Chairman Cordes Commissioners: - Horton, O'Leary, Cordes Commissioners: - Curran, Leung ALSO PRESENT: City Attorney Murphy, Planning Manager Starns, Associate Planner Gulick, Management Analyst Sun, and Community Development Secretary Venters Commissioner O'Leary made a motion to excuse Commissioner Curran and Vice - Chairman Leung for due cause seconded by Commissioner Horton and unanimously carried. 3. PLEDGE OF ALLEGIANCE 4. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA 5. CONSENT CALENDAR The Planning Commission is requested to review and approve: 1) Minutes of the Planning Commission Special Meeting of October 17, 2013. 2) Minutes of the Planning Commission Regular Meeting of October 22, 2013. Recommendation: Approve. Commissioner Horton moved to approve the Consent Calendar, seconded by Commissioner O'Leary and carried by Roll Call Vote. A TENTATIVE PARCEL MAP AND CONDITIONAL USE PERMIT TO ALLOW A 3 UNIT CONDOMINIUM SUBDIVISION ON A R -3 ZONED PROPERTY. Chairman Cordes opened the public hearing. City Attorney Murphy briefed Commissioner Horton regarding the continuance of the project. He advised that the public hearing is currently closed however the Planning Commission had the option to re -open the item for public comment. Commissioner Horton made motion to re -open the public hearing seconded by Commissioner O'Leary and unanimously carried. Engles Shen, project engineer, briefed the Planning Commission regarding compliance of the project. Jesse Lin, Temple City resident, expressed concern regarding the driveway width due to the proposed block wall. Chairman Cordes closed the public hearing. Commissioner O'Leary made a motion to approve Tentative Parcel Map 71596 and Conditional Use Permit 12 -1813 as amended, and find that the project is categorically exempt seconded by Commissioner Horton and carried by Roll Call Vote. A ZONE VARIANCE REQUEST TO ALLOW THE CONSTRUCTION OF AN ATTACHED THREE -CAR GARAGE WITH A FIVE -FOOT REAR SETBACK AS OPPOSED TO THE REQUIRED 15 -FOOT SETBACK PER CODE. THE SUBJECT PROPERTY IS IN THE R -1 (SINGLE FAMILY) ZONE. The request, however was required to be placed on the agenda as the public hearing notice had already been published at the time of withdrawal. Chairman Cordes opened the public hearing. Chairman Cordes closed the public hearing. City Attorney Murphy clarified that there is no motion to make as the application has been withdrawn. B. A REQUEST FOR A MODIFICATION OF CONDITIONAL USE PERMIT TO EXTEND HOURS OF OPERATION TO 11:OOAM TO 9:30PM AND TO PROVIDE OUTDOOR SEATING FOR AN EXISTING CHINESE RESTAURANT. CASE NUMBER: 130000077 APPLICANT: ZHONG WEI QI RECOMMENDATION: ADOPT A RESOLUTION TO APPROVE THE PROJECT Management Analyst Sun gave a PowerPoint presentation. Chairman Cordes opened the public hearing. Lydia Chunq, Temple City business owner, requested that the Planning Commission add a condition to require the applicant to build a five foot solid wall for privacy. Zhonq Wei Qi, applicant, agreed to amended condition of approval. Chairman Cordes closed the public hearing. A REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH A KOREAN RESTAURANT IN THE TEMPLE CITY MARKETPLACE. CASE NUMBER: 130000056 APPLICANT: BIG RICE RESTAURANT RECOMMENDATION: ADOPT A RESOLUTION TO APPROVE THE PROJECT Management Analyst Sun gave a PowerPoint presentation. Chairman Cordes opened the public hearing. Allison Fung, project designer, would like amend the hours of operation from 11 a.m. to 9:30 p.m. Gary Furtano, property owner representative, agreed to abide by the conditions of approval. Chairman Cordes closed the public hearing. Commissioner Horton made a motion to approve Conditional Use Permit 130000056 as amended, and find that the project is categorically exempt seconded by Commissioner O'Leary and carried by Roll Call Vote. MATTERS FROM CITY OFFICIALS Commissioner Horton expressed gratitude and his commitment to serving on the Planning Commission, however had missed meetings due to commute and various duties. 10. UPDATE FROM PLANNING MANAGER Planning Manager Starns updated the Planning Commission that a joint meeting of the Planning Commission and Parks and Recreation Commission will discuss the • • • Planning Commission Minutes November 7, 2013 Page 5 of 5 Pages Parks and Open Space Master Plan on November 12th, a workshop for the proposed Sign Code Update will take place on November 26th, and the draft Housing Element update, along with subdivision projects is scheduled for December 10th, and the Planning Commission Meeting of December 24th will be cancelled in observance of the Christmas holiday. 11.
