BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND:
WHEREAS, the City of Tybee Island is a duly organized municipality within the State of
Georgia; and
WHEREAS, the City owns certain real property within its limits, which is reflected on
the plat attached hereto; and
WHEREAS, the City has determined that it is in the best interests of its citizens, the City
and the public at large to promote recreational activities and educational programs and facilities
regarding marine life and environmental issues; and
WHEREAS, it is advisable and appropriate to make the property reflected on the attached
plat available by way of lease to the Marine Science Center, a non-profit corporation, for
purposes of constructing a public building to belong to the City but to be occupied by the Marine
Science Center; and
WHEREAS, the City has authority under its Charter to regulate right of way areas and to
provide for recreational uses and to take other actions consistent with these purposes; and
WHEREAS, the City has authority under its Charter to abandon, change, or close
roadways and to provide for recreational and other facilities and to take other actions consistent
with the purposes hereof; and
WHEREAS, the property reflected on the attached plat includes an unopened right of
way that is not appropriate for vehicular access or travel and has a significantly higher and best
use as a portion of the property for the structure to be constructed hereafter and to be subject to
the lease from the City to the Marine Science Center; and
WHEREAS, the Mayor and Council have deemed it advisable and appropriate to close
and discontinue any roadway use or plan of that certain right of way in the portion of the plat
attached hereto identified as Wrenwood Avenue for the purpose of such unopened and
unimproved right of way to be available for the building of the structure to be leased by the
Marine Science Center from the City;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council, in open meeting
duly assembled, as follows:
RESOLVED, that the Mayor and the Clerk of Council are authorized to execute that
certain lease agreement between the City and the Marine Science Center, subject to the terms and
conditions of such lease agreement ; and
BE IT FURTHER RESOLVED that the property depicted on the plat attached hereto be
available for the construction of a building to be owned by the City and occupied pursuant to the
lease agreement by the Marine Science Center and that portion of the property as described on
the plat attached hereto and designated as Wrenwood Avenue is deemed abandoned and ceased
to be recognized for public road purposes, but to be retained by the City as public property, so as
to be available as part of the property for the construction of the new facility.
