEMBERS MORTON AND CASTRO NOES: NONE ABSTAIN: NONE ABSENT: NONE FLORES, RODRIGUEZ, SANTILLAN -BEAS, RESOLUTION NO. 2011.235 ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE PROPOSED BUDGET ADJUSTMENTS AND HEREBY AMENDING THE CITY'S ADOPTED FISCAL YEAR 2010 -2011 OPERATING BUDGET AND ADOPTED FISCAL YEAR 2011 -2012 OPERATING BUDGET Item #17. LYNWOOD AFRICAN AMERICAN ADVISORY COUNCIL — REQUEST FOR USE OF BATEMAN HALL Director of Recreation and Community Services Perry Brents introduced the item regarding the Lynwood African American Advisory Council request for use of Bateman Hall. After discussion by the Council, it was moved by Council Member Rodriguez to approve the rental of Bateman Hall with the condition that the group purchase their own refreshments. After discussion by the Council, Council Member Rodriguez withdrew his motion and the Council decided it would be most appropriate for the Lynwood African American Advisory Council to go through the school district for this request. CITY COUNCIL ORAL AND WRITTEN COMMUNICATION Council Member Flores thanked everyone for attending the meeting. He asked everyone to let their neighbors and friends know about what happened in the council meeting and to encourage them to attend the meetings themselves. Council Member Rodriguez reminded everyone that city council meetings are held every first and third Tuesday of the month and stated that it is a pleasure to serve the residents. Council Member Santillan -Beas asked everyone to continue attending council meetings because regular attendance is important. Mayor Pro Tern Morton thanked everyone for attending the meeting. He encouraged residents to attend Block Watch meetings every fourth Tuesday of the month. He mentioned that while at the League of California Cities meeting he met a Beverly Hills Council Member who stated that even his city has the same problems as all other cities are facing. Mayor Castro thanked everyone for attending the meeting and for staying involved. She stated that she understands the need for bureaucracy and the need to learn how to maneuver through it. She asked for the residents' participation and communication with the Council. CLOSED SESSION City Attorney Fred Galante announced that the Council would recess to discuss two closed session items on the City Council agenda and one closed session item on the Lynwood Redevelopment agenda. The Council recessed to closed session at 6:25 p.m. The City Council reconvened at 7:02 p.m. City Attorney Fred Galante stated that the Council met in closed session and with respect to the following matters: Item #18. CLOSED SESSION ITEMS A. ADJOURNMENT Having no further discussion, it was moved by Mayor Castro, seconded by Council Member Rodriguez, and carried to adjourn the regular Lynwood City Council meeting at 7:06 p.m. Aide Castro, Mayor 41V Maria Quinonez, City Clerk
